Abstract

The issue that arises in the regulation of abortion in Law No. 1 of 2023 on the Criminal Code and Law No. 17 of 2023 on Health is the difference in provisions and the scope of regulations held by these two laws. First, Law No. 1 of 2023 on the Criminal Code regulates criminal offenses and the criminal justice system in general, including in the context of abortion. However, the provisions in the Criminal Code tend to be criminalizing in nature, where abortion is often considered a criminal offense. Problems arise when these two laws have conflicting or inconsistent provisions, such as in determining the permissible gestational age limit for performing an abortion, the definition of qualifying health conditions, and the procedures that must be followed. The research method used in this study is the Normative Juridical research method. This study includes the analysis of legal texts, namely the Health Law No. 17 of 2023 and the Criminal Code Law No. 1 of 2023, as well as the interpretation of these two legal regulations. The result of this research is that the Health Law No. 17 of 2023 expands access to abortion services for victims of sexual violence by providing special exceptions in certain situations, such as pregnancies resulting from reported rape. This law establishes more detailed guidelines regarding abortion procedures and gestational age limits. Nevertheless, implementation challenges such as social stigma and limited access to healthcare services still need to be addressed. Meanwhile, Article 463 of the Criminal Code regulates criminal sanctions for abortions performed without complying with legal provisions. Thus, the Health Law No. 17 of 2023 provides guidelines for safe and legal abortions, while the Criminal Code enforces the law against illegal abortions

Abstract

This study aims to analyze the role of the last will in organ and cadaver donations within the framework of Indonesia's Health Omnibus Law. Utilizing a normative juridical approach, the research examines legal principles and regulations, emphasizing the significance of last wills as legal documents to streamline donation procedures, clarify donor intentions, and safeguard rights. Data was collected from legal texts, government publications, and expert interviews to identify gaps in the legal system, focusing on donor autonomy and family consent.The findings reveal ambiguities in implementing last wills, often leading to conflicts with family consent and religious considerations. Interviews with legal and healthcare professionals indicate the prioritization of family decisions over documented donor wishes, highlighting the need for clear guidelines and legal safeguards. The study also identifies logistical and cultural challenges, including low public awareness and inadequate healthcare infrastructure, which hinder the effective implementation of organ donation laws.This research concludes that integrating last wills into Indonesia's legal framework can enhance procedural transparency, protect donor rights, and address ethical and cultural complexities. Revisions to existing regulations, public education, and improved healthcare infrastructure are recommended to balance donor autonomy with societal and health system needs, ensuring a robust organ donation system.

Abstract

Perkembangan model bisnis berbasis dampak sosial, atau yang dikenal sebagai social entrepreneurship. Memiliki potensi besar dalam mengatasi permasalahan sosial, hukum positif Indonesia belum sepenuhnya mengakomodir keberadaan dan kebutuhan Social Entrepreneurship. Penelitian ini bertujuan untuk mengkaji pranata hukum terhadap model bisnis social entrepreneurship di Indonesia, serta mengevaluasi kesesuaiannya dalam mendukung tujuan pembangunan berkelanjutan (Sustainable Development Goals/SDGs). Dengan pendekatan yuridis normatif, studi ini mengkaji regulasi yang relevan, seperti Peraturan Presiden Nomor 2 Tahun 2022, serta membandingkannya dengan praktik internasional. Selain itu, peran organisasi seperti Asosiasi Kewirausahaan Sosial Indonesia (AKSI) juga dianalisis sebagai aktor non-negara yang mendorong penguatan ekosistem kewirausahaan sosial di Indonesia, tetapi belum ada landasan hukum yang secara resmi memberikan kewenangan untuk mewakili pemerintah dalam pengelolaan dan pengembangan social entrepreneurship. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum (legal vacuum) dan belum adanya pranata hukum yang komprehensif untuk mengakomodasi model bisnis ini secara berkelanjutan. Penguatan regulasi diperlukan khusus yang memberikan kepastian dan perlindungan hukum terhadap pelaku usaha sosial agar peran strategis mereka dalam pembangunan nasional dapat terlaksana secara optimal.

Abstract

The purpose of this study is to analyze the legal capacity of the parties in a digital online buying and selling contract and to determine the party that can be held accountable for the goods that have been purchased according to the laws and regulations in Indonesia. Technological developments have made developments in all sectors, including in the buying and selling system. Buying and selling now uses more of the internet or what is called online buying and selling. Online buying and selling falls into the category of digital transactions or contracts. The problem that can occur in a digital contract is the capacity of the parties in this case the subjects who make the agreement. It should be noted that digital contracts are the same as conventional contracts which must be subject to Article 1320 of the Civil Code concerning the requirements for the validity of an agreement. The agreement can be canceled if there is a party that does not meet the subjective requirements of Article 1320 of the Civil Code. The subjects in online buying and selling can be done by children who use their parents' or adults' cellphones. So when the party who makes the agreement does not meet the subjective requirements and should be canceled but is not done, the agreement is considered to remain valid. For online buying and selling that has been done by children, the parents or guardians of the child must be responsible. This research is of a normative legal nature by looking at the requirements for the validity of an Agreement from Article 1320 of the Civil Code.

Abstract

This study explores the harmonization of inheritance laws in interfaith families, specifically addressing the distribution of inherited assets among members with different religions. It focuses on the application and distribution of inheritance laws for interfaith families, referring to Law Number 1 of 1974 concerning Marriage and Supreme Court Circular Letter Number 2 of 2023 concerning Guidelines for Judges in Adjudicating Cases of Registration of Marriages between Believers of Different Religions and Beliefs.  Applying a legal normative method, the findings conclude that there are three systems of inheritance laws in Indonesia: civil law, Islamic inheritance law, and customary law.  The resolution of inheritance distribution in interfaith families within in Islam involves the application of "wasiat wajibah," while for non-Muslim faiths (Hindu, Christian, Catholic, Buddhist, Confucian), civil law or customary law adhered to by the deceased applies.  Inheritance law issues in interfaith families in Indonesia necessitates a specific regulation to minimize legal uncertainty and confusion in the distribution of inheritance among interfaith families

Abstract

The rapid development of financial technology (fintech), particularly Peer-to-Peer Lending services or Layanan Pendanaan Bersama Berbasis Teknologi Informasi (LPBBTI), has provided easier access to financing for the public. However, it has also raised serious concerns regarding unethical debt collection practices, often involving intimidation and privacy violations. This research aims to analyze the legal framework governing debt collection and consumer protection in fintech, as well as to assess the effectiveness of law enforcement against such violations. The study employs a normative juridical method using the statute and conceptual approach, examining regulations such as Law No. 8 of 1999 on Consumer Protection, Law No. 27 of 2022 on Personal Data Protection, OJK Regulation (POJK) No. 40 of 2024, and the AFPI Code of Conduct. The findings indicate that although the legal framework establishes principles of transparency, fairness, data protection, and a prohibition on intimidating collection practices, its implementation remains far from optimal. The Financial Services Authority (OJK) recorded thousands of complaints related to unethical collection methods, highlighting the gap between normative law and actual practices in the industry. Enforcement through administrative, ethical, and criminal sanctions has not provided sufficient deterrent effect nor ensured remedies for consumers, particularly regarding immaterial losses. Therefore, strategic measures are required, including strengthening supervisory mechanisms, integrating complaint platforms, mandating compensation for consumers as part of administrative sanctions, and enhancing public financial literacy to achieve effective and fair consumer protection in the fintech sector.

Abstract

The implementation of restorative justice in Indonesia faces significant challenges in maintaining legal certainty, particularly when humanitarian grounds are used as the basis for terminating prosecution. In practice, law enforcement officers often consider the offender’s socio-economic conditions, health, and vulnerability as reasons for applying restorative justice, even when the formal requirements stipulated in legislation are not fully met. In addition to a statutory and conceptual approach and case studies, this study uses a normative juridical method by examining pertinent laws and regulations, including Law Number 11 of 2021 on the Prosecutor's Office, the Attorney General's Regulation Number 15 of 2020, the Chief of Police Regulation Number 8 of 2021, and the Supreme Court Regulation Number 1 of 2024. The findings reveal that humanitarian considerations can serve as a legitimate basis for terminating prosecution to achieve substantive justice. However, this flexibility risks creating disparities if not more clearly regulated. Therefore, more detailed and uniform guidelines are needed to ensure that the application of restorative justice on humanitarian grounds remains consistent with the principles of legal certainty, human rights protection, justice values, and the concept of progressive law that places human welfare above rigid legal formalities.
