Abstract

The changing employment status of wives in Muslim households has become a significant social phenomenon impacting family dynamics, especially within Islamic family law. Increasing female workforce participation brings complex shifts in roles, responsibilities, and obligations of spouses, affecting household stability economically and socially. This study explores how Islamic family law responds to and regulates these changes, considering cultural and legal challenges posed by formal employment, such as Government Employees with Work Agreements (PPPK) and Civil Servants (PNS), versus informal employment. The research uses a qualitative library method, analyzing primary and secondary sources including books, journals, fatwas, and legal documents on Islamic family law. Through content and critical analysis, it synthesizes normative legal perspectives with empirical data—especially the mass divorce cases in Blitar and Cianjur—to understand the multifaceted impact of wives’ employment changes on household harmony. Findings highlight that while Islamic law keeps the husband as primary provider, it allows flexibility in recognizing productive roles of working wives, provided family harmony is preserved. The study underscores supportive spousal communication, psychosocial adaptation, and contextual legal interpretation to reduce conflicts from role changes. It concludes an integrative approach involving adaptive legal frameworks, family education based on Islamic values, and responsive social policies is essential to maintain Muslim family stability amid modern socio-economic transitions. This research offers valuable insights for academics, legal practitioners, and policymakers balancing tradition and modernity in Muslim family life.

تهدف هذه المقالة إلى مناقشة مفهوم المال من المنظور الإسلامي يشمل المعنى والنوع والوظيفة والموقع وطريقة الحصول على المال. تستخدم هذه المقالة البحثية منهجًا نوعيًا مع نوع البحث المكتبي. تقنية جمع البيانات المستخدمة هي التوثيق، مع تقنيات تحليل البيانات في شكل تحليل المحتوى والاستقراء والاستنباط. وخلاصة هذا المقال أن الملكية اسم لغير البشر، وهي ثابتة لمصلحة البشر، ويمكن الاحتفاظ بها في مكان، ويمكن أن تتم بالجهد، ويمكن أن يمتلكها كل إنسان، وتصح ل بيعاً وشراءً، ويمكن تملكه وله قيمة، ويمكن تخزينه لمدة طويلة أو قصيرة، ويمكن الاستفادة منه عند الحاجة. هناك عدة أنواع من الأموال، وهي الأموال المتقوّمة وغير الأموال المتقوّمة، و الأموال المضللة و الأموال القيّمة، وأموال الاستصلاح و الأموال الاستثمارية، و الأموال المنقولة، والأموال غير المنقولة. للأموال عدة وظائف، وهي سد الحاجات الإنسانية الشخصية، ووسيلة للتقرب إلى الله، ووسيلة لمساعدة المحتاجين، ووسيلة لبناء جيل حتى لا يصبح جيلاً ضعيفاً. . ومنزلة المال أنه ملك الله المطلق، وديعة، ومتاع للعبادة، وحلي، واختبار الإيمان. هناك عدة طرق للحصول على الأموال، وهي العمل، والسيطرة على أموال المباح، واتفاقيات/معاملات حقوق الملكية، والميراث، والشفعة.

Abstract

Artikel ini mengeksplorasi tantangan dan peluang dalam mengintegrasikan nilai-nilai Hukum Islam ke dalam sistem hukum positif di Indonesia, dengan fokus khusus pada upaya pemberantasan korupsi. Pokok permasalahan yang diangkat adalah bagaimana nilai-nilai dasar Hukum Islam, seperti keadilan, tanggung jawab, dan transparansi, dapat diterapkan secara efektif dalam konteks hukum nasional yang sekuler. Tujuan dari penelitian ini adalah untuk menganalisis potensi kolaborasi antara Hukum Islam dan hukum negara dalam menciptakan sistem hukum yang lebih adil dan berintegritas. Metode penelitian yang digunakan adalah analisis kualitatif berbasis literatur yang mengacu pada sumber-sumber terpercaya dan terakreditasi. Hasil penelitian menunjukkan bahwa meskipun terdapat tantangan signifikan, seperti perbedaan prinsip dan hambatan struktural, terdapat peluang besar untuk integrasi nilai-nilai Hukum Islam dalam hukum positif. Kesimpulannya, integrasi ini dapat memperkuat efektivitas penegakan hukum di Indonesia dan berkontribusi pada penciptaan sistem hukum yang lebih responsif dalam memberantas korupsi

Abstract

This article discusses the academic problem of the dominance of social gender construction in determining child custody in Indonesia’s Religious Courts, which hinders substantive justice, especially for women and children. This research employs a library research method with a qualitative approach and socio-legal studies to analyze key literature, regulations, court decisions, and recent empirical studies. The analysis finds that legal argumentation and judges’ narratives often reproduce gender bias through interpretations of the Compilation of Islamic Law and patriarchal social doctrines, resulting in child custody decisions that are frequently not based on the principle of the best interests of the child. The main recommendations are the reformulation of gender-responsive interpretations and regulations of Islamic family law, increased gender literacy among legal practitioners, and cross-sectoral advocacy to create a more just and inclusive family law system. These findings highlight the urgency of reforming Islamic family law based on substantive justice and child protection and provide both conceptual and practical contributions to the development of progressive Islamic studies in Indonesia.

Abstract

This research offers a novel contribution to Islamic family law by deconstructing the concept of mu’asyarah bil ma’ruf as a normative foundation for addressing contemporary legal and social challenges. Departing from traditional textual interpretations, the study reconceptualizes mu’asyarah bil ma’ruf as a dynamic and inclusive ethical-legal framework grounded in justice, reciprocity, and gender equality. The scope of the research covers ethical, social, and legal dimensions of harmonious family life in Islam, with particular attention to husband–wife relations and family justice. Employing qualitative library research, this study utilizes content and critical analysis of primary Islamic legal sources, court decisions, and relevant family law policies. The findings reveal that classical normative frameworks often reflect patriarchal assumptions that constrain women’s rights and fail to respond adequately to contemporary social dynamics, resulting in legal and social inequalities. Through a deconstructive approach, the research exposes these biases and proposes an alternative interpretation that emphasizes mutual respect, proportional rights and obligations, and substantive justice within the family. This study concludes that reinterpreting mu’asyarah bil ma’ruf is essential for developing a more just and responsive Islamic family law. Practically, the findings contribute to Islamic legal reform by providing a conceptual basis for gender-sensitive legislation, judicial interpretation, and family law policies that protect women and children while remaining firmly rooted in Islamic values.

Abstract

This study critically examines the practice of marriage dispensation due to zina (premarital pregnancy) in Indonesia through the integrated perspectives of gender justice, child protection, and Islamic law. Although Law No. 16 of 2019 raised the minimum age of marriage to strengthen child protection, empirical data show a continued increase in marriage dispensation applications and approvals in the Religious Courts, particularly in cases involving premarital pregnancy. Existing studies largely address marriage dispensation from doctrinal Islamic law or child marriage policy perspectives, while critical analyses of how judicial discretion operates in practice remain limited. The novelty of this study lies in its reconceptualization of judicial discretion as a mechanism of moral mediation rather than a rights-protective safeguard, and in its demonstration of how moral narratives surrounding zina shape judicial reasoning and marginalize child-centered assessments. Using a qualitative library-based method with a critical socio-legal approach, this study analyzes Religious Court decisions issued between 2019 and 2023, academic literature, and institutional reports. The findings show that marriage dispensation is frequently framed as an immediate response to social stigma and moral anxiety, causing the best interests of the child principle to function symbolically rather than substantively. This study contributes to Islamic family law scholarship by offering a new analytical lens for evaluating marriage dispensation practices and their implications for child protection and gender justice.

Abstract

This study aims to examine how women’s leadership roles in households can be conceptualized through the lens of maqāṣid al-syarī‘ah and modern sociology, offering an integrative framework that aligns normative Islamic principles with observed social dynamics. Using a library research approach, the study systematically analyzes authoritative Islamic legal sources, classical and contemporary sociological theories, and findings from existing empirical studies on family roles and gender relations. Rather than conducting original fieldwork, this research synthesizes prior empirical evidence to assess the normative legitimacy, functional dimensions, and societal implications of female leadership in the family. The analysis shows that the objectives of maqāṣid al-syarī‘ah—the protection of religion, life, intellect, progeny, and wealth—are compatible with sociological perspectives on gendered decision-making, role flexibility, and family well-being. This synthesis results in a conceptual model that supports equitable role distribution, promotes justice, and strengthens family resilience amid socio-cultural change. The study concludes that empowering women in family leadership roles, when grounded in both Islamic objectives and sociological insights, contributes to a more balanced and sustainable household structure, and it recommends future empirical research to test and contextualize this model across diverse cultural settings.
