Abstract

This article aims to illustrate the concept of ijbar according to Islamic religious law based on the opinion of jurists about the right to force a girl (ijbar right) to marry owned by her guardian even without her consent because a guardian is considered to be the one who knows best about what is best because women are considered not proficient in formulating things that are best for her,  Therefore, consent is not a priority that ultimately monopolizes women's interests and has the potential to cause violence against women, therefore this article tries to describe ijbar rights according to the perspective of Islamic Law and Human Rights.

Abstract

This study aims to identify the reasons and considerations of judges in granting marriage dispensation applications in the midst of changes to the marriage law regarding marriage age limits. The research method used was qualitative with a philosophical juridical approach, involving interviews, observation, and document analysis. Data were analyzed inductively, starting from data collection to the development of hypotheses that were tested iteratively using triangulation techniques. The results revealed several factors behind the marriage dispensation applications, such as the existence of sexual relations and pregnancy outside marriage, love and dating relationships, lack of parental supervision, and low economic and family education. The judge looked at the application to make sure it wouldn't have even worse effects. He used maqashid sharia and fiqhiyah rules to decide that stopping mafsadat (damage) was more important than getting maslahah (benefits). Another consideration is the obligation to marry for those who are worried about falling into adultery. The decision on marriage dispensation is a dilemma for judges because it contradicts child protection and the prohibition of underage marriage but is necessary to avoid worse consequences

Abstract

The aim of this research is to describe and analyze the non-litigation mediation process carried out by marriage registration officers at KUA Kedu in resolving guardian adhol dispute cases.  The research method uses a descriptive-qualitative approach which provides an overview of marriage problems related to guardian adhol and the role of the Kedu Religious Affairs Office (KUA) in resolving guardian adhol problems through non-litigation mediation. The data used is primary data sourced from field research. The data collection technique uses a direct observation approach and documentation. Data analysis uses narrative analysis which is analyzed using mediation theory, namely understanding conflict resolution effectively through communication and collaboration.  Research results on the role of KUA Kedu in resolving problems related to adhol guardians through non-litigation mediation attended by marriage guardians, prospective brides and grooms. The prospective bride's marriage guardian finally agreed to become the marriage guardian and carried out taukil wali bilkitabah (handing over the guardian's authority in writing) before the Head of the Kedu District KUA.  Keywords: Role, Resolving Adhol, Office of Religious Affairs

Abstract

ABSTRACT Talaq divorce cases in the Religious Courts often become a challenge in maintaining a balance between the rights and obligations of husband and wife and the interests of children. Mediation is an alternative dispute resolution instrument used in the divorce process, including divorce and divorce, which aims to reach a peaceful agreement through the judicial process (litigation). In Supreme Court Regulation (Perma) 1 of 2016 concerning Mediation Procedures in Court, this regulation requires every civil case submitted to court to go through a mediation process first before proceeding to the further trial stage. The aim is to encourage peaceful, faster and cheaper dispute resolution through dialogue between the parties facilitated by a mediator. This article aims to examine the role of mediation in resolving talak divorce cases, as well as the factors that influence its success. A case study of a talak divorce case which succeeded in reaching an agreement through mediation will be used as material for analysis, namely case Number 353/Pdt.G/2023/PA.Sal. This research highlights the importance of mediation as a solution approach to minimize the negative impacts of divorce, especially for women and children. Abstract

Disputes over joint property or gono-gini often occur in divorce and inheritance processes, causing prolonged conflict. This study focuses on the resolution of joint property disputes through non-litigation mediation facilitated by religious leaders in Ngadisepi Village, Gemawang District, Temanggung Regency. Mediation was chosen as an alternative method that is faster, more cost-effective, and more effective in reaching agreements than litigation. Religious leaders play an important role in strengthening mediation with an approach to religious values ​​believed in by the local community. This study uses a descriptive-qualitative approach with data collected through observation and documentation. The results of the study indicate that a mediation approach involving religious leaders can provide a more emotionally and financially satisfying solution for the disputing parties. In addition, mediation helps reduce tension and accelerate conflict resolution, thereby increasing the satisfaction of all parties involved.

Abstract

After the ratification of the Convention on Elimination of All Forms of Discrimination Against Women (CEDAW), the issue of women's equality and anti-discrimination against Indonesian women has not been optimal. Indonesia tries to achieve women's equality and eliminate discrimination against women in marriage regulations. However, many things can still be criticized by thinkers regarding the harmony between the law and the reality that is developing in society. The researchers use a qualitative method in this article, with data collection based on phenomenological principles based on the ruling of the Religious Court. This article attempts to provide a complete overview of an important issue that has yet to be addressed in the law itself after the ratification of CEDAW with Law Number 7 of 1984 and to see how far the optimization of the design of laws and regulations and the development of indicators/parameters based on CEDAW. Through this article, readers can be aware of the achievement of optimizing the implementation of the Convention on Eliminating all forms of Discrimination against women due to divorce lawsuits. Asserting women's rights and addressing post-divorce discrimination remain important issues, particularly regarding economic rights, which are often unequal.

Abstract

Pembagian warisan kerap kali memunculkan masalah baik dari sisi cara pembagianya yang kurang disetujui ahli waris ataupun dari segi hak yang diterima oleh ahli waris. Hal ini kerap menimbulkan konflik antar saudara yang menyebabkan permusuhan diantara mereka bahkan ada yang sampai ke ranah pengadilan atau bisa sampai terjadi pertumpahan darah sesama saudara. Hal ini tentu bertentangan dengan agama Islam yang mana Islam sangat menjunjung persatuan terlebih lagi dilingkup keluarga. Untuk meminimalisir konflik yang terjadi dalam pembagian warisan maka hibah dipandang sebagai solusi yang tepat untuk bisa mencegah terjadinya masalah tersebut. Dimana harta dibagi ketika pewaris masih hidup dan masih sadar. Dengan menghadirkan semua ahli waris harta dibagi secara merata secara sukarela dengan persetujuan ahli waris. Apabila ada pihak yang belum terima dengan hasil pembagian maka bisa dimusyawarahkan dan bisa dibicarakan dengan baik sehingga bisa tercapai kerukunan keluarga. Inilah yang diharapkan dengan hibah harta warisan bisa terbagi dengan baik, semua pihak bisa menerima haknya dengan lapang dada dan tidak ada sengketa setelahnya. Tulisan ini  berusaha menguraikan pentingnya hibah sebagai solusi untuk menyelesaikan problematika pembagian warisan menggunakan metode kepustakaan dengan perspektif kaedah saddu dzarii’ah yaitu mencegah kemudhorotan yang lebih besar lebih diutamakan daripada mecari maslahat yang sedikit.

Abstract

This study aims to analyze the effectiveness of the implementation of Law No. 23/2004 on the Elimination of Domestic Violence (PKDRT Law), especially on the protection and fulfillment of victims' rights, as well as structural obstacles in its implementation. The approach used is normative juridical with a content analysis method of laws and regulations, secondary data from Komnas Perempuan, KPAI, LPSK, and case studies of court decisions. The main findings show that although the PKDRT Law is an important legal breakthrough, its implementation in the field is still weak, especially in the enforcement of Article 5 (types of violence), Article 26 (victims' rights), and Article 44 (punishment). The low sensitivity of the authorities, patriarchal culture, and the lack of witness and victim protection are the main obstacles. In conclusion, legal protection for victims of domestic violence in Indonesia still requires strengthening derivative regulations, improving the victim protection system, and increasing the understanding of officials and the public to realize substantive justice for victims.
