Abstract

The  1945  Constitution  of  Indonesian  Republic  (UUD  1945)  has  been  a  set  of  sacred  norm and national administration reference for four decades. However, since the reform era Indonesian people are now able to review, discuss, and criticize its content consistent with recent national progress. Amendment of the 1945 Constitution becomes a new momentum to improve the state’s management, which has apparently deviated from the country’s foremost objectives written in the national philosophy of “Pancasila”. In response to the amendment, there are three diverse perspectives that highlight its process. First, there are people who wish to keep the ori ginality of the 1945 Constitution. Second, there are individuals who agree with the last amendment of the 1945 Constitution. Lastly, there is a public view which supports the continuous amendment process of the 1945 Constitution until it achieves the supreme mandate of the country and the people. This paper will focus on the third perspective as the main issue of discussion. UUD 1945 telah menjadi norma yang sakral dan referensi administrasi nasional selama empat dekade ini.Akan tetapi, sejak era reformasi masayarakat Indonesia mampu mereview, endiskusikan dan mengkritik isi dari UUD 1945 seiring dengan keajuan bangsa saat ini. Perubahan UUD 1945 menjadi momentum untuk meningkatkan manajemen Negara yang nampaknya menyimpang dari tujuan Negara pada awalnya yang tercantum dalam pancasila. Dalam menyikapi perubahan UUD 1945 tersebut, ada tiga pendapat yang berbeda yang menggarisbawahi proses tersebut. Yang pertama, sebagian masyarakat menginginkan keaslian dari UUD 1945. Yang kedua, sebagian masayarakat menginginkan perubahan terkhir dari UUD 1945. Yang  terakhir,  ada  pendapat  publik  yang  mendukung  keberlanjutan  dari  proses  perubahan UUD 1945 hingga mencapai mandat tertinggi dari Negara dan rakyat. Tulisan ini secara fokus akan mendiskusikan isu dari pendapat yang terakhir dari amandemen UUD 1945

Abstract

There are some changes towards law protection of human rights. UUD 1945 is not as accommodative as RIS constitution. To overcome the problems, the government made an amendment to UUD 1945 section 28, to give more law protection for human right.

Abstract

Higher education in Indonesia plays a pivotal role in preparing a generation ready for the professional world. The curriculum of the Master's Program in Sharia Science at UIN Sunan Kalijaga Yogyakarta is integral to this mission. However, this research identifies gaps in the curriculum that do not fully align with alumni needs and job market demands. A field study involving 104 alumni from September 2018 to August 2022 was conducted using a descriptive-analytical method with an empirical approach. Data was collected via a survey sent to alumni and analyzed using Ralph W. Tyler's theory and James A. Banks' multicultural education theory. Findings reveal that courses like Fiqh Studies, Sharia Science, and Islamic Family Law in Indonesia were highly valued and should be further developed. Conversely, courses such as Falak Science and Arabic Text Reading were seen as less relevant and suggested for removal. Additionally, the replacement of the final project with journal publication was criticized. The analysis suggests that the curriculum should evolve to better reflect societal diversity and complexity. The proposed changes emphasize developing relevant courses and revising or eliminating those deemed less beneficial. These recommendations aim to ensure that the Sharia Science Master's Program remains responsive, inclusive, and capable of producing graduates who can compete in the global era.

Abstract

This study focuses on the phenomenon of politicised law enforcement in corruption cases during election years, where legal actions are suspected of being used as political tools to weaken opponents and maintain power. Consequently, law enforcement is perceived as "by order" and heavily influenced by vested interests. This entanglement between politics and law is attributed to a lack of integrity and moral values among the involved actors, further undermining democratic practices and justice. This study analyses how the politicisation of law occurs in the electoral context and its impact on law enforcement and proposes a solution to prevent the politicisation of corruption in law enforcement through local wisdom-based approaches. This research employs a socio-legal method, analysing secondary data from various corruption cases exposed ahead of the 2014, 2019, and 2024 elections. This analysis includes literature reviews, investigative reports, and data from law enforcement agencies. Findings indicate a consistent pattern where corruption in law enforcement involving public officials tends to intensify as elections approach, suggesting efforts to politicise the law. Such politicisation negatively impacts genuine anti-corruption efforts by casting the law as a political instrument rather than a means of upholding justice, thus degrading the dignity of law enforcement and affecting public perception. Taking Malaysia as an example in successfully improving its Corruption Perceptions Index (CPI), this study underscores the importance of strengthening integrity by instilling moral values rooted in local wisdom, such as "Hasta Brata" and the "nine anti-corruption values." These efforts are essential to establishing dignified democratic practices and fair law enforcement that are free from corruption, collusion, and nepotism.

Abstract

The phenomenon of Rohingya refugees in Aceh, Indonesia, presents complex challenges in refugee management, particularly amid regulatory limitations and evolving social dynamics. Based on this context, this study aims to elucidate the dominant role of Islamic law understanding in Aceh in addressing the Rohingya refugee issue, employing Michael Mann's theory of power networks as an analytical framework. This research employs a qualitative, descriptive-analytical approach involving in-depth interviews with 15 informants, including UNHCR staff, activists, local communities, and refugees. Secondary data were obtained from literature and policies on refugee management in Indonesia. The findings indicate that the Acehnese community's understanding of Islamic law, as reflected in ukhuwah Islamiyah and local values such as peumulia jamee, serves as a key factor in accepting refugees. The principle of ukhuwah Islamiyah, rooted in the Qur'an, Hadith and the objectives of Sharia (Maqāṣid al-Sharīʿah), provides the moral and legal foundation for supporting international solidarity. However, challenges arise in social tensions, negative media coverage, and suboptimal implementation of Presidential Regulation No. 125 of 2016 concerning the Handling of Refugees from Abroad. From the perspective of power network theory, this study finds that the ideological network based on Islamic legal values dominates community solidarity. Meanwhile, economic, political, and military networks struggle to balance resource distribution and harmonising local and international policies. The scientific contribution of this research lies in its discovery that Islamic and local values dominate other power networks in refugee management in Aceh. The study recommends the formulation of a qanun on refugee management that aligns with local values as a model for similar contexts in other regions

Abstract

This research focuses on the October 2023 conflict between Israel and Hamas, analyzing violations of international law committed by both parties under the 1949 Geneva Conventions. Using a qualitative document-based approach, the study investigates actions taken by Israel and Hamas during the first ten days of the conflict. It examines the jus ad bellum and jus in bello violations, such as Hamas's unprovoked attacks on Israeli civilians and Israel's disproportionate retaliatory strikes in Gaza. Both parties violated the Geneva Conventions: Hamas breached Article 51 by launching attacks without declaring war and targeting civilians. In contrast, Israel's retaliations violated the principle of proportionality by causing excessive civilian harm. Israel's blockade of Gaza also violated humanitarian law, as it denied civilians access to essential goods. The research identifies legal obligations under international law, noting that while Israel is a state party to the Geneva Conventions, Hamas, as a non-state actor, is bound by customary international law. The study concludes that both sides committed war crimes, requiring legal accountability through international mechanisms. The findings contribute to ongoing discussions about the challenges of enforcing international law in asymmetrical conflicts involving state and non-state actors.KEYWORDS: International law, Justice of war, Israel-Palestine dispute, Use of force.

Abstract

Massive demonstrations  in  several  Arab  countries  lead to a civil war among the citizens. This is of special concern to the United  Nations  as  the  global  nature  of  international organizations  to  participate  in  the  intervention  of  the  conflict accompanied  by making  resolutions.  These cases are  suing  back the  legitimacy  of  international  law,  especially  international organizations  like  the  UN.  In  this  study  describes  about  the legitimacy  of  the  UN  Security  Council  resolutions,  and  thenapply  it  to  analyze  the  conflict  in  Darfur.  The  UN  is  an international  organization  which  is  the  subject  of  public international  law,  so  that  the  resulting  public  policy  becomes legally  binding  for  member  states  based  on  the  collective legitimation.  In  the  application  of  collective  legitimation  is  in practice  often does not  correspond to  the value of  morality  and even  a lot of  opposition  as in  the case of  the conflict in  Darfur whose governments  openly  reject the  contents of  the resolution issued by the United Nations.

Abstract

Tulisan ini membahas tentang interrelasi dan interkoneksi antara hermeneutika sebagai metode penafsiran dalam Al-Qur’an dan ushul fiqh sebagai metode berfikir dalam tradisi Islam, yang dimulai dengan pengenalan tentang hermeneutika dan sekilas tentang beberapa alirannya. Kemudian tulisan ini dilanjutkan dengan membahas tentang ushul fiqh dan bagaimana pertalian (interrelasi) dan hubungan (interkoneksi) antara hermeneutika dan ushul fiqh beserta analisa tentang relasi dan koneksi antara keduanya. Hermeneutika dan ushul fiqh memiliki keterkaitan mengingat hermenutika bisa dijadikan sebagai salah satu metode dalam ushul fiqh yaitu  metode al-Ma’thur  dan  al-Ra’yu  yang menggunakan akal.

Abstract

Massive demonstrations that occurred since 2010 in several Arab countries (Arab Spring) sparked the attention of the UN Security Council to undertake humanitarian intervention, including in Libya which started in February 2011 with the use of armed force undertaken by NATO and some other big countries. Humanitarian intervention is a recommendation of the UN Security Council Resolution 1973 of 2011, under Chapter VII of the UN Charter, 1945. In doing humanitarian intervention, state and international organizations must have the recommendation of the UN Security Council, but the Security Council should also get legitimacy from the international community. Humanitarian intervention is also required to have humanitarian objectives to protect human rights. In this paper discusses the legitimacy given by the international community to the humanitarian intervention of the UN Security Council on Libya.

Abstract

Tasikmalaya is an area that strives to formalize the  Shari'ah in  the  form  of  regional  regulation.  Some  rules  are  made  in order  to support  such  efforts.  In  looking  at  the  effectiveness  of  the enforcement of the law, the legal system is used as a perspective in this study.  The  paper  looked  at  the  implementation  of  the  Regional Regulation  Sya'riat  Islam  in  the  three  elements  of  the  legal  system. Based on the substance of the law, there are several provisions of the regulations that contain bias and allow violence against minorities, such as  the  word  Muslim  and  misleading.  In  terms  of  legal  structure, authorities in charge of ensure the entry into force of these regulations, do not seem to serious in performing their duties. Whereas in the case of the legal culture of society Tasikmalaya provide enormous support in the implementation of the Regulation of Islamic Shari'ah. However this issue is reaping the pros and cons.
