Abstract

Sociology of law is a studyof interrelationship between law and society. It is a branch of science to understand, observe, explain by empiric analytical approach regarding law problem confronted with other phenomenon in society. Sociology of law approach show us that the law of state is not the only behavior reference. In reality, the other laws are effectively complied by society.Based on Indonesia constitution, UUD 1945Article 31 Par 3, says the government shall manage and organize national education system to improve priesthood and faith and notable character. In related with bullying, which is a long stand phenomenon have been practically occur in the life of student, the prepetator will constantly intimidate and mocking their friends. It must be stopped due to the reason if the victim will descelerate attending the class. In sociology perspective, any violence is an abuse behaviour. Thus, the ethic enforcement generally coming from self awareness. The situation appear to be very critical to eradicate especially in the realm of education had been conducted systematically out of approaching framework.

Abstract

Today's labor competition is a problem, especially in the context of reducing unemployment in the region. Since regional autonomy the issue of labor has become a problem that is the authority of the regional government, so the regional government continues to work hard in overcoming the problem. This socio legal research wants to answer two problems, firstly, how the legal arrangement regarding the obligation to employ local labor force that applies. Secondly, knowing and analyzing the implementation related to the obligation to employ local workers based on the provisions of the Regional Regulation of Berau Regency, East Kalimantan Province. Law Number 4 Year 2009 Concerning Mineral and Coal only regulates the obligation to prioritize the use of local labor, likewise in Law Number 13 Year 2003 regarding Manpower there is no regulation on the obligation to employ local workers. This is different from Berau District Regulation No. 8 of 2018 concerning Protection of Local Workers which regulates the obligation to employ local workers as much as 80% (eighty percent) in the company.

Abstract

Menurut Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan (UU Ketenagakerjaan), pemagangan merupakan sub-sistem dari pelatihan kerja. Pemagangan dalam rangka pelatihan kerja tersebut dapat dibedakan lagi berdasarkan wilayahnya. pemagangan (magang) yakni pemagangan dalam rangka pelatihan kerja, pemagangan untuk tujuan akademis, dan magang untuk pemenuhan kurikulum atau persyaratan suatu profesi tertentu. Pemagangan dilaksanakan atas dasar perjanjian pemagangan antara peserta dan pengusaha yang dibuat secara tertulis yang sekurang-kurangnya memuat ketentuan hak dan kewajiban peserta dan pengusaha serta jangka waktu pemagangan yang termuat dalam Pasal 22 ayat (1) dan ayat (2) Undang-undang Ketenagakerjaan. Pasal 11 Undang-undang Nomor 13 Tahun 2003 menjamin setiap tenaga kerja berhak untuk memperoleh dan/atau mengembangkan kompetensi kerja sesuai dengan bakat, minat, dan kemampuannya melalui pelatihan kerja. Selanjutnya disebutkan bahwa pengusaha bertanggung jawab atas peningkatan dan/atau pengembangan kompetensi pekerjanya melalui pelatihan kerja (Pasal 12 ayat (1)). Pelatihan kerja diselenggarakan dan diarahkan untuk membekali, meningkatkan dan mengembangkan kompetensi kerja guna meningkatkan kemampuan, produktivitas dan kesejahteraan bagi tenaga kerja. Upaya pembinaan tenagakerja ditempuh melalui perencanaan dan program ketenagakerjaan seperti pelatihan, pemagangan dan pelayanan penempatan tenaga kerja. Program pelatihan kerja juga bertujuan menyiapkan tenaga kerja untuk mengisi kesempatan atau lowongan kerja.

Abstract

Lingkungan hidup merupakan bagian yang mutlak dalam kehidupan manusia, karena manusia dalam memenuhi kebutuhannya tergantung sekali dengan lingkungan. Dalam Pasal 1 Butir 1 Undang – undang Nomor 23 Tahun 1997 tentang Pengelolaan Lingkungan Hidup dinyatakan bahwa Kesatuan ruang dengan semua benda, daya keadaan dan makhluk hidup termasuk manusia dan perilakunya, yang mempengaruhi kelangsungan perikehidupan dan kesejahteraan manusia serta makhluk hidup lain. Dengan adanya perkembangan teknologi, maka semakin besar pula kesempatan untuk mendirikan industri oleh karenanya lingkungan hidup secara langsung akan terganggu karena efek samoing dari industri adalah limbah, sedangkan pertumbuhan penduduk memerlukan lahan baru bagi perumahan, pangan dan lapangan kerja. Undang – undang lingkungan hidup terdahulu (Undang – undang Nomor 4 Tahun 1982) tidak mengatur tanggung jawab korporasi terhadap pencemaran lingkungan, sedangkan di Undang - undang Nomor 23 Tahun 1997 pada pasal 45 dinyatakan, bahwa “tindak pidana sebagaimana dimaksud dilakukan oleh atau atas nama suatu badan hukum, perseroan, perseriktan, yayasan, atau organisasi ancaman pidana denda diperberat dengan sepertiga”. Dengan kata lain perbuatan pencemaran yang dilakukan oleh badan hukum dapat di kategorikan sebagai Kejahatan Korporasi. Abstract

The administrative court is established to settle the dispute between the government and its citizen. The dispute arises from a governmental act which is considered breaching citizen rights. It could be concluded that the administrative court principally is established to protect the citizen. In other terms, the purpose of administrative court actually not only to preserve the individual rights, but also to protect public rights and to be a media for the community to control any policies which are issues by the government in order to achieve good governance

Abstract

An unwritten employment agreement is a contract made verbally. Although verbal employment agreements do not violate existing laws and regulations, this form of agreement places workers in a vulnerable position. In the city of Samarinda, there are workers employed under unwritten agreements. Legal protection for workers with unwritten employment agreements is regulated by the Labor Law and the Job Creation Law. Workers in Samarinda who are employed under such agreements can seek legal protection by filing a report with the Department of Manpower and Transmigration of East Kalimantan Province.

Abstract

Child marriage is a social phenomenon that is rampant in the community, child marriage can be seen as a violation of the protection of children's rights and human rights that are contrary to various legal provisions and international agreements. The research method used is a Social Legal approach. The results of the study show that child marriage still occurs in marriage dispensations with various causal factors and tends to increase in Samarinda City. Marriage dispensations can legalize child marriage, which has the potential to violate children's rights, so it is necessary to carry out protective efforts as a form of prevention that must be carried out repressively and preventively as a form of security and comfort in protecting, maintaining and defending their rights.
