Abstract

Akhir-akhir ini angka pengajuan permohonan dispensasi kawin di Pengadilan Agama Banyuwangi cukup tinggi dan dalam kurun waktu enam tahun (2008-2013) rata-rata 40% perkara dispensasi kawin yang masuk adalah akibat hamil pra-nikah. Penelitian ini bertujuan untuk mengetahui pertimbangan hakim dalam menetapkan dispensasi kawin akibat hamil pra-nikah dan untuk memahami aspek maqashid syari’ah Islam terhadap penetapan hakim tersebut. Metode penelitian ini menggunakan pendekatan yuridis normatif dan bersifat deskriptif analistis. Dari hasil penelitian menunjukkan bahwa Hakim Pengadilan Agama Banyuwangi dalam menetapkan dispensasi kawin akibat hamil pra-nikah berdasarkan pertimbangan hukum yuridis (berdasarkan aturan perundangan yang berlaku), berdasarkan pertimbangan hukum Islam dan berdasarkan pertimbangan keadilan masyarakat. Penetapan hakim tersebut ditinjau dari aspek maqashid syari’ah Islam dari segi kemaslahatannya adalah lebih mengutamakan hifz al-nasl, sedangkan dari segi mafsadatnya hifz al-din tidak tercapai yaitu terjadi pelanggaran syari’at Islam tentang larangan zina dengan menjadikan KHI Pasal 53 sebagai legalitas kawin hamil akibat zina.

Abstract

This study aims to explore the management of ethical issues in dealing with social media crises by Islamic boarding schools, focusing on the strategies implemented to maintain the institution's image and public trust. The research approach used is qualitative with a case study design. It takes Nurul Jadid Islamic Boarding School as the research subject because of its active social media activities and experience in handling various digital crises. Data were collected through semi-structured interviews with social media managers and Islamic boarding school leaders, observations of Islamic boarding school social media activities, and analysis of digital documents in the form of uploads, comments, and responses to emerging issues. Data analysis techniques were carried out thematically by identifying relevant patterns from the collected data and triangulation to ensure the validity of the findings. The results of the study indicate that Islamic boarding schools face a dilemma in balancing social media trends with religious values, challenges in responding to diverse audiences ethically, and the lack of a structured crisis management strategy. These findings emphasize the importance of value-based social media crisis management to maintain the integrity of religious institutions in a dynamic digital era.

Abstract

This research aims to examine the impact of Artificial Intelligence-based learning on education policy and school management, with a focus on how schools adapt to technological disruption. The research method uses a qualitative approach with case studies. Data was collected through semi-structured interviews, participant observation, and document analysis, then analyzed through the stages of data reduction, data presentation, and drawing conclusions. The research results show that Artificial Intelligence-based learning requires transformative policy changes in three main aspects: data use policies, continuous training for teachers, and personalized learning approaches. Effective data management policies are critical to protecting student privacy and supporting adaptive learning based on real-time analytics. Continuous professional development enables teachers to utilize Artificial Intelligence tools effectively, while personalized learning strategies increase student engagement and motivation through an individualized approach. The implications of this research emphasize that the integration of Artificial Intelligence in education must be accompanied by ethical, inclusive and planned policies. The contribution of this research is both theoretical and practical, providing a framework for policy makers to design strategic leadership, stakeholder engagement, and a culture of innovation to realize the maximum potential of Artificial Intelligence in education..

Abstract

This research is motivated by the emergence of the faithfluencer phenomenon as a new religious authority figure in the digital era that significantly shapes the religious mindset and practices of Generation Z. This change marks a shift from traditional religious authority to a more interactive and contextual, and media-based digital authority. The purpose of this study is to analyze the role of faithfluencers in shaping digital piety and redefining religious authority among Generation Z through social media. This study uses a qualitative approach with descriptive analysis through observation of content on Instagram and TikTok platforms, as well as interviews with active followers. The results show that faithfluencers function not only as conveyors of da'wah messages, but also as social and spiritual mediators who combine religious values with a popular communication style. The digital piety produced through this interaction tends to be reflective, participatory, and experiential, emphasizing personal meaning-making rather than rigid doctrinal transmission. The contribution of this research lies in developing the concept of digital religious authority that is adaptive to the spiritual needs of the younger generation and serves as a strategic reference for religious institutions in optimizing social media-based da'wah that is relevant to the dynamics of today's digital culture.
