Abstract

The concept of property ownership in Islam has unique characteristics, which are in line with human nature. In contrast to the two currently developing concepts, capitalism and communism, neither system has succeeded in bringing individuals or groups into harmony with a social order of life. Individual property rights freedom is the foundation of the concept of capitalism, and the abolition of individual property rights is the main goal of socialism-communism teachings. Because humans are born into the world and do not own any property, the purpose of this paper is to investigate Islam's concept of ownership (the owner of the universe, the role of humans, and who provides everything). This article uses the literature study method, which entails gathering information from various sources, including books and related articles on property ownership in Islam. The findings of this study show that God owns everything in the universe, and humans did not have property in the world at first, but all the gifts that God gave with the guidance to use them as well as possible for the benefit of many people.

Abstract

In the Koran, nature is described as a book compiled by a wise being, whose every line and word is a sign of the wisdom of its author. Of course, nature can no longer be separated from social life. Economic activities and social life are two interrelated things. In this case, economic activity is a human activity in order to fulfill all his life needs. In general, there are three types of economic activities, namely: production, distribution and consumption. These three things are mutually sustainable. In this modern era, economic activities are greatly influenced by government intervention and policies. Apart from that, this economic activity is influenced by natural resources, human resources, management systems and so on.

Abstract

Current Islamic Economy One of the main challenges is the low level of sharia financial literacy among the public. This causes the public to still have low interest in using sharia financial products and services. Another challenge is the lack of research and development in the field of Islamic economics and the lack of application of Islamic economics in business practices in Muslim countries. Therefore, efforts are needed to increase sharia financial literacy among the public, increase research and development in the field of Islamic economics, and apply Islamic economics in business practices in Muslim countries. Researchers decided to use qualitative research methods. Researchers use qualitative research methods because the opinions of each expert and practitioner are definitely different, a science can be very solution and relevant if applied at one time, but it could be useless if applied at a different time. Ushul fiqh in Islamic economics can be applied not to economics but to an economic system. Because the system is a regulation that requires a basic set of foundations that are qath'i based on revelation. The role of Ushul Fiqh as a methodology for developing economic systems in order to answer all contemporary economic problems. Meanwhile, in its application, Jazuli classifies qawa'id into six different areas, namely mahdhah (special) worship, ahwal as-Syahshiyyah (personal and family matters), mu'amalah maaliyah (economic transactions), jinayah (criminality), siyasah ( politics), and fiqh qadhaya (procedural and judicial law). Among the most basic qawa'id in this matter is "All forms of muamalah are basically permissible (allowed) unless there is an argument that forbids it." In the economic context, maqashid shari'ah has a dual role, namely: as a control tool as well as a social engineering tool to realize human benefit. It provides a rational philosophical basis for economic activity. Without maqashid shari'ah, understanding and practice of Islamic economics will be narrow, rigid, static and slow. Islamic economics will lose the spirit and substance of its sharia. But on the contrary, with maqashid syari'ah, Islamic economics develops elastically, dynamically, in accordance with the character of Islamic syari'ah which is universal and relevant for all time and space).

Abstract

Introduction: Waqf is a sign of giving whose implementation is carried out by retaining (ownership) of origin (tahbisul ashli), then making the benefits generally accepted. Purposes of the Research: To find out about the management of waqf property in North Sumatra, especially the waqf land of Tengku Darwisyah in Serdang Bedagai according to positive law and Islamic law.Methods of the Research: This research is a qualitative study with a social history approach to Islamic law.Results of the Research: The management of the waqf land of Tengku Darwisyah is still far from expectations because it has not been managed perfectly and only has a traditional and consumptive nature, and there has been no good management. In addition, the trustee of the waqf of Tengku Darwisyah is passive and even fatalistic by allowing tenants to build permanent structures such as places of worship, sports halls (GOR), farms, and trading companies, which should be productive, and this policy is not based on any contract or agreement.

Abstract

This research aims to analyze the customer benefit of Islamic unit link by ANP method (Analytic Network Process). The analysis resulted that the value of inconsistency index < 0,1, it means that all respondents are consistent in answering the questionnaire. W value of opportunity and benefit cluster is 1; it means all respondents have complete agreement. While W value of cost cluster is 0,18 and risk cluster is 0,15. It means that agreement among respondents is lower. The most dominance cost is acquisition cost (2.49273), and the most dominance risk is discomply to Syariah risk (2.71049). The score of benefit cluster for the customer is lower than Cost cluster (6.52) and Risk cluster (6.83), because of benefit cluster score 6.21. In answering choice between buying or don't buy Syariah unit link, attention must be paid to opportunity cluster score, namely 4.75. It is lower than benefit, cost, and risk cluster. It shows that Syariah unit link is offering a lower opportunity to gain financial benefit than bearing cost and risk.
