Abstract

Interfaith Marriage in a Positive Legal Perspective in Indonesia. This study aims to determine, and analyze the legitimacy of interfaith marriages in terms of marriage laws that apply in Indonesia and analyze what legal consequences arise in marriages of Indonesian citizens with foreign citizens of different religions. This study uses a normative juridical approach. A juridical approach is used to analyze various principles and theories related to the problems studied. The results of the study show that the validity of marriage in Indonesia cannot be separated from religious law, where interfaith marriages are seen from Islamic religious law and Christian religious law and other religions, basically it is not allowed to be carried out, so that if there are interfaith marriages carried out, the marriage is considered invalid. The legal consequences arising from interfaith marriages are the juridical and psychological aspects. Which is where if this interfaith marriage occurs, its legality is not recognized both in formal juridical and religious terms. Then from the psychological aspect of marriage which results in the status and belief of children, because in Indonesia they consider a legitimate child to be a child born from a legal marriage.

Abstract

This study examines the use of unwritten contracts in trade activities, with the aim of understanding the applicable practices and their implications for civil law in Indonesia. The research method used is qualitative with an approach to document study and in-depth interviews with business actors and legal practitioners. The results of the study show that unwritten contracts are often chosen because of the speed and flexibility factors in day-to-day business transactions, although this carries significant legal risks, including ambiguity in the enforcement of the rights and obligations of the parties. The study also explores how civil law provisions can be interpreted and applied in cases where unwritten contracts are the source of disputes. This study provides recommendations to increase legal awareness among business actors and proposes policy changes that can strengthen the legal framework for the use of written contracts in trade. The implications of this research are relevant for the development of more transparent and accountable trade laws and practices.

Abstract

Penguatan Pelayanan Kesehatan Primer (Primary Health Care) penting dilakukan demi meningkatkan efektivitas dan efisiensi pelaksanaan Program Jaminan Kesehatan Nasional. Namun implementasinya belum berjalan maksimal. Apalagi di era Revolusi Industri 5.0. Fasilitas Kesehatan Tingkat Pertama (FKTP) masih belum memenuhi target yang telah ditetapkan. Tujuan penelitian adalah untuk mengetahui dan menganalisis penguatan pelayanan jaminan kesehatan nasional yang berkualitas melalui Pelayanan Kesehatan Primar (Primary Health Care) di Era Revolusi Industri 5.0. Penelitian ini adalah metode penelitian hukum normatif, pendekatan peraturan perundang-undangan dan konseptual melalui analisis deskriptif kualitatif menggunakan bahan hukum primer, sekunder dan tersier. Hasil dan kesimpulan penelitian adalah penguatan pelayanan jaminan kesehatan nasional yang berkualitas melalui ketahanan Primary Health Care di Era Revolusi Industri 5.0 adalah meningkatkan kapasitas program Jaminan Kesehatan Nasional (JKN) dengan melakukan pembenahan bertahap dan berkesinambungan yang dilakukan bersama-sama seluruh stakeholder terkait. Dukungan pemerintah berupa pemerataan fasilitas kesehatan lewat alokasi anggaran kesehatan serta mewajibkan seluruh anggota masyarakat mengikuti program JKN dengan memasukkan sebagai syarat setiap pengurusan administrasi sehingga menunjukkan bentuk kontribusi dan partipasi warga masyarakat terhadap kelangsungan JKN dan tercapainya sistem gotong royong.

Abstract

It is known that in general the process of buying and selling transactions requires a physical meeting between the seller and the buyer, as per Article 1457 of the Civil Code. In the context of modern trade, buying and selling can be done face-to-face, without using original signatures and without territorial boundaries by utilizing information technology. Digital signature emerges as a concept that replaces the word “agree” in electronic transactions. Similar to analog signatures, digital signatures also serve to legitimize existing documents. However, currently there is still much debate regarding the recognition, legal force and legal consequences of electronic signatures, especially when disputes arise between the parties involved. The purpose is to determine and analyze the position of the validity of digital signatures in internet sales transactions: the perspective of the Civil Code and the Consumer Protection Law as well as the position of the parties in the internet Sales and Purchase Agreement. This research uses a normative juridical legal research approach. The approach used is legislation (state approach). In this legal research, analytical descriptive specifications are used. The method used is a literature study (Library Research) and qualitative data analysis using primary, secondary and tertiary legal materials which are interpreted in depth. The resume and discussion is that digital signatures are a very appropriate technique used to guarantee the authenticity of documents and avoid the possibility of someone leaking documents. This technique is much more sophisticated and more efficient than manual signatures. Information technology security is then regulated by law by not being an obstacle to technological development, but rather as a counterweight that provides security guarantees to its users. The law is here to provide protection for information technology.
