Abstract

Penelitian dalam tesis ini berjudul “Penerapan Pendaftaran Jaminan Fidusia Secara Elektronik oleh Kreditur Dinjau dari Peraturan Menteri Hukum dan Ham Nomor 9 Tahun 2013” dalam penelitian tesis ini mengkaji tiga rumusan masalah mengenai pendaftaran jamiinan fidusia secara elektronik, faktor apa saja yang menghambat dalam proses pendaftaran jaminan fidusia dan juga mengenai wanprestasi. Metode penelitian yang diterapkan dalam penelitian ini adalah penelitian normative yang mana digunakan dengan mengingat permasalahan yang diteliti yang berkaitan dengan materi yang dikaji berdasarkan peraturan perundang-undangan. Data penelitian ini di kumpulkan dengan cara studi pustaka, serta wawancara. Hasil dari penelitian dari tesis ini adalah bahwa penerapan asas publicitet adalah di wajibkan dikarekan termasuk asas yang wajib untuk di patuhi. Kendala dalam proses pendaftaran jaminan fidusia bukan kendala yang disebabkan oleh Notaris melainkan dari sistemnya yang terkadang error. Cara penyelesaian wanprestasi tidak ada bedanya dengan yang sebelum berlakukan perndaftaran secara elektronik, hanya saja jika jaminan fidusia didaftarkan maka besar untuk memiliki perlindungan hokum. Jika terjadinya wanprestasi maka dapat di selesaikan dengan cara litigasi maupun non-litigasi.

Abstract

Children must be protected from all forms of cruelty and oppression, in any form, even though there are already a set of regulations that protect children from the dangers of economic exploitation, and the problem of economic exploitation of children from year to year experiences very complex developments, so that child exploitation increases every year. annually indicates that there are significant obstacles that occur at the level of implementation. The discussion in this study is to analyze the factors that cause economic exploitation accompanied by violence against children, and criminal law policies in tackling child exploitation and as well as legal protection for child victims of economic exploitation accompanied by violence. This type of research is normative legal research. Based on the results of this study, it is concluded that the background that makes children victims of trafficking in persons is due to the motive of poverty, and difficulty finding work,  education, law enforcement against perpetrators of child exploitation crimes must be implemented strictly and indiscriminately, by implementing statutory regulations - promulgation along with the application of serious criminal threats is one step to be able to provide a deterrent effect for the perpetrators

Abstract

Intellectual property protection contributes significantly to national and international economic development. Indonesia as a developing country must be able to take appropriate steps to anticipate all changes and developments as well as global trends so that national goals can be achieved. Protection for communal intellectual property is one way to reduce the practice of biopiracy, while ensuring fairness and equal treatment between owners and users of communal intellectual property. There are at least three important ways that must be considered:  First, documentation of communal intellectual property is carried out through database development; Second, there is an obligation to fulfill the requirements for Communal intellectual property for which legal protection will be applied for, whether it has been in force or has been determined. Third, the owners of intellectual property rights, must show proof of approval for the use, distribution of ownership, or profit sharing from the owner of the communal intellectual property.

Abstract

This study examines the implementation of the horizontal separation principle in the regulation of buildings as objects of fiduciary collateral based on Government Regulation No. 16 of 2021, with a study focus on the City of Medan. This principle allows buildings to be used as fiduciary collateral without having to pledge the land on which the building stands, thus opening up new access to credit facilities. However, the implementation of this principle still faces various obstacles, including low understanding from business actors and financing institutions, as well as limitations in the administrative system and socialization of regulations. The results of the study show that although the Building Ownership Certificate (SBKBG) has been regulated as the legal basis for fiduciary imposition on buildings, its implementation is still not optimal due to limited supporting infrastructure and technical regulations for implementation. This study emphasizes the importance of strengthening socialization, harmonization of regulations, and the readiness of related institutions to ensure legal certainty and the effectiveness of the implementation of the horizontal separation principle in supporting the development of the fiduciary guarantee system. These findings are expected to contribute to the formulation of more inclusive and responsive policies in supporting the property financing sector in Indonesia.

Abstract

This study discusses the importance of mediator recommendations after the failure of fair industrial relations dispute mediation, in realizing a quick, appropriate, fair and inexpensive resolution. Mediation of industrial relations disputes led by an industrial relations mediator is one of the alternative options for resolving industrial relations disputes after the failure of bipartite negotiations, which is regulated in Law Number 2 of 2004 concerning the Settlement of Industrial Relations Disputes. However, in practice, the recommendations of industrial relations mediators are not always effective and are often ignored by the disputing parties. This has raised debate regarding the role and effectiveness of mediators in encouraging settlement through non-litigation channels before going to the Industrial Relations Court. This study uses a juridical-normative approach by analyzing laws and regulations related to mediation and settlement of industrial relations disputes. In addition, this study also explores the written recommendations of mediators in carrying out their functions, as well as the responses of the parties involved in the dispute to the written recommendations provided by the industrial relations mediator. The results of the study show that although the mediator's recommendations are non-binding, the mediator's role remains important in the initial resolution process. It is necessary to strengthen regulations and the role of mediators to increase compliance of the disputing parties, in order to reduce the burden of cases in industrial relations courts and encourage fast, appropriate, fair and inexpensive conflict resolution.

Abstract

Indonesia as a country that has problems in human trafficking, not only functions as a country of origin (source) and transit point for international human trafficking, but also as a country that receives victims. The increasing number of workers that is not accompanied by the availability of employment opportunities is a very complex problem to overcome. This research is a normative legal research, namely a legal study that positions law as a structured norm system. In Indonesian legal regulations, it has been regulated in Law No. 21 of 2007 concerning the Eradication of Criminal Acts of Human Trafficking related to legal accountability for criminal acts of human trafficking. This law also regulates the rights of victims to receive medical and social rehabilitation, repatriation, and reintegration that must be provided by the state, especially for those who experience physical, psychological, and social suffering due to the crime of human trafficking. Restitution prioritizes the perpetrator's responsibility for the impacts caused by the crime. Therefore, the main target is to handle all losses experienced by the victim.
