Abstract

Although it is understood that the Tax Law is part of the Public Law, but the Tax Law has close links with the Civil Code and mutually concerned. That's because most of the Tax Law looking for basic possibilities for the collection of the events, circumstances and legal acts engaged in environmental civil, such as income, wealth, treaties submission, the transfer of rights as inheritance, compensation, debt relief, and so on. With the enactment of the tax in the form of the Act, means the tax is not a voluntary payment but as an obligation that must be followed so that if people do not meet their obligations will be sanctioned. From the standpoint of the Private Law, the tax in terms of the law is engagement arising from the Law (Tax Law) requires a person who fulfills the conditions prescribed by the Act to pay a sum of money to the treasury state that can be imposed. This research is to discuss the legal relationship between the obligation of natural person as part of Private Law and Tax Law as part of the Public Law.

Abstract

Undang-Undang Nomor 3 Tahun 2014 Tentang Perindustrian mengatur tata industri nasional menjadi lebih peduli terhadap lingkungan dengan mengusung paradigma pembangunan berkelanjutan. Norma pembangunan berkelanjutan diatur lebih lanjut melalui mekanisme Standardisasi Perindustrian. Sebagai konsekuensi Indonesia menjadi anggota WTO, regulasi standardisasi industri telah diperbarui dengan cara mengintegrasi ketentuan standardisasi dalam perjanjian Agreement on Technical Barrier to Trade. Penulisan artikel ini bertujuan mengetahui perbandingan kaidah standardisasi yang diatur Agreement on Technical Barrier to Trade dan UU Perindustrian serta hubungannya dengan pembangunan berkelanjutan. Hasil yang didapat adalah kaidah dari kedua sumber hukum tersebut identik dan terhubung sebagai instrumen pengaturan yang efektif dalam pembangunan industri dengan tetap menjamin aspek keamanan, keselamatan dan kesehatan manusia serta kelestarian fungsi lingkungan hidup.

Abstract

This research is motivated by the United States, which withdrew from the Paris Agreement because for the United States, the Paris Agreement is an agreement that weakens the economy. Following Article 28 of the Paris Agreement, this action raises problems that the United States cannot withdraw before 2020. In this case, there needs to be legal clarity in binding the country to global climate protection. The act of withdrawing the United States from the Paris Agreement would undoubtedly be a problem for the countries incorporated in it. In this case, the Paris Agreement continues to run as it should because the United States withdrew using the mechanisms contained in the Paris Agreement. Still, the United States continues to handle climate change because it does not come out of the Convention (UNFCCC). Then in the campaign and carbon trading, the United States should compensate for having left obligations as a developed country party following the Paris Agreement.

Abstract

It is an common matter when inefficiency bureaucracy take an advantage by cost and benefit. There is so many poor service in public sector where people need it. Grease, graft and bribery were some reason behind these problems and one from another become the manifestation of corruption. This thing is purchase and sale based the order resulted in high-cost economy. It is called corruption because discrimination for the public service was exist whos pay higher will become priority. Government seems tobe let it happen and all rules to direct the public was neglected. It’s all about the public service, the government should in charge or maybe we should know something inside bureacracy. This article would like to analyze not only merely the money spending but also to get the picture out inside bribery, grease, discretion and administration.

Abstract

This research is proposed to answer two questions: Firstly, to find out the cause of fictitious orders experienced by Go-Jek drivers in the Go-food menu in Go-Jek app. Secondly, to know the legal protection of Go-Jek drivers who suffered losses due to a fictitious plane in the Go-food menu on the Go-Jek app. And the research is directed to educate the public the importance of Civil law which governs agreement in the life of society. This study uses socio-legal approach with a number of resource persons. The choice of approach to socio-legal does not mean disregarding doctrinal side support on the grounds that one of the aims of this study sees a set of positive norms in relation to Legal protection of Go-Jek drivers, including legal theory support with a view to verifying the implementation of law in practice (protection and responsible). This study concludes that, Transactions using Go-Jek access has so far caused legal consequences among others who is responsible for the losses experienced by drivers, whether the Go-Jek party is responsible for the losses experienced drivers, including what kind of legal protection obtained by the driver when suffering application losses by irresponsible consumers. The factors of the emergence of fictitious orders are the existence of competitions between the Go-Jek driver, Go-Jek verification system is still weak, and the existence of bad faith in someone. Partnership agreement between PT. Go-Jek and Go-Jek’s driver is a standard clause that created and provided without involving the Go-Jek drivers in which there is a clause of transfer of responsibility because of PT. Go-Jek as the Go-Jek application service manager will not be responsible if there is a loss caused by the use of Go-Jek application. The legal relations and responsibilities of the parties should be clearly stipulated in the partnership agreement between PT. Go-Jek Indonesia, and Partners are created based on mutual agreement and agreement between both parties. To minimize the losses experienced by Go-Jek drivers in service delivery for every use of consumer spending service must have a Go-Pay account, which expenditures can not be executed if the balance in the Go-Pay account is insufficient to make an expense transaction.

Abstract

The border region is the front territory of the country jurisdiction and posses an important role in the matter of enforcement of national law sovereignty. Sebatik Island owned by two countries, Indonesia and Malaysia. Demarcation of territorial boundaries in Sebatik Island refers to Memorandum of Understanding between the Government of Malaysia and the Government of the Republic of Indonesia regarding Surveys and Demarcation of the Border Line of 1973 which is followed up with the results of a joint Surveys and Demarcation on the island of Borneo poured in the form of an advanced Memorandum of Understanding containing each boundary point which has been agreed upon.From 1973 to 2017 there are 9 (nine) points of Outstanding Boundary Problem (OBP) on Sebatik Island that have not been agreed by both countries. The boundary disputes have led to unclear legal status of Sebatik Island's land border territory within the framework of international treaty law and also led to the uncertainty of the status of the MoU as the legal basis for the determination of state borders between Indonesia and Malaysia on Sebatik Island.This law research questioning two issue. First, what factors make the border region not yet regulated by international agreements on borders. Second, how the legal status of the 1973 Memorandum of Understanding in stipulate the point of demarcation between Indonesia and Malaysia in the perspective of international treaty law. Based on the research, the factor that caused the border area not yet been regulated by a definitive border agreement is the disparity of reference between Indonesia and Malaysia to determining the land boundary in Sebatik Island. Indonesia uses the provisions of 4o 10 'LU degree while Malaysia uses existing pillar references. This dispute involve the overlap of the Sebatik Island border area from both countries. Thus, the legal status of the 1973 Memorandum of Understanding has not been binding as law either in national law or as an agreement in international law.

Abstract

AbstractAgreement on Technical Barriers to Trade has been agreed as part of the General Agreement on Tariffs and Trade /GATT and implemented by the WTO member states. In Indonesia, Act No.7/2014 About Trade adopted the system, such as standardization, technical regulations and conformity assessment. This research aims to get the enforcement of standardization according to Act No.7/2014 as compared with the provisions of the Agreement on Technical Barriers to Trade and to obtain the impact of standardization in reducing technical barriers to trade. The research is a normative legal research using comparative approach. The degree of object comparison is discussed using economic analysis of law. The result shows that economic analysis assumes rational behavior of the State to achieve maximum prosperity through multilateral trade agreements. Multilateral agreements are an efficient choice because it produces a universal agreement. Thus, the allocation of norms of standardization in Act No.7/2014 About Trade is assumed to sync with the Agreement on Technical Barrier to Trade, but there is a difference in controlling the equilibrium of treatment. Standardization is still considered to become potential for technical barriers of trade. The essence of this obstacle accounts as internal measures. AbstrakAgreement on Technical Barriers to Trade disepakati sebagai bagian dari perjanjian General Agreement on Tariffs and Trade (GATT) dan dilaksanakan oleh negara –negara anggota WTO. Di Indonesia, Undang-undang No.7 Tahun 2014 tentang Perdagangan mengatur norma yang diadopsi dari Agreement on Technical Barriers to Trade, yaitu standardisasi, regulasi teknis dan penilaian kesesuaian. Penelitian ini bertujuan untuk mendapatkan hasil pemberlakuan standardisasi menurut Undang-undang No.7 Tahun 2014 tentang Perdagangan yang dibandingkan dengan Agreement on Technical Barriers to Trade dan untuk mendapatkan dampak standardisasi dalam mengurangi hambatan teknis perdagangan. Metode penelitian yang digunakan adalah penelitian hukum normatif. Penelitian ini bersifat deskriptif dengan pendekatan perbandingan hukum. Derajat perbandingan objek penelitian dibahas menggunakan analisis ekonomi terhadap hukum. Hasil penelitian menunjukkan bahwa analisis ekonomi mengasumsikan perilaku rasional Negara untuk mencapai kemakmuran yang sebesar-besarnya melalui perjanjian dagang multilateral. Perjanjian multilateral merupakan pilihan sikap yang efisien karena menghasilkan perjanjian yang universal. Dengan demikian, alokasi norma standardisasi dalam Undang-undang No.7 Tahun 2014 tentang Perdagangan sinkron dengan Agreement on Technical Barrier to Trade. Standardisasi bekerja sebagai instrumen hukum dalam pasar bebas melalui perlindungan lingkungan, keselamatan konsumen, kemanan dan kesehatan publik. Instrumen standardisasi membantu konsumen membandingkan karakteristik produksi dan menambah preferensi bagi konsumen untuk produk sejenis.
