Abstract

Tulisan ini mengulas satu perihal saja, yaitu untuk melihat bagaimana struktur perlindungan HAM dalam Konstitusi di Indonesia khususnya pada UUD 1945 pasca amandemen. Sebagaimana diketahui, hasil amandemen UUD 1945 memasukkan ketentuan HAM dalam Pasal 28A sampai dengan Pasal 28J. Hanya saja, ketentuan-ketentuan mengenai HAM yang terdapat dalam Pasal 28A hingga Pasal 28J tidak memberikan pengaturan yang jelas mengenai pembatasan yang dapat dilakukan atas pembatasan hak.

Abstract

Heretofore in Indonesia, cases of gross violation of human rights have faced an indefinite stagnation of justice. Although the Indonesian government has ratified international human rights conventions and enacted its own system of human rights law, such laws have proven unable to fulfill the restoration of justice toward these victims in two particular aspects: convictions against the perpetrators and reparations for the victims. This article focuses on fulfilling the rights of women victims of past gross human rights violations. It will be based on normative legal research by which the existing laws are critically analyzed in order to expose the legal gaps which might have contributed to the inability of these laws to restore justice and the victims’ well-being. Furthermore, the article stresses an urgency upon the enactment of the Sexual Violence Eradication Bill. It contends that the Sexual Violence Eradication Bill is an essential first step for the fulfillment of women victims’ rights, inasmuch as the bill includes an exhaustive mechanism of penal provisions against sexual crimes under various circumstances, including as part of gross human rights violations.

Abstract

This paper discusses three legal precedents regarding the legal personhood of nature in three countries; Ecuador, New Zealand, and India. Each country has recognized some natural areas as legal persons through different means. In Ecuador, the rights of nature, which resemble legal personhood of the nature, are recognized in the 2008 Amendment of Ecuador Constitution. Meanwhile, New Zealand has recognized the legal personhood of Whanganui River through legislated settlement treaty between the government and Maori peoples. Whereas in India, the rivers of Ganges and Yamuna have been recognized its legal personhood through the Uttarakhand High Court’s decisions. These three legal precedents are a very important breakthrough in legal studies regarding “who”, “whom” and now “what”, are recognized as a legal person. This article contains descriptions of the three precedents aforementioned which will be explored further in terms of possible advantages and also weaknesses that came with by recognizing nature as legal person.

Abstract

Purpose - During the 2024 election, the KPU issued PKPU 10/2023, which regulates candidacy. PKPU 10/2023 contains changes to a new method for calculating decimals for calculating women's quotas in electoral districts. The question arises: Does PKPU 10/2023 contain the spirit of special treatment in the interests of women? For this purpose, this study was carried out by departing from three aspects: (i) The historicity of the dynamics of "special treatment" in the 1945 Constitution.Methodology – Also considered in this section are the circumstances and conditions that served as the background for including special treatment provisions in the constitution, along with the dynamics surrounding them. (ii) Precedents in Constitutional Court Decisions which provide rules for the meaning of special treatment. (iii) The role of the KPU as a regulator in formulating its regulations, namely the attribution of authority possessed by the KPU to translate the spirit of the constitution towards special treatment. Finally, (iv) the substance of the PKPU 10/2023 norm itself is reviewed for conformity with the norms.Findings - In succession, the following were found: First, from a historical perspective, the special treatment of women's political quotas shows a tendency for constitutional interpretations to open space for women's political involvement. Second, the KPU as the regulator has a strategic role in interpreting the constitutional spirit, including special treatment for women. Third, regarding substance, the content of norms contained in PKPU 10/2023 is different from Law 7/2017 and the 1945 Constitution.Implication - From these three aspects, this study concludes that PKPU 10/2023 shows a discrepancy in the spirit of special treatment in capturing the interests of women's political representation. There should be changes to PKPU 10/2023 norms while maintaining the special treatment provisions for women as contained in PKPU 20/2018.

Abstract

Tulisan ini berusaha menjawab potensi antisipasi dan mekanisme kontrol kekosongan jabatan Presiden dalam UUD 1945. Pengangkatan topik ini hendak menjawab isu wacana penundaan Pemilu 2024 yang diiringi dengan penambahan masa jabatan Presiden. Sesungguhnya kekosongan kekuasaan disini tidak dapat dimaknai sebagai akibat dari ketiadaan Pemilu saja, melainkan terhadap hal apapun yang mengakibatkan suksesi kepemimpinan tidak dapat berjalan secara normal. Sehingga disini penulis akan memberikan tanggapan dari sudut yang berbeda. Pada satu sisi, harus diterima adanya celah kekosongan hukum dalam UUD 1945 ketika proses suksesi kepemimpinan tidak dapat dilaksanakan secara normal dan sisi yang lain, kekhawatiran akan penyalahgunaan wewenang hi UUD 1945 hingga lahirnya suatu rezim otoriter. Prinsipnya, tulisan ini hendak mengambil jalan tegah solusi kekosongan hukum dalam dan mengulas langkah-langkah apa saja yang dapat ditempuh untuk mengatasi agar tampuk kekuasaan tidak sampai kosong. Tulisan ini disusun dengan metode yuridis normatif, yaitu melalui analisis sumber-sumber peraturan perundang-undangan maupun pustaka lain yang dianggap menunjang.

Abstract

Tulisan ini bertumpu pada kajian tesis doktoral “Perjalanan Panjang” ASEAN dari G.B. Arundhati. Pada studi tersebut Arundhati menerapkan pendekatan indikatif untuk menyatakan telah terjadi transformasi ASEAN menuju rule-based-organization yang people oriented. Studi ini menggunakan perspektif Arundhati pada African Union dalam upayanya melakukan demokratisasi kawasan. African Union dipilih karena kesamaan historis sebagai mantan bangsa terjajah yang berisikan banyak pemerintah otoriter. Maka terdapat dua aspek yang ditonjolkan. Pertama, tentang pergeseran atas primasi kedaulatan dimana African Union memperkenalkan prinsip non-indifference. Kedua, tentang representasi yang diperlihatkan lewat parlemen regional dan organisasi yang menghubungkan kelompok sipil pada tubuh African Union. Masing-masing terhubung lewat semangat mewujudkan solidaritas rakyat Afrika. Jadi meskipun terdapat kesamaan latar dengan ASEAN, Afrika menempuh jalan yang berbeda dalam pelembagaan organisasi regionalnya.Kata Kunci: Regionalisme; African Union; Organisasi Internasional; Demokratisasi. This article is a respond to G.B. Arundhati’s doctoral thesis of “Perjalanan Panjang” ASEAN (ASEAN’s Long Journey). Arundhati employed an indicative approach on ASEAN’s transformation toward people oriented rule-based-organization. Such perspective was then implemented in this study on African Union in the context democratizing the region. Like ASEAN, African nations shared historical background as the colonized nations with widespread authoritarian governments. This study will put emphasize on two aspects. First, the changing attitude toward the primacy of sovereignty through the novelty of non-indifference principle. Second, the institutionalization people’s representation via regional parliament and CSO organization. Both aspects connected through the spirit to realizing the solidarity among Africans. Different from ASEAN, Africa took a different path on institutionalizing their regional organization.Keywords: Regionalism; African Union; International Organization; Democratization.

Abstract

Zuchron mencoba pertanyaan tersebut dengan mengurai ontologis manusia melalui analisis Wujud dan Mahiyyah, Wujud Kharij dan Wujud Dzihni, dan Tasykik Al-Wujud, serta epistemologisnya yaitu melalui analisis Ma’qulat, Kulli Musyakkik, dan I’tibari. Pada pokoknya, analisis tersebut sebetulnya bermuara untuk menjawab satu pertanyaan, siapakah manusia itu dalam konstitusi. Dari situlah Zuchron berpendapat yang menurut saya menjadi bagian paling penting dalam buku ini: bahwa terdapat klasifikasi tentang manusia yang terdapat secara eksplisit dalam hukum yaitu antara lain konsep rakyat, warga negara, penduduk, orang, manusia, masyarakat, bangsa, dan umat, ditambah dengan manusia (dalam HAM). Klasifikasi tersebut menjadi penting karena mengandung muatan yang berbeda-beda. Zuchron mencotohkan, pada tingkat individu, seseorang bisa saja memiliki pluralitas atribut, namun sebagai warga negara, maka pluralitas atribut tersebut seharusnya memiliki hak yang sama dihadapan hukum. Demikian pula dengan frasa “setiap orang” dalam Pasal 28A s.d. 28J UUD 1945 yang merupakan bab khusus mengenai HAM. Penyematan setiap orang tersebut memiliki cakupan yang lebih luas dibandingkan dengan penggunaan frasa “setiap warganegara”.
