Abstract

The aim of this research was to determine the inheritance system of customary law in the District of Toba Batak society in South Lampung regency Natar. The method used is descriptive method. Data collecting techniques used observation, documentation, literature study, and interviews. Data were analyzed by using descriptive analysis techniques. There are system of inheritance in Batak Toba people. First individuality system, second mayorat system, and the last is minorat system. From the third inheritance system above district it can be concluded that the inheritance system of Batak Toba people who live in the south Lampung Natar still using the division of the estate system in accordance with the legal provisions.Tujuan yang ingin dicapai dalam penelitian ini adalah untuk mengetahui sistem pewarisan hukum adat dalam masyarakat Batak Toba di Kecamatan Natar Kabupaten Lampung Selatan. Metode yang digunakan adalah metode Deskriptif. Teknik pengumpulan datanya dengan observasi, dokumentasi, kepustakaan dan wawancara. Teknik analisis data menggunakan teknik analisis deskriptif. Sistem pewarisan pada masyarakat Batak Toba ada tiga sistem pewarisan yang pertama sistem pewarisan individual, sistem pewarisan mayorat dan yang terakhir sistem pewarisan minorat. Ketiga sistem pewarisan diatas maka di simpulkan bahwa sistem pewarisan masyarakat Batak Toba yang tinggal di Kecamatan Natar Kabupaten Lampung Selatan masih menggunakan sistem pembagian harta waris sesuai dengan ketentuan hukum adat Batak Toba.Kata kunci : batak toba, masyarakat, sistem pewarisan

Abstract

This research discusses the phenomenon of early marriage that occurs in Pinayungan Village, Karawang Regency, by highlighting the imbalance between legal norms and social norms prevailing in the community. Although legal regulations, such as Law No. 16 of 2019 and PERMA No. 5 of 2019, have regulated the minimum age of marriage and marriage dispensation procedures for the protection of children's rights, the practice of early marriage is still rampant. Through a juridical-sociological approach and qualitative method, this study explores the sociocultural factors behind early marriage, including the belief in the "itung-itungan" tradition and parents' concerns about promiscuity. Interviews with the Religious Affairs Office and one of the children who married early show that social norms in the community take precedence over formal state legal norms. This phenomenon reinforces the concept of "living law" proposed by Eugen Ehrlich. In addition to violating positive law, the practice of early marriage also causes violations of various children's rights guaranteed by the Child Protection Law and the Convention on the Rights of the Child, such as the right to education, health, decent work, and the right to grow and develop optimally. This study recommends the need for a culture-based legal approach to encourage the effective implementation of child protection and prevention of early marriage.

Abstract

The new Indonesian Penal Code (KUHP), introduced through Law No. 1 of 2023, represents a transformation of the national criminal law by dialectically adopting elements of Islamic Criminal Law (HPI). These reforms encompass sentencing, penal systems, and sanctions while emphasizing religious values, modern legal needs, and social harmony. This study employs a documentary-historical method to analyze the dialectics between Islamic law and the new KUHP, identifying five key elements: the principle of legality, unwritten law, criteria for unwritten law, retroactive principles, and the classification of criminal offenses.The analysis reveals that HPI significantly contributes to the new KUHP through concepts such as restorative justice, the principle of jalb al-mashalih wa dar’u al-mafasid (promoting benefits and preventing harm), and flexibility in the form of takzir. While the new KUHP successfully reflects values of democratization, recodification, and harmonization, certain HPI elements, such as the scope of unwritten law based on maqashid al-syari'ah and the application of retroactive principles for crimes with broad societal impact, are not fully accommodated. This study underscores the importance of synergy between Indonesian cultural values and religious law to create a functional, just, and sustainable criminal justice system.

Abstract

Protection of traditional knowledge in Indonesia has not had effective and adequate legal regulations, so it gives opportunities to irresponsible parties for in a manner unilateral claims and take advantage of the economic function of knowledge; that is, there is the utilization of traditional knowledge without permitting access to utilization and profit sharing fair and balanced. There need to be sui rules generis governing the concept of Prior Informed Consent (PIC) for access permission and appropriate and benefit sharing balanced with the idea of Access and Benefits Sharing System (ABS). This is research doctrinal, with approach statute approach to find out whether there have been regulations and norms governing the protection of traditional knowledge.Perlindungan pengetahuan tradisional di Indonesia belum mempunyai aturan hukum yang efektif dan memadai, sehingga memberikan peluang kepada pihak yang tidak bertanggung jawab untuk secara sepihak mengklaim dan memanfaatkan fungsi ekonomi dari pengetahuan tradisional tersebut, yaitu adanya pemanfaatan pengetahuan tradisional tanpa       adanya izin akses pemanfaatan serta pembagian keuntungan yang adil dan seimbang. Perlu adanya peraturan sui generis yang mengatur tentang konsep Prior Informed Consent (PIC) untuk ijin akses dan pembagian keuntungan yang adil dan seimbang dengan konsep Access and Benefit Sharing System (ABS).
