Having ratified CEDAW in 1984, Indonesia is obliged to eliminate gender-based discrimination that injure women’s rights and impair their position before the law. However, Compilation of Islamic Law in some parts still contradict CEDAW, e.g. the stipulations regarding marriage guardian, witnesses, age requirement, wife’s disobedience, and spouse’s rights and obligations. Sebagai konsekuensi dari ratifikasi Konvensi Perempuan pada 1984, Indonesia diharuskan menghapus diskriminasi gender yang melanggar hak perempuan dan merugikan kedudukannya dalam hukum. Namun ternyata KHI masih bertentangan dengan Konvensi tersebut. Hal ini dapat dilihat dalam pasal tentang wali nikah, saksi, batas usia perkawinan, nusyuz, dan hak dan kewajiban suami isteri.

Sebagian besar permohonan dispensasi perkawinan dikabulkan oleh Hakim terlebih apabila terdapat alasan yang mendesak. Namun kenyataan di lapangan faktanya tidak demikian, dimana tidak semua permohonan dispensasi perkawinan yang terdapat alasan mendesak disetujui oleh Majelis Hakim. Seperti halnya putusan dispensasi perkawinan Nomor 335/Pdt.P/2021/PA.Smd dimana permohonan ini tidak diterima dan putusan Nomor 153/Pdt.P/2021/PA.Smd ditolak. Penetapan Pengadilan Kelas 1A ini menarik untuk diteliti untuk melihat perbedaan pertimbangan Majelis Hakim dan alasan permohonan tidak diterima dan ditolak yang seperti kita ketahui adalah hal yang berbeda. Dalam penelitian ini penulis menggunakan penelitian hukum normatif dengan menggunakan metode penelitian kualitatif. Teknik pengumpulan data yaitu dengan observasi, dokumentasi, wawancara dan studi pustaka. Hasil dari penelitian ini yaitu dari sisi yuridis Majelis Hakim mempertimbangkan syarat formil dan materil dari permohonan. Permohonan Nomor 335/Pdt.P/2021/PA.Smd tidak diterima disebabkan oleh tidak terpenuhinya syarat formil dan syarat materil sedangkan permohonan dispensasi perkawinan Nomor 153/Pdt.P/2021/PA.Smd ditolak disebabkan tidak terpenuhinya syarat materil permohonan. Dari sisi Hukum Islam Majelis Hakim mempertimbangkan dispensasi perkawinan Nomor 335/Pdt.P/2021/PA.Smd dan Nomor 153/Pdt.P/2021/PA.Smd dengan melihat maslahat dan mafsadat dari kedua permohonan kemudian menggunakan kaidah fiqh dan maslahah daruriyah sebagai pertimbangannya.

The normative assurance of protection for women's and children's rights post-divorce has been extensively regulated through laws, including the Compilation of Islamic Law (KHI), the Supreme Court Regulation (PERMA), and the Supreme Court Circular Letter (SEMA). However, not all these regulations have been effectively implemented post-divorce in Indonesian Religious Courts. Hence, this article is written to understand how the implementation of post-divorce women's rights protection occurs in the Religious Courts, especially when the husbands are absent from the divorce trials (verstek judgments). This normative-doctrinal legal research utilizes the statutory and case law analysis of selected decisions from Samarinda and Sangatta Religious Courts. The findings indicate that the protection of post-divorce women's rights is not adequately realized, as not all the rights of former wives in the Religious Courts are adequately accommodated, especially the alimony (nafkah iddah). This is attributed to cases being decided in absentia of the husband, indications of the wife's disobedience (nushuz), low awareness of the wife regarding her rights, and the gender sensitivity of the judges not being maximum.

This study discusses interfaith marriages which have become an undeniable controversy in Indonesia with its religious diversity. Article 35a of the Population Law Number 23 of 2006 is the basis for regulating heterosexual marriages in order to obtain permission to conduct interfaith marriages and instruct the local population and civil registry office to make records. In decision No. 220/Pdt.P/2021/PN Bpp, for example, the judge permitted interfaith marriages by considering several applications, administrative files and witnesses brought by the applicant. The research method used is the normative legal approach method, namely a method that is a library legal research. The results of the study show that the Qur'an, Surah Al-Baqarah verse 221, clearly prohibits a group of people from carrying out interfaith marriages, however, in Law No. 1 of 1974, one of the judge's considerations in the Balikpapan District Court Decision Number 220. Registration of interfaith marriages involves the results of a decision from the district court so that it can be recorded by the local population and civil registry office.

Online mediation in divorce cases at the Samarinda Religious Court has factors that make the mediation carried out online, therefore there is an agreement between the two parties and the mediator is the person who helps with the mediation. The factor is the difference in area between the plaintiff and the defendant. The purpose of online mediation is first, to find out the application of online mediation in divorce cases at the Samarinda Religious Court. Second, to determine the effectiveness of online mediation in divorce cases at the Samarinda Religious Court. This research uses empirical-normative legal research methods with qualitative analysis. The data source used is primary data from the statements of 5 informants at the research location. And secondary data was obtained from primary legal materials from Perma No. 1 of 2016. The results of the first research, there were obstacles because the parties did not comply with the regulations regarding dishonesty of the parties, so that online mediation was not carried out well. The Family Planning (FP) program is an effort to control the number and spacing of births to maintain family welfare. In the Islamic perspective, contraception has long been acknowledged through the practice of 'azl, which is permitted as long as it is based on mutual agreement between husband and wife. However, debates arise when a wife decides to use contraception without her husband's consent, particularly when her health is a primary consideration. This article aims to analyze the Islamic legal perspective on a wife's decision to use FP without her husband's approval, employing a normative approach. The findings reveal that Islam provides flexibility for women to protect their health, even without their husband's consent, if the action is intended to safeguard the wife's well-being and life. The principles of maqashid shariah and the legal maxim la dharara wa la dhirara provide a legal basis for this decision. While consultation between spouses is encouraged, the wife's health remains a priority in Islam.

Islamic family law is a field of legal studies that is largely applied in Muslim countries today. Generally, the implementation of these laws takes the form of formal state legislation. Muslim countries from the Middle East, North Africa, South Asia to Southeast Asia almost all have family law legislation. This indicates that family law is a very important field of Islamic law as it is implemented evenly in the contemporary Islamic world. Muslim countries continue to strive for reforms and changes in family law legislation to address emerging issues in line with the times. This research aims to present the models of reform and the methods used by Muslim scholars or intellectuals in the reform of Islamic law in Muslim countries. The method used is a qualitative data approach as it is library research. This research found that there are three models of Islamic family law reform: 1) countries that do not undertake reforms, 2) countries that abandon conventional fiqh concepts and shift to liberal concepts, 3) countries that undertake moderate reforms in accordance with changing times. The methods used in these legal reforms are twofold: 1) Intra-doctrinal reform through takhayyur and talfiq, 2) Extra-doctrinal reform through maslahah mursalah, sadd al-dhari’ah, regulatory, siyasah syar’iyyah (administration), and court decisions.

This article discusses the execution of divorce decisions related to the fulfillment of child support after divorce, analyzed through the perspective of law enforcement according to Lawrence Friedman. The main focus is on how the legal system affects the implementation of child support obligations and the factors that influence its effectiveness. Using Friedman's three-element legal system theoretical framework—legal structure, substance, and culture—this article explores the obstacles and potential solutions in enforcing court decisions. The results of the analysis show that obstacles in the legal structure and community culture often hinder the implementation of child support obligations, even though the legal substance is adequate. Therefore, reforms in the legal system and increased public legal awareness are needed to ensure the welfare of children after divorce.

This study discusses marriage dispensation as a condition for release in child criminal cases. Marriage dispensation is a permit granted by the court to couples who wish to marry under the age specified by law. In the context of child criminal cases, marriage dispensation is often proposed as an effort to avoid criminal penalties for children involved in cases of extramarital pregnancy. This study uses an empirical legal research method (qualitative research), namely a research method that is used together to obtain accurate, valid, reliable, and objective results with an empirical-normative research system. Data analysis is carried out by reviewing and interpreting the data received to obtain a deep understanding of the practice of marriage dispensation in child criminal cases. This study aims to analyze the legal implications of marriage dispensation in child criminal cases and to understand the judge's considerations in granting the dispensation.

This study examines the progressivity of judges in deciding cases without the presence of the litigants (Verstek) which is linked to the fulfillment of women's rights in the Samarinda Religious Court and the Sagata Religious Court. This is because almost 80% of divorce case trials in the Religious Courts are not attended by the parties; So the case was decided by the judge through Verstek. This study was conducted to find out the influence of a Judge's progressivity on protecting the rights of women (wives) after divorcing their husbands. This research is a documentation study carried out by examining several Judges' decisions which were decided in Verstek both in cases of talaq divorce (divorce filed under the will of the husband) and contested divorce (divorce filed under the will of the wife). This study was carried out by using a case study approach combined with a legal study approach; while in the analysis stage, the author uses qualitative descriptive analysis methods. The results of the research conclude that in Verstek decisions the judges tend to be progressive in accommodating women's rights after divorce, both in cases of Talak divorce and contested divorce.
