Abstract

Penelitian ini bertujuan untuk mendapatkan gambaran yang jelas tentang: 1) hambatan sufisme terliadap pendidikan kognitif. dan 2) sumbangan sufisme terliadap pendidikan afektif. Penelitian ini merupakan penelitian kualitatif dan menggunakan prosedur analisis isi. Sumber data utama adalah kitab A l-Risalah al-Qusyaihyyah. Sekurang-kurangnya ada tiga hal utama dalam sufisme yang menjadi penghambat pengembangan kemampuan kognitif, yaitu penghargaan yang terlalu tinggi kepada ilmu kasyaf daripada pengetahuan ilmiah empiris. pengutamaan perasaan (dzaug) dan pengalaman rohani daripada berpikir kritis, dan sistem pendidikan yang bersifat teacher centered. Selanjutnya, terdapat empat sumbangan sufisme bagi pendidikan afektif. yaitu berbagai potensi pengembangan dan pembinaan iman dan taqwa. potensi pendidikan budi pekerti, dan potensi metodc pendidikan yang praktis. Kata Kunci: sufisme, kognitif, afektif.

Abstract

The purpose of this research is to understand and analyze the role of mamak/uncle in marriage customs in Kuantan Hilir Seberang District, Kuantan Singingi Regency. The method used is descriptive qualitative method. interviews with traditional leaders and references to several books related to the research title. Being a mamak/uncle is very much needed by their nephews, especially in the marriage process. when his nephew wanted to marry a mamak who would prepare everything, especially making correspondence. As for the letter prepared by the mamak/uncle, the permit was then forwarded to the mamak balobe from the mamak balobe Barula to the mamak penghulu from the mamak penghulu to the village head. After the letter was signed, it was followed by a letter to the Office of Religious Affairs (KUA). If this process is neglected or violated, the marriage is null and void according to customary law.Keywords: The Role of Mamak/Uncle in Marriage Customs

Abstract

There are two types of marriage guardians: first, nasab guardians, namely guardians whose guardianship rights are based on blood relations. Such as, his biological parents, or also wali aqrab and ab'ad (closest or distant relatives). Second, the wali hakim is a guardian whose guardianship rights arise because the bride's parents refuse (adhal) or are absent, or for other reasons that physically exist but the guardianship rights do not exist. The emergence of the Itsbat Nikah provision is also related to the issue of the status of marriage registration. There are two views on the issue of the status of marriage registration, the first view states that marriage registration is only an administrative requirement, not a condition for the validity of a marriage, so marriage registration is only a process of obtaining evidence that a marriage has been carried out by someone, while the second view states that marriage registration is a valid condition for marriage. In this discussion, the author focuses on the consideration of judges who grant itsbat nikah cases where the previous marriage was held using an unofficial guardian or not the KUA head. This is not in accordance with article 23 of the Compilation of Islamic Law “(1) The new guardian judge can act as a marriage guardian if the nasab guardian is absent or impossible to present or his residence is unknown or absent or adlal or reluctant”. The Applicant's marriage guardian in the marriage contract was another person (a local community leader named Selan) due to the Applicant's non-Muslim biological father. The judge considered it as follows: that a kiyai, cleric or community leader who acts as a marriage guardian in Islamic law is known as wali muhakkam, namely someone who is appointed by the prospective husband and wife to act as a guardian in their marriage.

Abstract

One fundamental human need, which requires a highly specific solution, is the fulfillment of sexual desires, with marriage serving as its gateway. Therefore, a man who is already married may go to great lengths to marry again. Cross-border polygamous marriages involving Indonesian women and Malaysian men, conducted in Satun, Thailand, present a complex legal phenomenon. This study aims to analyze the implementation of laws governing such marriages under Indonesian, Malaysian, and Thai legal systems, as well as their impact on the legal status of the marriage, women's rights, and legal recognition in each country. The findings reveal that cross-border marriages often fail to fulfill registration procedures in the home country, rendering them legally unrecognized in Indonesia and Malaysia. In Thailand, Islamic law applied in Satun permits polygamy, but such recognition is local and does not automatically extend across national borders. This study recommends strengthening legal cooperation among countries to provide better legal protection for couples and related parties involved in cross-border marriages.

Abstract

Divorce is a global phenomenon with significant implications for children's rights. This study aims to conduct a comparative analysis of the fulfillment of children's rights after divorce in five countries with different legal systems: Qatar, Egypt, Indonesia, Malaysia, and Jordan. The research employs a normative juridical method with a comparative legal research approach through literature review and legal document analysis. The findings reveal that each country has a unique mechanism for ensuring children's rights after divorce. Diverse legal systems—ranging from common law, civil law, to Islamic law—lead to variations in approaches to ensuring custody, care, and protection for children. The study identifies four critical dimensions in fulfilling children's rights: the right to survival and development, the right to protection, the right to education, and the right to participation. The comparative analysis highlights that cultural factors, legal systems, and political commitment play a fundamental role in determining the effectiveness of child rights protection after divorce. Key recommendations of this study include the need for regulatory harmonization, strengthening enforcement mechanisms, and developing sustainable monitoring systems. This research provides theoretical and practical contributions to understanding the complexity of fulfilling children's rights across global legal systems.
