Abstract

Throughout Islamic history, we observe enmity and conflicts between Sunnism and Shiism, nonetheless there has been also reconciliation between these sects. This article examines the opportunities and challenges of Sunni-Shia convergence in Indonesia. Such a picture will reveal a better understanding of the features of Sunni-Shia convergence in the country and their relationship with the notion of ‘Indonesian Islam’. The hostility between Shiism and Sunnism in Indonesia is triggered by misunderstandings between these sects, politicisation of Shiism, as well as geopolitical tensions in the Middle East. These constitute the challenges of Sunni-Shia convergence. One may also observe the ventures of Sunni-Shia convergence which have been undertaken by the scholars of the Nahdlatul Ulama (NU) and Muhammadiyah, and other Islamic civil society organisations. Grounding on these enterprises and the enduring elaboration of ‘Indonesian Islam’, the opportunities of and the prospects for Sunni-Shia rapprochement in the country are envisaged.

Abstract

The position of the Ahmadiyya is problematic since it claims to be a part of the Muslim community, but it is considered a deviant sect by the mainstream Sunni Muslims in Indonesia. There has been persecution and violence towards this minority. The violence towards the Ahmadiyya increased most notably after the issuance of a joint ministerial decree in 2008, which limits the activities and proselytization of the Ahmadiyya. Interestingly, although affected by the national and regional discourse on the Ahmadiyya, the Ahmadiyya community in Malang, East Java, still lives peacefully with other faith communities. By employing qualitative content analysis, the present study examines the dynamics of the Ahmadiyya as a religious minority in the context of a plural society in Malang, East Java. More specifically, it investigates two main research problems, namely the Ahmadiyya community’s agency in response to the limitation of their activities and the socio-political and socio-religious factors relatively supporting peaceful life of the Ahmadiyya community. This study reveals a distinct picture that stays in contrast to the majority of Ahmadiyya communities in Indonesia, which is often associated with discrimination and persecution.

Abstract

This study aims to identify the reasons and considerations of judges in granting marriage dispensation applications in the midst of changes to the marriage law regarding marriage age limits. The research method used was qualitative with a philosophical juridical approach, involving interviews, observation, and document analysis. Data were analyzed inductively, starting from data collection to the development of hypotheses that were tested iteratively using triangulation techniques. The results revealed several factors behind the marriage dispensation applications, such as the existence of sexual relations and pregnancy outside marriage, love and dating relationships, lack of parental supervision, and low economic and family education. The judge looked at the application to make sure it wouldn't have even worse effects. He used maqashid sharia and fiqhiyah rules to decide that stopping mafsadat (damage) was more important than getting maslahah (benefits). Another consideration is the obligation to marry for those who are worried about falling into adultery. The decision on marriage dispensation is a dilemma for judges because it contradicts child protection and the prohibition of underage marriage but is necessary to avoid worse consequences

Abstract

Abstract

This study is aimed at revealing the strategies of advocacy for Muslim women and children who become victims of domestic violence in Semarang, Central Java, Indonesia.  This research was conducted at the ‘Legal Resources Centre for Gender Justice and Human Rights’ (LRC KJHAM) and the ‘Regional Technical Implementation Unit for the Protection of Women and Children’ (UPTD PPA). Data collection techniques include in-depth interviews and documentation. It employs two main theories, namely conflict theory and the maqasid al-shari’a (objectives of Islamic law). The results show that the advocacy efforts embrace complaint services, assessment, medical referrals, provision of safe houses, counselling, litigation and non-litigation legal assistance, empowerment, and policy advocacy. Based on conflict theory, a dialectic is found in domestic violence cases.  This can be observed that male dominance in a patriarchal system represents a thesis, whilst rejection of violence as a violation of human rights and Islamic principles embodies an antithesis, and advocacy as a form of resolution serves as synthesis. Furthermore, from the perspective of maqasid al-shari’a, this advocacy aligns with the five essential objectives of Islamic law, namely, preservation of religion (ḥifẓ al-dīn) through strengthening faith; preservation of life (ḥifẓ al-nafs) through medical services and safe houses; preservation of lineage (ḥifẓ al-naśl) through child protection and legal aid; preservation of intellect (ḥifẓ al-‘aql) through counselling; and preservation of wealth (ḥifẓ al-māl) through economic empowerment. This paper argues that the advocacy provided in these two institutions is not merely legal-formal, but also reflects a broader effort for social transformation rooted in Islamic teachings.

Abstract

This paper examines the appreciation and acceptance of Seyyed Hossein Nasr’s (b. 1933) ideas in the context of intellectual discourse in Indonesia. To do so, it investigates the translation of Nasr’s works into Indonesian, studies on Nasr’s thought, and quotations from Nasr’s works that emerge in the writings of some Indonesian intellectuals. It is especially the notions of Perennialism, “traditional Islam” and scientia sacra that throw light on the process by which his ideas have taken root and gained influence and acceptance in Indonesia. To be more specific, the article scrutinizes the impact of Nasr’s ideas and perspectives on the structure of thought of two Indonesian intellectuals, namely Nurcholish Madjid (1939-2005) and Komaruddin Hidayat (b. 1953). This paper also traces the roots of Nasr’s and Hidayat’s thought in the classical-medieval Islamic tradition, most specifically in Suhrawardi’s School of Illumination, and compares these with those of Madjid and Hidayat.DOI: 10.15408/sdi.v23i2.3002

Abstract

Happiness is not a fixed entity but rather constructed by the individuals in their interaction with society. Happiness has been explored by religion, philosophy, and various academic disciplines, however, these concepts are constructed by the individuals following their respective contexts. Individuals’ understanding of happiness varies due to their unique circumstances. Therefore, it becomes important to study the concept of happiness that exists in society. This study is a qualitative field study. The respondents consisted of twelve individuals who are graduates of Islamic schools (madrasah) or Islamic boarding schools (pesantren) who work as teachers, traders, or farmers in Kediri Regency, East Java, Indonesia. Data collection methods which have been used in this study are documentation and in-depth interviews. The findings of the study show that respondents generally perceive happiness as a state of peaceful and contented mind due to the fulfilment of physical and spiritual needs accompanied by gratitude to God. In line with their views, their orientation towards happiness is generally religious or spiritual. For them, genuine happiness can be achieved when they can perform religious rituals and become closer to God. To attain genuine happiness, their religious or spiritual needs and desires must be fulfilled. However, they also do not have the same orientation towards happiness. The religious doctrines of happiness acquired from the madrasah or the pesantren seem to be maintained, although there are slight differences among the respondents. This indicates that their understanding of happiness is a construct based on the doctrines they have learned and their individual experiences over time.
