Abstract

This research examines the issues that hinder the process of money laundering and the seizure of assets resulting from money laundering in Indonesia. This study examines the issues that hinder the process of money laundering and the confiscation of assets resulting from money laundering crimes in Indonesia and the problems that arise when assets resulting from money laundering crimes are not easy to recover. This research uses normative legal research methods with literature data collection. The results showed that both Indonesian positive law and Islamic criminal law have provided legality to efforts to eradicate money laundering crimes. Asset forfeiture arrangements are outlined in Law No. 8/2010 on the Prevention and Eradication of Money Laundering Crimes under Indonesian positive law. A new law is needed to prevent and eradicate the crime of money laundering as the current laws have not been successful in stopping economic crime in Indonesia. Conversely, as the act is motivated by an attempt to legitimize the proceeds of crime, the forfeiture of assets arising from money laundering can be categorized as jarimah ta'zir in Islamic criminal law. In short, a thorough understanding of these two legal systems can enhance the effectiveness of initiatives aimed at combating money laundering.

Abstract

Dari penelitian serta penjelasan di atas dapat diambil kesimpulan yaitu penetapan kewarisan terhadap transgender dalam tinjauan hukum Islam yang dilakukan oleh seseorang yang memiliki kelamin normal ialah berdasarkan kelamin semula sebelum ia melakukan transgender.Penetapan kewarisan terhadap perbaikan penyempurnaan serta pembuangan salah satu kelamin adalah berdasarkan kelamin setelah ia melakukan Transgender. Penetapan terhadap penyempurnaan dan pembuangan salah satu kelamin ini berdasarkan kelamin yang dominan di antara kedua dan hal ini berdasarkan penetapan hukum pengadilan dan ahli medis yang memahami tentang kelamin yang cocok terhadap oarang tersebut sehinga mendapatkan penetapan yang jelas terhadapat status orang tersebut.Pembagian warisan untuk seorang khunsa ghairu muskyil dilihat dari statusnya setelah melalui beberapa cara dengan melihat pertama kali keluarnya air seni dan juga dilihat dari tanda-tanda kedewasaannya. Pembagian warisan seorang khunsa musykil para ulama berbeda pendapat, menurut mazhab Hanafi khunsa diberikan bagian terkecil dari dua perkiraan laki-laki dan perempuan, menurut mazhab Syafi’i khunsa diberikan bagian terkecil dari bagian laki-laki dan perempuan lalu sisa hartanya ditangguhkan sampai status khunsa jelas, menurut mazhab Maliki khunsa mendapat kedua bagian terkecil dari perkiraan laki-laki dan perempuan yang kemudian jumlah dari perkiraan tersebut dibagi setengah.

Abstract

This research aims to describe legal sanctions for perpetrators of criminal acts of hoarding and selling subsidized fuel according to criminal and Islamic criminal laws. The research method is empirical legal research using a legal sociological approach. Interviews or observations obtain primary data, and secondary data is from books, articles, or other reading sources. The data was analyzed using content analysis and case study analysis. So researchers can explore, analyze and interpret empirical data related to the social aspects of law. The results of this research explain that hoarding is prohibited in positive criminal law and Islamic criminal law. Sanctions in positive law are regulated in the Oil and Gas Law no. 22 of 2001 article 55, with a maximum penalty of imprisonment of 6 (six) years and a maximum fine of IDR 60,000,000,000.00 (sixty billion rupiah). Meanwhile, hoarding is known as the ta'zir punishment in Islamic criminal law. This illustrates that in the context of criminal law. However, there may be similarities in the conception of certain criminal acts, sanctions and punishment approaches can differ based on different legal bases.

Abstract

Children who commit crimes must have their rights protected to ensure their survival and well-being. This study aims to apply diversion regulations in resolving cases of children in conflict with the law at the Women and Children's Services Unit of the Criminal Investigation Department in the Labuhanbatu Police Department to ensure the provision of restorative justice. This empirical legal study collected data through interviews with the Labuhanbatu Police Department. Findings indicate that diversion regulations are detailed in Law No. 11 of 2012 concerning the Juvenile Criminal Justice System. According to Islamic criminal law, if a child commits a crime, the punishment should be educational and involve al-shulhu (reconciliation). While diversion is carried out with a restorative justice approach, many juvenile offenses are not entirely diverted and are often processed further in the legal system. The practice of reconciliation for juvenile crimes in Labuhanbatu involves the upah-upah ceremony, which aligns with the concept of al-shulhu. Factors that prevent juvenile offenses from being resolved through diversion include cases of theft, embezzlement, and assault. This study recommends that diversion be mandatory for juvenile offenders at the stages of investigation, prosecution, and trial to resolve juvenile criminal cases

Abstract

In Indonesia, the need for land is increasing day by day due to a significant increase in population. This causes the value of the land to increase. The increasing value of land can result in every community always cultivating the land. Forms of land cultivation can be done in various ways such as ways that are in accordance with the law and ways that are against the law. As an effort to protect land rights owners, land certificates are issued. According to Government Regulation Number 24 of 1997 concerning Land Registration in Article 32 paragraph (1) what is meant by a certificate is, "A valid proof of rights letter as a strong means of proof regarding the physical data and legal data contained therein, as long as the physical data and legal data are in accordance with the data in the measurement letter and the land book of the relevant rights". The purpose of this study is to determine the provisions for the transfer of building use rights to ownership and to determine the process of transferring building use rights to ownership at the National Land Agency. The research method used in this study is the normative legal method. Regarding the use of the normative legal approach method, this research was conducted through Library Research. The results of this study are how the process of transferring Building Use Rights to Ownership Rights is an important step for land owners to obtain stronger legal certainty and security.

Abstract

The issue at hand in this research focuses on how residents of Pematang Panjang village utilize grants as an alternative to inheritance, the factors influencing this practice, and the legal standing of grants under statutory provisions. This qualitative research aims for an in-depth understanding of the relevant phenomena and is categorized as empirical legal research utilizing a legal sociology approach. Methods such as interviews, observations, and document analysis are employed to deeply interpret the observed phenomena. In Islamic law, the transfer of property rights is termed a gift, defined as a voluntary transfer of goods without compensation between living individuals, as outlined in Article 171 letter (g) of the Compilation of Islamic Law (KHI). While gifts are typically voluntary, Article 211 indicates that gifts from parents to children can be viewed as part of an inheritance. However, Article 212 clarifies that gifts generally cannot be revoked, except for those given by parents to their children. In light of the observed phenomena, the practice of gifting as a substitute for inheritance in Pematang Panjang village may serve as a strategy to address various factors considered by heirs, and can be seen as an effort to promote fairness among them.

Abstract

Sexual urges that are very strong and challenging to control are reflected in hypersexuality, which can result in coercion, pressure, or even violent behavior. It can be difficult to recognize and address incidents of domestic violence involving hypersexual behavior. Because sociological juridical normative legal studies explore the meaning of hypersex, hypersexual variables, related cases, and hypersex, these findings help in building legal arguments. The hope is to maintain the welfare of every family member and build a family atmosphere free from sexual violence. Legal writing is included in the category of sociological jurisprudential normative legal research, trying to investigate legal penalties for those involved in hypersexual behavior that leads to sexual violence. Legal norms are the subject of the analysis of the internal perspective of this legal method. Legislation relating to the crime of sexual violence is secondary data referred to by this study. The findings of this study indicate that the elements of punishment for perpetrators of hypersex based on criminal law are a single/imperative formulation system, an alternative formulation system, and a cumulative formulation system. While based on Islamic criminal law, ta'zir punishment is a sanction that can be given to those who commit violations including sexual violence. In addition, the type of ta'zir punishment also differs depending on the choice of the government judge or ulul amri based on ijtihad.

Abstract

This study discusses the considerations carried out by the Sharia Court in Malaysia in the implementation of the order of the right of the child to visit the father in the case of denial of the father's right to see the child according to the Syariah Court Civil Procedure Enactment (State of Selangor) 2003. The type of research used is qualitative research with a normative jurisprudence approach based on the laws of Malaysia and Islamic law. The source of the research data uses secondary data, which includes the study of documents from the judgment of the syaria court. The researchers found that the right to the child is preferred to women because there is compassion and tenderness in caring for the child. In the case 10000-003-0008-2014 the researchers also found that children's rights can be lost if one breaches a court order that has been established. The results of this study show that according to good practices the sanction imposed is imprisonment for not more than six months or a fine not exceeding RM2,000 if she fails to show reasons or fail to satisfy the Court.

Abstract

The transformation of digital technology and the development of the internet have revolutionized trade activities, one of them is through electronic commerce (e-commerce). This business model offers ease of transactions, time efficiency, and expanded market reach without geographical boundaries. However, this convenience raises legal issues, one of them is unilateral transaction cancellation by the buyer, particularly with the Cash on Delivery (COD) method. From the perspective of Indonesian civil law, unilateral cancellation without a valid reason constitutes a form of default and a violation of the principle of good faith as regulated in Clause 1338 verse (3) of the Civil Code. This study aims to identify legal provisions related to bad faith in unilateral cancellation and to analyze the forms of legal protection for sellers in e-commerce. This study uses a normative juridical research type with a statutory approach. Data collection techniques include literature studies, including primary legal materials such as the Civil Code, Clause No. 8 of 1999 concerning Consumer Protection, and Clause No. 11 of 2008 concerning Electronic Information and Transactions, as well as secondary and tertiary legal materials. The analysis method in this study is qualitative, conducted through an interpretation of the processed legal materials. The results show that unilateral cancellations, particularly in COD systems, cause losses for sellers both financially and non-financially, including damaged goods, repackaging costs, lost potential profits, and psychological stress. Legal protection for sellers includes the right to receive payment as agreed, protection from bad faith consumer actions, and the right to claim compensation under Clause 1243 of the Civil Code. Prevention efforts can be implemented practically, such as reporting to the platform and deactivating the COD option, or legally through lawsuits for breach of contract or unlawful acts. This study presents a novelty approach to the concept of bad faith, which can be considered to be unilateral cancellation.

Abstract

Provisions for Child Custody Based on the Compilation of Islamic Law are Islamic, mature, of sound mind, trustworthy, unmarried, able to educate children. There are no hadanah for non-Muslims and require women who carry out hadanah (caring for children) to be Muslim, and there are no rights and authority for those (women) who are apostates (non-Muslims) to care for children. This research aims to find out more about the provisions on child custody based on the compilation of Islamic law and child custody due to divorce due to apostasy from a wife according to the compilation of Islamic law using normative methods that collect and analyze data so as to obtain a clear picture of the problem being discussed. written work, with the aim of depicting or illustrating the occurrence of a problem systematically, factually and accurately as well as in order to obtain the truth in the process of perfecting this writing. The results of the research show how the provisions for child custody are based on a compilation of Islamic law and child custody rights from divorce due to apostasy according to the compilation of Islamic law.
