Abstract

Study This aim analyze phenomenon discrimination to patient Guarantee National Health Insurance (JKN) and limitations knowledge patient about his rights . Space scope study service - focused House sick in Indonesia with review aspect legal , social , and access health . The method used is study normative with approach studies literature , through secondary data review from the Indonesian Ombudsman, BPJS Watch, Riskesdas 2018, and various publication academic . Data includes surveys and reports national which shows more of 21% of JKN patients experienced treatment discriminatory , time wait an average of 3–5 hours, and low level knowledge rights (47%). Findings confirm existence discrimination systemic which has implications for injustice structural , reinforced by gaps information patient . Analysis test literature support the need reform service and socialization right patient . This study underscores the importance of improving both the dissemination of information about patients' rights and the responsiveness of healthcare services, to ensure equitable and just treatment for all individuals under the JKN program.

Abstract

The rapid development of artificial intelligence technology has significantly transformed the healthcare sector, including the emergence of AI-based medical chatbots used for diagnosis support, symptom checking, health consultation, and patient education. In Indonesia, the adoption of medical chatbots has increased alongside the expansion of digital health services. However, the legal framework governing transparency obligations and informed consent mechanisms in the operation of AI-based medical chatbots remains fragmented and insufficient. This study analyzes the urgency of establishing comprehensive regulations concerning transparency and informed consent in the use of medical chatbots in Indonesia. The research employs a normative juridical method through statutory, conceptual, and comparative approaches. The study examines Indonesian laws relating to health services, electronic information systems, personal data protection, consumer protection, and medical ethics. The findings indicate that AI-based medical chatbots may create legal uncertainty regarding accountability, patient autonomy, data privacy, algorithmic bias, and medical malpractice risks when transparency and informed consent principles are not adequately regulated. Furthermore, existing regulations have not specifically addressed the obligations of developers and healthcare providers to disclose AI system limitations, decision-making processes, data usage practices, and potential risks to users. Therefore, Indonesia urgently requires a specific and harmonized regulatory framework to ensure legal certainty, patient protection, ethical healthcare innovation, and responsible AI governance. This article recommends the formulation of detailed transparency standards, mandatory informed consent procedures, algorithmic accountability principles, and supervisory mechanisms to support the safe and ethical implementation of AI-based medical chatbots in Indonesia.

Abstract

Resiko bank dalam operasionalnya begitu tinggi, di satu sisi terkait dengan ketentuan yang dibuat oleh Bank Indonesia dan di sisi yang lain bank mengelola dana nasabah agar tidak lari ke bank lain khususnya dalam pelaksanaan prinsip Know Your Costumers. Jika terjadi resiko tersebut yaitu dalam hal pertanggungjawaban pidana oleh bank. Namun, untuk pertanggungjawaban pidana dari badan hukum, asas kesalahan tidak mutlak berlaku. Disamping itu terkait resiko bank maka patut juga dipertimbangkan konsep pertanggungjawaban pidana yang selama ini diterapkan untuk kejahatan atau tindak pidana konvensional diadaptasikan ke dalam Tindak Pidana Pencucian Uang yaitu prinsip diminished responsibility. Dalam hukum pidana, diminished responsibility (berkurangnya tanggung jawab) merupakan alasan pelaku bahwa meskipun melanggar hukum, mereka tidak harus sepenuhnya bertanggungjawab secara pidana, karena alasan-alasan tertentu.

Abstract

The purpose of this research is to find out how the existence of TKI is in the protection of labor law, because along with the progress of the times (globalization era), problems in the field of employment are also increasing, especially if it is associated with other aspects such as economic, social and political. However, the basic problems in this field still do not deviate from the classic problems, namely the “master-worker” relationship, strikes and dismissals, and rights and obligations. Workers and employers in their respective positions have rights and obligations. However, in this case, it is the workers who need to be protected and guaranteed by law in exercising their rights. In the field of employment, these guarantees often include economic guarantees.
