Abstract

The purpose of this study is to explain and analyze the relationship of local government and regional representatives Deawan. This research uses normative juridical method. Results of research In carrying out its duties and functions despite the equal position between the Regional Government and the DPRD. Supervision remains in place as the duties of the DPRD always exercise good oversight of the government in running the wheels of the government and include supervision of the use of APBD and Regional Policies. The working relationship of Local Government with DPRD according to Law Number 23 Year 2014 on Regional Government, namely:1.Relationship in the making of Regional policy, 2. Discussion and Ratification of Regional Regulations, 3. Relationship in the discussion of Regional Expenditure Budget Plan (RAPBD), 4. Relationship in the field of personnel, 5.Hubungan In the Policy on the management of Regional Goods, 6. Relations in the field of Policy and political supervision of the region.

Abstract

Abstrak Tidak tercapainya tujuan pembangunan dan terjadinya penyimpangan terhadap tata kelolah pemerintahan yang dilakukan oleh Aparatur Negara menimbul kerugian negara yang disebabkan lemah sistem pengawasan dan pencegahan. Oleh karena itu diperlukan pengawasan yang resmi yang dilakukan oleh Lembaga Otonomi yang kuat, Sehingga kegiatan pemerintah daerah dapat tercapai dan tidak adanya penyimpangan. Penulisan dalam tulisan ini menggunakan metode normatifmenganalisis masalah pengawasan dan kelemahan serta hambatannya dari sisi aturan dan norma perundang-undang, serta buku yang berhubungan dengan pengawasan daerah. Pelaksanaan pengawasan yang dilakukan Inspektorat selaku Lembaga pengawas dan pencegahan internal terhadap pelaksanann dan tata kelolah pemerintah tidak mempunyai kekuatan yang kuat, walaupun hasil temuan dalam pengawasan itu terbukti adanya penyimpangan. Ini disebabkan Lembaga Pengawasan Daerah tidak mampu dan Independen dan selalu dibawah tekanan Kepala Daerah. Oleh kerana kedepan harus ada regulasi pemerintah pusat dimana kedudukan Inspektorat Daerah kedudukannya satu tingkat diatas yang dia awasi. Kata kunci: Pengawasan Internal Abstrack The failure to achieve development goals and the occurrence of deviations from government carried out by the State Apparatus have incurred state losses caused by weak supervision and prevention systems. Therefore an official oversight is conducted by a strong Autonomous Agency, so that local government activities can be achieved and there are no deviations. The writing in this paper uses a normative method to analyze the problems of supervision and weaknesses and their constraints in terms of rules and norms of legislation, as well as books relating to regional supervision. The supervision carried out by the Inspectorate as the internal supervisory and prevention agency for the implementation and governance of the government does not have a strong power, although the findings in the supervision are proven to be irregularities. This is because Regional Oversight Institutions are incapable and independent and are always under the pressure of the Regional Head. Therefore, in the future there must be a central government regulation where the position of the Regional Inspectorate is one level above which he oversees.

Abstract

Politik hukum dalam pembangunan Hukum Nasional pasca amandemen undang-undang dasar 1945, dapat disimpulkan sebagai berikut: a) Lahirnya Bentuk Negara Indonesia adalah Negara Kesatuan, b) Bentuk Pemerintahan Indonesia adalah berbentuk Republik dengan sistem presidensiil, c) Negara Indonesia adalah Negara Hukum, d) Struktur Negara Indonesia terdiri dari Pemerintahan pusat dan pemerintahan daerah. Penelitian dilakukan secara Yuridis Normatif mencakup penelitian terhadap asas hukum, sistimatika hukum dan sinkronisasi. Dimana kelembagaan pemerintahan pusat terdiri dari lembaga legislative, eksekutif dan yudikatif sesuai dengan teori separation of power dari Trias Politika dan juga prinsip check and balances antar lembaga Negara. Sedangkan struktur lembaga hanya terdiri dari lembaga legislatif dan lembaga eksekutif dengan penyelenggaraan pemerintahan berdasarkan konsep otonomi dalam bentuk desentralisasi politik (devolusi). Dalam amandemen UUD 1945 proses penegakan hukum Kekuasaan Kehakimam ditangan Mahkamah Agung. Eksekutif tidak lagi lembaga yang mendominasi dalam pembentukan undang-undang sehingga proses Checks and Balance dalam sistem politik dan sistem ketatanegaraan, merupakan dasar dalam politik hukum dan pembangunan hukum pasca amandemen dimana kepala Negara dan Kepala Daerah dipilih melalui perwakilan dan sekarang kedaulatan itu ada ditangan rakyat, termasuk konsep Negara hukum The Rule Of Law yang menjamin dan melindungi hak rakyat (HAM) dan pemisahan kekuasaan yang jelas.

Abstract

Abstrak Di Kota Manna Kabupaten Bengkulu Selatan sudah ada pelaksanaannya serta perencanaannya tetapi didalam pelaksanaan pengelolaan ruang terbuka hijau masih belum terlaksana sesuai dengan Peraturan Perundang-Undangan yang ada. Ada dua permasalahan yang dikaji dalam skripsi ini mengkaji 1) Bagaimana implementasi Peraturan Daerah Nomor 8 Tahun 2011 Tentang Rencana Tata Ruang Wilayah Kabupaten Bengkulu Selatan 2) Bagaimana Faktor Penghambat Rencana Tata Ruang Wilayah Kabupaten Bengkulu Selatan. Jenis penelitian ini menggunakan metode penelitian hukum empiris yaitu penelitian dengan adanya data lapangan sebagai sumber utama seperti hasil wawancara dan observasi dengan menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakatan. Hasil penelitian dan pembahasan 1)pelaksanaan pengelolaan ruang terbuka hijau di Kota Manna Kabupaten Bengkulu Selatan yang belum terlaksana sesuai dengan Peraturan Perundang-Undangan yang ada serta masih kurangnya kesadaran dari masyarakat dalam menjaga dan memelihara ruang terbuka hijau yang ada. 2) masih adanya faktor penghambat seperti faktor internal dan faktor eksternal dalam pengelolaan ruang terbuka hijau di kota Manna. Dapat disimpulkan bahwa pelaksanaan ruang terbuka hijau di kota manna sudah ada pelaksanaannya tetapi dalam pelaksanaannya belum berjalan sesuai dengan peraturan perundang-undangan yang ada serta maish banyaknya faktor-faktor penghambat dalam pelaksanaan ruang terbuka hijau itu sendiri. Thereare two problems examined in this thesis reviewing I ) How is the implementationof Regional Regulation No. 8 of 2011 Regarding Spatial Planning in SouthBengkulu Regency 2) How are the Inhibiting Factors of Spatial Planning in SouthBengkulu Regency. This type of research uses empirical legal research methods,namely research in the presence of field data as the main source such asinterviews and observations by analyzing laws that are seen as communitybehavior that is patterned in people’s lives that always interact and relate tosocial aspects. Research and discussion results 1) the implementation of greenopen space management in Manna City, South Bengkulu Regency which has hotbeen implemented in accordance with the existing Laws and Regulations as wellas the lack of awareness from the communityi in maintaining the existence ofgreen open spaces. 2) there are still inhibiting factors such as internal factors andexternal factors in the management of green open space in Manna city. It can beconcluded that the implementation of green open space in Manna city has beencarried out but in its implementation it has not proceeded in accordance with theexisting laws and regulations and also the many inhibiting factors in theimplementation of green open space itself

Abstract

Abstrak Tujuan Otonomi daerah memberikan kemudahan daerah dalam melaksanakan kewenangan, sehingga dalam menjalankan kewenangan membawak efek positif dalam berinvestasi. Investasi bertujuan untuk peningkatan ekonomi masyarakat daerah serta peningkatan Pendapatan Daerah, tetapi otonomi sering disalahgunakan oleh Pemerintah daerah terutama yang berhubungan dengan perizinan, sehingga Investor mengalami kesulitan dan hambatan. Tujuan otonomi daerah supaya ada dampak positif serta memberi pelayan publik lebih mudah dan cepat, penyederhanaan Pelayanan Kegiatan Investasi, dan penyederhanaan (regulasi) pelayanan kegiatan ekonomi membantu kelancaran usaha dari para pelaku ekonomi, karena deregulasi dipandang untuk meningkatkan efisiensi bagi pelaku ekonomi. Adanya kepastian proses adminitrasi dan kepastian hukum yang dapat menjamin keamanan dan stabilitas politik Daerah, singkronisasi regulasi antar pemerintah daerah dengan pemerintah pusat, Daerah harus membuka diri dan mempermudah perizinan sektor investasi terutama berhubungan rekruitmen tenaga kerja yang besar, terukurnya kemampuan keuangan daerah dalam era otonomi daerah dengan menggunakan kinerja fiscal sehingga tercapainya keberhasilan daerah dalam menjalani otonomi daerah. Kata Kunci: Otonomi Daerah, Investasi. Abstract In doing investment, there are often problems, one of which is regional autonomy, the challenges of implementing investment in Indonesia in the era of regional autonomy in Indonesia. In its regulation, there is a system of division of authority in facilitating the entry of investments with the investment arrangements at the regional level referring to investment regulations at the national level. Therefore, although the direction of Indonesian economy after Regional Autonomy refers to the economy in the region, it must be remembered that the authority of regional autonomy towards regional independence remains within the framework of the unitary state. The direction of the investment policy and the increase in business activities through investment policies are expected to create opportunities for the growth and development of the business world for every large, medium, and small scale of economic actor. Simplification of Investment Services, Simplification (deregulation) economic activity services helps accelerate the operation of economic actors, because deregulation is seen to increase efficiency for economic actors. The certainty of the administrative process and legal certainty that can guarantee the security and political stability of the region, synchronization of regulations between the local government and the central government, faster in licensing and the realization of certainty, the regional government must open up and facilitate licensing of the investment sector, especially related to the large recruitment of workers, measurable regional financial capacity in the era of regional autonomy by using performance so that the regional achievement can successfully undergone the regional autonomy.

Abstract

An autonomous regional government must necessarily have an independent and uninterruptible internal supervisory body, in order to a ggod governace government as mandated by Act No. 23 of 2014, which is accountability, transparency, effectiveness and transparency. This research aims to find out the position and function of the internal supervisory agency of the Regional Inspectorate. In discussions using an institutional reconstruction approach to the regulations of the laws governing the Regional Inspectorate. As for the obstacles, some things are institutional relations, supervisory officers and officers who are killed are appointed by the head of the district and they are accountable to the governor or the mayor. Of the District Inspectorate is the same district official as the supervised official, of the same structural office as the second esellon officer appointed by the head of the district, from the aspect of the authority of the District inspectorate not followed with sanctions so that the supervision is ineffective. For effective supervision, the District Inspectorate must be reconstructed or rearranged legally by changing the regulations of the separate legislation governing the internal supervisory agency, i.e. the District inspectorate, either by law or government regulation

Abstract

Sebagai negara hukum, pemerintah bertanggung jawab untuk memberikan kepastian hukum kepada semua warga negara Indonesia, sehingga tingkah laku dan hubungan setiap orang memiliki aturan dan batasan. Selain itu, ada beberapa peraturan yang tetap diakui tetapi tidak termasuk dalam hierarki peraturan perundang-undangan, sehingga peraturan yang berlaku tidak selalu termasuk dalam hierarki peraturan perundang-undangan. Tingkah laku dan aktifitas masyarakat harus diawasi agar tidak merugikan pihak lain ataupun dapat mengganggu perekonomian nasional. Apalagi dengan perkembangan teknologi yang setiap waktu selalu berkembang mewajibkan peran pemerintah selalu hadir dan selalu mengawasi karena aktifitas masyarakat pun selalu berkembang mengikuti perkembangan zaman dan teknologi. Oleh sebab itu akan selalu ada perkembangan peraturan di setiap waktunya menyesuaikan dengan kebutuhan agar dapat menjaga kestabilan perekonomian nasional. As a state of law, the government is responsible for providing legal certainty to all Indonesian citizens, so that everyone's behavior and relationships have rules and limits. In addition, there are some regulations that are still recognized but not included in the hierarchy of laws and regulations, so the applicable regulations are not always included in the hierarchy of laws and regulations. People's behavior and activities must be monitored so as not to harm other parties or disrupt the national economy. Especially with the development of technology, which is always developing, it requires the role of the government to always be present and always supervise because people's activities always develop following the times and technology. Therefore, there will always be developments in regulations every time to adjust to the needs in order to maintain the stability of the national economy.

Abstract

The granting of special autonomy to local governments does not have a positive impact on its implementation, it can be seen that the regional governments that implement special autonomy are included in the category of underdeveloped and poor regions, this is due to the implementation that cannot be maximized and the limited authority to manage the potential and resources of the region and the authority of local governments to innovate is very limited and lacking due to most of the kunkuren authority is still under the authority of the government, so that the dependence on assistance from the central government is still large, thus a reconstruction of regulations on special autonomy is needed with the aim that it can be implemented and the regions are able to be independent in managing regional potential based on local resources and wisdom. The research aims to find out the problems of special autonomy and the concept of regulation which will be applied so that it has a positive impact in implementing special autonomy. The discussion uses a normative juridical approach method focused on analyzing literature and legal documents through doctrinal research. From the results of studies conducted in the implementation of special autonomy to several regional governments in Indonesia has not been successful and the main objectives of special autonomy have not been achieved, therefore it is necessary to change the concept of special autonomy regulation through the reconstruction of the legal concept of special autonomy in a form where concurrent authority only exists in local governments, special autonomy in the form of material autonomy whose authority lies with the provincial government and the central government has the authority to form regulations and implement regulations carried out by local governments, namely the provincial government
