Abstract

Abstract: According to Universal Declaration of Human Rights 1948, each individual has the same right to obtain citizenship status. However, there are still individuals who do not have citizenship status called stateless persons. Rohingya is an ethnic who does not obtain the recognition of citizenship by Myanmar. Such circumstances caused the Rohingyas to be displaced from their homes and save themselves to share the country, including Indonesia. This study examines the Indonesian government's position in protecting Rohingnya refugees in Aceh based on the perspective of international law. In this regard, the Indonesian government has an obligation to provide protection against them under the provisions of international law, both international treaties and international customary law. In addition, it appears that the Government of Indonesia in this case has not been able to meet the standards of service and protection in facilitating Rohingya immigrants under international law.Abstrak: Menurut Universal Declaration of Human Right 1948, setiap individu memiliki hak yang sama untuk mendapatkan status kewarganegaraan. Namun demikian, masih terdapat individu yang tidak memiliki status kewarganegaraan yang disebut stateless persons. Rohingya merupakan etnis yang tidak mendapatkan pengakuan kewarganegaraannya oleh Myanmar, negara tempat etnis tersebut tinggal. Kondisi demikian menyebabkan etnis Rohingya terusir dari tempat tinggalnya dan menyelamatkan diri ke berbagi negara, termasuk Indonesia. Dalam hal ini, pemerintah Indonesia memiliki kewajiban dalam memberikan perlindungan terhadap mereka berdasarkan ketentuan hukum internasional, baik perjanjian internasional maupun hukum kebiasaan internasional. Penelitian ini mengkaji sikap pemerintah Indonesia dalam melindungi para pengungsi Rohingnya di Aceh dalam perspektif hukum internasional. Menggunakan pendekatan yuridis-normatif, penelitian ini menemukan bahwa meskipun pemerintah memutuskan untuk melakukan upaya perlindungan, tetapi dalam beberapa Pemerintah Indonesia belum mampu memenuhi standar pelayanan dan perlindungan dalam memfasilitasi imigran Rohingya yang sesuai dengan hukum internasional.

Abstract

The increasing frequency of personal data breaches in Indonesia underscores the urgency of ensuring effective legal protection for citizens' privacy rights. The enactment of the Personal Data Protection Law (Law No. 27/2022) is a significant milestone, but its effectiveness depends not only on regulatory provisions but also on public legal awareness. Previous studies have largely focused on the normative framework and technical protections, with limited attention to how the public perceives and responds to personal data protection. This study applies a normative-empirical approach, combining doctrinal legal analysis with survey data, to assess the level of public legal awareness regarding data protection obligations and risks. The study's findings reveal that although many respondents acknowledge the potential dangers of excessive data disclosure, they still grant access to applications, reflecting the so-called privacy paradox. This inconsistency suggests that legal protection alone cannot guarantee effective law enforcement without parallel improvements in digital literacy and legal awareness. The novelty of this study lies in the linkage of Indonesian data protection law to the sociological dimensions of public legal awareness, a perspective rarely emphasized in previous research. The results contribute to academic discourse by integrating normative analysis with empirical evidence and offer practical implications for policymakers to design targeted legal education and digital literacy programs that strengthen the enforcement of the Personal Data Protection Law in Indonesia in particular and become a reflection and reference for other countries globally.
