Abstract

Indonesian construction consulting services are facing a complex problem in fulfilling the nation’s expectations regarding high quality infrastructure development and the construction industry’s competitiveness. A study of this problem and a formulation of solutions to improve the situation are presented in this paper. A survey was carried out in Jakarta, West Java, East Java, and North Sumatra provinces to collect data related to this problem. A focus group discussion and a workshop with all stakeholders were conducted to formulate improvement actions that need to be taken. It was revealed that the problems faced include, among others, the limited number of professional engineers compared to the number of national consultancy companies, the uneven distribution of engineers in Indonesian regions, an imperfect procurement system, and low-quality work output in general. Recommended actions include improvement of the government’s role in consulting services nurturing and facilitation, development of partnerships, and amelioration of the professional engineer and consultant certification system.

Abstract

Penyelenggaraan jalan tol sudah dimulai di Indonesia sejak tahun 1978 yang pengelolaannya dilaksanakan oleh Pemerintah melalui pembentukan dan penunjukan PT Jasa Marga. Selama periode 1978 sampai 1988 tingkat pertumbuhan jalan tol hanya 26,88km/tahun. Rendahnya pertumbuhan jalan tol mendorong pemerintah mulai mengikutsertakan swasta dalam pengelolaan melalui skema Kerjasama Pemerintah Swasta (KPS). Pada periode kedua ini dengan adanya perubahan sistem penyelenggaraan, PT Jasa Marga berperan sebagai regulator sekaligus operator jalan tol. Namun, periode 1989 sampai tahun 2004, tingkat pertumbuhan jalan tol menurun menjadi 23km/tahun. Peran ganda PT Jasa Marga ditengarai sebagai penyebab turunnya pertumbuhan jalan tol. Semenjak tahun 2004, sistem penyelenggaraan jalan tol diubah dimana peran regulator dikembalikan kepada Pemerintah melalui pembentukan Badan Pengatur Jalan Tol (BPJT). Pemerintah juga melakukan beberapa perubahan pada kerangka hukum penyelenggaraan jalan tol. Perubahan sistem penyelenggaraan jalan tol ternyata tidak dapat meningkatkan kinerja sistem dengan menurunnya tingkat pertumbuhan jalan tol menjadi hanya 21,43km/tahun. Makalah ini bertujuan untuk mengembangkan kerangka pengukuran kinerja sistem penyelenggaraan jalan tol yang kemudian dapat diaplikasikan untuk mengukur kinerja sistem saat ini. Diharapkan dengan pengukuran kinerja maka dapat teridentifikasi permasalahan yang menyebabkan rendah tingkat pertumbuhan jalan tol. Kerangka pengukuran mencakup elemen tata kelola KPS, elemen kerangka hukum serta elemen kerangka institusional. Melalui kajian literatur yang intensif maka studi mengidentifikasi 44 indikator-indikator yang dapat digunakan sebagai kerangka pengukuran kinerja sistem penyelenggaraan jalan tol.

Abstract

Abstract Performance Based Contract is an innovation maintenance contract to improve the quality and value-added of the national road service. Under this contract, the performance of contractors is not evaluated by the input and processes, but by the output and outcome performance indicators which had already clearly been defined and measurable. Contractors are free to establish what, when, how, and where the maintenance work is performed. With its creativity and innovation, the contractor can increase the added value of maintenance work to more directly meet the road user expectations. Since 2011 the Directorate General of Highways has been trying to implement the Performance Based Contract, but the condition of the national road service is not ideal yet, characterized by the frequent of overloading, the provisions of program development and preservation are not yet firm, the design life, road damage, and construction failure that have not been applied resulting in the need for adjustment to the initial concept of the Performance Based Contract. This paper discusses the adjustments made, the deviation of the basic concepts of the Performance Based Contract, analysis of the problems faced, and the challenges to be overcome to enhance the concept of the Performance Based Contract for national road maintenance in the future. Keywords: Performance Based Contract, National Road, overloading, road maintenance  Abstrak Performance Based Contract (PBC) merupakan kontrak inovasi pemeliharaan untuk meningkatkan mutu dan nilai tambah penyelenggaraan jalan nasional. Dalam kontrak ini, kinerja pemeliharaan kontraktor tidak dinilai dari input dan proses, tetapi melalui indikator kinerja output dan outcome yang telah lebih dulu didefinisikan dengan jelas dan terukur. Kontraktor bebas menetapkan apa, kapan, bagaimana, dan di mana pekerjaan pemeliharan dilakukan. Dengan kreativitas dan inovasinya, kontraktor dapat meningkatkan nilai tambah pekerjaan pemeliharaan untuk lebih langsung memenuhi harapan pengguna jalan. Ditjen Bina Marga semenjak tahun 2011 telah melakukan uji coba penerapan PBC, namun kondisi penyelenggaraan jalan nasional yang belum ideal ditandai oleh seringnya beban berlebih, ketentuan program pembangunan dan preservasi yang belum tegas, umur perencanaan, kerusakan, serta kegagalan bangunan yang belum diterapkan mengakibatkan perlunya dilakukan penyesuaian terhadap konsep initial PBC. Makalah ini membahas penyesuaian yang dilakukan, penyimpangannya terhadap konsep dasar PBC, analisis terhadap permasalahan yang dihadapi, dan tantangan yang masih harus diatasi untuk mengembangkan konsep PBC pemeliharaan jalan nasional di masa yang akan datang. Kata-kata kunci: Performance Based Contract, jalan nasional, beban berlebih, pemeliharaan jalan

Abstract

Abstract This paper is aimed to analyze Supported Build Operate Transfer as an alternative toll road development financing scheme in the Public Private Partnership framework. Support alternatives analyzed include construction grant, operation grant, tax holiday, and soft loan. The adopted approach consists of classifying groups of non-financially feasible toll roads based on the main causes, analyzing effective support alternative for each group, and performing sensitivity analysis to measure the relationship between the condition of financial infeasibility and the extent of the needed support. Analysis results show that the most effective support is construction grant (investment cost) and operation grant (revenue improvement) while supports in form of tax reduction or decrease of discount rate are very marginal. The analysis also indicate that Supported Build Operate Transfer is effective to be granted to toll roads that need relatively high investment cost but have low revenue. Meanwhile, for toll roads that need high investment cost and have high revenue, it is not suggested to apply Supported Build Operate Transfer. For toll roads with low investment cost and low revenue, the government has to get involved by applying Availability Based Payment scheme as in this case, besides support at initial phase, support during operation phase would also be needed. Keywords: toll road, Public Private Partnership, Supported Build Operate Transfer, Availability Based Payment  Abstrak Makalah ini bertujuan untuk menganalisis Supported Build Operate Transfer sebagai alternatif skema pembiayaan pembangunan jalan tol dalam kerangka Kerjasama Pemerintah dan Badan Usaha. Dukungan alternatif yang dianalisis meliputi hibah konstruksi, hibah operasi, tax holiday, dan soft loan. Pendekatan yang diadopsi terdiri atas penggolongan kelompok jalan tol yang tidak layak secara finansial berdasarkan penyebab utamanya, menganalisis alternatif dukungan yang efektif untuk masing-masing kelompok, dan melakukan analisis sensitivitas untuk mengukur hubungan antara kondisi ketidakseimbangan keuangan dan tingkat dukungan yang dibutuhkan. Hasil analisis menunjukkan bahwa dukungan yang paling efektif adalah hibah konstruksi (investment cost) dan hibah operasi (revenue improvement) sementara dukungan dalam bentuk pengurangan pajak atau penurunan tingkat diskonto sangat marjinal. Analisis juga menunjukkan bahwa Supported Build Operate Transfer efektif untuk diberikan pada jalan tol yang membutuhkan biaya investasi yang relatif tinggi namun memiliki pendapatan rendah. Sedangkan untuk jalan tol yang mem-butuhkan biaya investasi tinggi dan memiliki pendapatan tinggi, tidak disarankan untuk menerapkan Supported Build Operate Transfer. Untuk jalan tol dengan biaya investasi rendah dan pendapatan rendah, pemerintah harus terlibat dengan menerapkan skema Available Based Payment, seperti pada kasus ini, selain dukungan pada tahap awal, dukungan selama tahap operasi juga akan dibutuhkan. Kata-kata kunci: jalan tol, Kerjasama Pemerintah dan Badan Usaha, Supported Build Operate Transfer, Availability Based Payment

Abstract

Berdasarkan Permen PU PR No.1 tahun 2017 tentang Tatacara Pelaksanaan Pengadaan Badan Usaha Untuk Pengusahaan Jalan Tol, salah satu bentuk dukungan pemerintah untuk meningkatkan kelayakan finansial pada investasi jalan tol adalah dengan membangunkan sebagian konstruksi. Dukungan ini sudah diimplementasikan pada beberapa ruas jalan tol diantaranya: Cileunyi-Sumedang-Dawuan, Solo-Ngawi-Kertosono, Manado-Bitung, Balikpapan – Samarinda dll. Dalam pemberian dukungan tersebut tentu pemerintah dan badan usaha akan menghadapi risiko-risiko. Risiko –risiko tersebut perlu diketahui untuk dilakukan mitigasi pada risiko-risiko yang besar. Pada studi ini dilakukan identifikasi risiko secara kualitatif berdasarkan tahapan proses pemberiannya. Identifikasi dilakukan atas dasar studi literatur kemudian dilakukan validasi berdasarkan wawancara untuk menentukan risiko-risko yang kemungkinan besar akan terjadi. Berdasarkan hasil kajian diketahui risiko yang kemungkinan akan besar terjadi adalah ketersediaan anggaran yang terbatas sementara kebutuhan dukungan untuk investasi jalan tol akan sangat besar, proses pengajuan penjaminan akan memerlukan waktu proses yang lama, risiko peserta lelang sedikit, risiko keterlambatan konstruksi oleh pemerintah maupun badan usaha, risiko perbedaan kualitas untuk yang dibangun oleh pemerintah dan badan usaha, dan risiko timbulnya biaya evaluasi bagi badan usaha atas pekerjaan yang dilakukan pemerintah.

Abstract

The coastal area has a very strategic value because the city nearby this area can bedeveloped as a port city, recreation and conservation. Development of coastal areas requires professional human resources. Professional credentials for individuals can be attained through professional certification. This paper presents the procedure of professional certification base on Decree no. 11,2014 on Engineering. This study is a descriptive and qualitative research, carried out through the stages of literature study and data collection include professional competence assurance system, profession licence, qualification assurance systems engineering profession. Data were analyzed reference to best practices certification procedure in Malaysia, Singapore and the Philippines. The study show there are two stages of examinations and three standards in the certification procedure. The examinations are professional examinations and competence examinations. Professional examinations held in the Professional Engineers Program while competence examinations organize byProfessional Certification Body. The standard that used are the Engineers Service Standard, Engineers Competency Standard, and Engineers Professional Program Standard. All of these standards underlying the certification engineering procedure. Institutions directly involved in the certification process are the Board of Engineers Indonesia, Higher Education that organizer Profession Engineers Program, Professional Certification Body, and The Institution of Engineers Indonesia

Abstract

Salah satu fenomena sektor industri konstruksi periode lima tahun terakhir (2015-2020) adalah fakta data kepemilikan sertifikat Sistem Manajemen Keselamatan dan Kesehatan Kerja (SMK3) perusahaan mengalami kenaikan mendekati 70% (2017) namun tingkat kecelakaan kerja tidak mengalami penurunan bahkan mengalami kenaikan mendekati 40% (2017) (data Kemenaker RI). Persentase terbesar dari kecelakaan kerja tersebut disumbang oleh sektor konstruksi yaitu 32%. Melalui Permen PUPR RI No. 21/PRT/M/2019 pasal.3 ditegaskan bahwa setiap penyedia jasa harus menerapkan Sistem Manajemen Keselamatan Konstruksi (SMKK) dalam penyelenggaraan Jasa Konstruksi. PP No.50 tahun 2012 juga mewajibkan SMK3 bagi perusahaan yang memiliki potensi bahaya tinggi, yang salah satunya adalah perusahaan sektor konstruksi. Penerapan sistem tersebut secara terintegrasi dalam perusahaan konstruksi akan menimbulkan tantangan serta dampak, bagi perusahaan maupun proyek secara khusus. Makalah ini mencoba menyajikan hasil pengambilan informasi terkait tantangan dan dampak kondisi tdiatas melalui metode indepth interview online yang dilakukan oleh peneliti terhadap stakeholder PT. XX (persero). Informasi dan data yang didapat akan dibandingkan dan disinkronisasikan dengan beberapa hasil penelitian sebelumnya. Dan kesimpulan penelitiani ni adalah penerapan terintegrasi SMK3 dan SMKK dapat dilaksanakan oleh PT. XX (persero) dengan salah satu cara dengan memodifikasi form isian agar dapat digunakan secara bersamaan dalam audit SMK3, SMKK dan bahkan ISO 45001.

Abstract

Abstrak Sejak tahun 2015 pemerintah terus mendorong penyelenggaraan infrastruktur melalui Kerjasama Pemerintah Badan Usaha (KPBU). Berdasarkan Perpres 30/2015 KPBU tidak hanya untuk pemerintah pusat  tetapi juga untuk pemerintah daerah yang dikenal dengan nama Kerjasama Pemerintah Daerah Badan Usaha (KPDBU). Availability Payment (AP) merupakan salah satu bentuk KPDBU dimana pemerintah melakukan pembayaran untuk kinerja yang dihasilkan Badan Usaha tanpa bergantung pada demand. Kota Bandung sudah lama merencanakan untuk melakukan KPDBU melalui AP tetapi belum terlaksana, contohnya untuk penerangan jalan umum (PJU). Tujuan Penelitian ini adalah melakukan kajian terhadap konsep AP untuk infrastruktur daerah meliputi kajian anggaran, institusi dan regulasi pada rencana penyelenggaraan KPDBU PJU Kota Bandung. Penelitian dilakukan berdasarkan data sekunder dan data primer. Data sekunder terkait anggaran, peraturan, dan struktur organisasi. Adapun data primer dilakukan berdasarkan wawancara dan FGD dengan nara sumber kementerian keuangan, bappenas, Pemerintah Kota Bandung, dan PT Penjaminan Infrastruktur Indonesia. Hasil kajian menunjukkan bahwa 1. Dari aspek biaya, tren PAD Kota Bandung meningkat sehingga dapat diandalkan untuk pembayaran AP; 2. Berdasarkan regulasi Kota Bandung belum memiliki Perda terkait KPDBU; dan 3. Kota Bandung belum memiliki Simpul KPBU sehingga belum jelas siapa yang akan bertanggung jawab penyelenggaraan KPDBU di Kota Bandung Kata kunci: KPDBU, availabilty payment Abstract Since 2015 the government has continued to develop infrastructure by Public Private Partnership (PPP). Based on Presidential Decree 30/2015, PPP is not only for the central government but also for local governments, which is known as the local  Government PPP (KPDBU). Availability Payment (AP) is a form of KPDBU where the government makes payments for performance by Business Entities without depending on demand. The city of Bandung has long planned to carry out KPDBU by AP but it has not been implemented, for example for public street lighting (PJU). The purpose of this study was to conduct a study of the AP concept for regional infrastructure including a study of the budget, institutions and regulations on the planned implementation of the KPDBU PJU City of Bandung. The research was conducted based on secondary data and primary data. Secondary data related to budgets, regulations, and organizational structure. The primary data was conducted based on interviews and FGDs with sources from the Ministry of Finance, Bappenas, Bandung City Government, and PT Penjaminan Infrastruktur Indonesia. The results of the study show that 1. From a cost perspective, the trend of Bandung City's locally revenue is increasing so that it can be relied upon for AP payments; 2. Based on regulations, the City of Bandung does not yet have a local regulation related to KPDBU; and 3. The city of Bandung does not yet have a PPP Node, so it is unclear who will be responsible for implementing KPDBU in the city of Bandung. Keywords: Local government PPP, availabilty payment

Abstract

Referring to PPP Books 2017-2023 issued by The Ministry of National Development Planning of Indonesia, there is only 1 out of 16 AP PPP projects at the municipal/regency level that have successfully reached the operational stage (6% success rate), i.e. Madiun Regency Public Street Lighting. Several municipal/regency AP PPP projects have failed, for example, Bandung Municipal Public Street Lighting. The widespread failures indicate that the application of AP in regional infrastructure has so far not been successful in Indonesia. This paper aims to identify the basic requirements, critical success factors, and lessons learned from AP PPP implementation in Municipal/Regency Governments. Thus, it is hoped that the future provision of regional infrastructure with the AP scheme can proceed seamlessly. This study used a mixed-method approach that combines qualitative and quantitative data from literature reviews, questionnaires, and interviews. The results showed that the basic requirements for AP PPP include the existence of regulations and institutions. The five main success factors of AP PPP in the Municipal/Regency Government are (1) a well-organized and committed public agency; (2) political support; (3) favorable and efficient legal framework; (4) stable political and economic situation; and (5) public and private sector commitments and responsibilities. The lesson learned from the case study is that fiscal capacity is not the main factor in the success of PPP in Madiun Regency, but rather the willingness of the local government to implement PPP by regularly holding capacity building and maintaining good relationships and communication with each stakeholder involved.
