Abstract

The purpose of this study was to determine the implementation of counselees through Islamic religious courts in resolving polygamous household disputes (a case study at the Rantauprapat Islamic religious court, Labuhanbatu Regency in 2018-2021), especially about how it is planned, what are the steps, what are the inhibiting and supporting factors, and why the need for counselees at the Rantauprapat religious court. This study uses a qualitative method. This research takes place at the center of the Rantauprapat religious court. Data collection techniques using documentation, interviews and observations. The data analysis technique uses data collection, data reduction, data presentation and conclusions. The research informants here are the head of the religious court, judges, mediators, KUA and community leaders in Labuhanbatu. This research starts from the initial study from March to August 2021. The results showed that; 1) counselee planning at the religious court of Labuhan Batu Regency in reducing the number of polygamy disputes is carried out in two plans, namely based on service culture and based on transformative culture. 2) The counselee's steps at the Labuhan Batu Regency Religious Court in reducing the number of polygamy disputes are carried out in two steps, namely the Educational Step and the Consultative Step. 3) Inhibiting and supporting factors. The supporting factors are because of the facilities and infrastructure, the tools or instrumentals used, the understanding material about the importance of the sakinah family and the evaluation of technical implementation. Meanwhile, the inhibiting factors are the lack of awareness of some people to participate in the sakinah family program, less than optimal empowerment, less than optimal support from P3K, not yet optimal provision of constructive sakinah family development activities through the sakinah family festival.

Abstract

This study aimed to see the implementation of intellectual property rights (IPR) waqf in urban society from the Perspective of Maqasid Shariah. This research applied a qualitative approach to depict social phenomena and processes in implementing Intellectual Property Rights Waqf in Medan urban communities. The qualitative approach allows researchers to gain deep insight into people's views, attitudes, and understanding of waqf and intellectual property rights. The data collection techniques used were interviews and documentation. The findings show that the implementation of IPR waqf in the urban society of Medan City, from the perspective of Maqasid Shariah, holds great potential for societal development and the promotion of knowledge and innovation. However, clear regulations and guidelines that address the specific challenges of IPR waqf must be established to facilitate its successful execution. Through collaboration and a comprehensive approach, the integration of IPR assets into the waqf framework can bring significant social and economic benefits to the urban society of Medan City. Despite the challenges faced, the implementation of IPR waqf in Medan City holds immense potential for the development and growth of the urban society.

Abstract

This paper aims to analyze the impact and legal consequences of extraordinary legal efforts for judicial review in the religious courts of divorce cases from the perspective of mashlahat al-mursalah. The method used is normative legal research using multiple approaches including legislation, cases, and a comparative approach with data analysis techniques using descriptive analysis methods. The conclusion of this study shows that legal remedies for judicial review of divorce cases that have permanent legal force (inkracht van gewijsde) create new problems (mafsadat) in society, so for the sake of legal certainty, it is better if legal remedies taken against divorce cases are sufficient to the level of appeal. or just appeal. The Compilation of Islamic Law (KHI) has a strategic position to regulate the provisions of the procedural law, considering that the position of KHI so far has not only played a role in regulating material law, it also regulates formal law against Muslim divorces in Indonesia.

Abstract

This article aims to explain the difference in the judge’s ruling (disparity) related to child custody (hadhānah) in the Aceh Sharia Court. This article is field research with a qualitative approach. The research method used is a normative-empirical law phenomenology that compares several judges' verdicts on hadhānah cases in the Aceh sharia court. In addition, it also describes that although Indonesia has the same Islamic legal product (KHI) but in implementation between one Judge and another can produce a different verdict. The disparity of the judge's decision that occurred in some cases in Aceh began from the legal provision that the child could not choose a father or mother if the condition had not been mumayiz. In the context of age, custody is given to his mother. In fact, there is a problem with a different verdict by KHI, that is the custody given to the father at the first stage and custody back to the mother at the appeal stage in Sharia Court. The results of the study are; First, the disparity of the judge's verdict is a reasonable situation that occurs depending on the explanation of witnesses and the fact-finding in the field. Second, the KHI format is not absolute in deciding the cases, it takes other proof so that the Judge invites expert witnesses to consider the verdict. Third, consideration of the child's mental, environmental, and condition should be a priority to decide on ideal custody.

Abstract

Perselisihan perceraian antara suami istri seringkali melibatkan konflik emosional yang mendalam dan dampak psikologis yang signifikan, baik bagi pasangan yang bercerai maupun anak-anak yang terlibat. Menurut Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2016, mediator adalah pihak netral yang membantu para pihak dalam proses perundingan untuk menyelesaikan sengketa, serta Undang-Undang No. 1 Tahun 1974 tentang Perkawinan: Pasal 39 ayat 2 mengatur bahwa “pasangan yang mengajukan perceraian harus menjalani proses mediasi, di mana dalam hal ini psikolog dapat berperan sebagai mediator atau konselor”. Dalam konteks ini, Psikolog termasuk kategori Mediator Non Litigasi. Mediator adalah pihak netral yang membantu para pihak yang berselisih untuk menyelesaikan sengketa secara adil. Psikolog dianggap dapat membantu pasangan untuk memahami dinamika emosional yang mendasari konflik, memberikan ruang untuk berekspresi, serta membantu dalam mencari solusi yang konstruktif. Melalui mediasi yang dipandu oleh psikolog, diharapkan pasangan dapat mencapai kesepakatan yang lebih baik, meminimalkan dampak negatif perceraian, serta membantu menjaga hubungan yang sehat, terutama demi kesejahteraan anak. Hasil penelitian menunjukkan bahwa peran psikolog dalam mediasi perceraian suami istri memiliki dampak signifikan terhadap resolusi konflik dan pengurangan stres emosional. Penelitian ini mengungkapkan bahwa pasangan yang terlibat dalam sesi mediasi dengan psikolog melaporkan tingkat kepuasan yang lebih tinggi dalam penyelesaian masalah dibandingkan dengan mereka yang tidak melibatkan psikolog. Selain itu, psikolog dapat membantu pasangan untuk memahami perspektif satu sama lain, yang berkontribusi pada komunikasi yang lebih efektif dan pengambilan keputusan yang lebih rasional. Temuan lain menunjukkan bahwa dukungan psikologis yang diberikan selama proses mediasi dapat mengurangi perasaan cemas dan depresi pada individu yang mengalami perceraian. Psikolog juga berperan dalam mendampingi pasangan dalam mengelola emosi negatif dan membangun strategi coping yang lebih baik. Dengan demikian, keterlibatan psikolog dalam mediasi perceraian tidak hanya menguntungkan pasangan, tetapi juga mendukung kesejahteraan keluarga secara keseluruhan.

Abstract

Introduction: Waqf is a sign of giving whose implementation is carried out by retaining (ownership) of origin (tahbisul ashli), then making the benefits generally accepted. Purposes of the Research: To find out about the management of waqf property in North Sumatra, especially the waqf land of Tengku Darwisyah in Serdang Bedagai according to positive law and Islamic law.Methods of the Research: This research is a qualitative study with a social history approach to Islamic law.Results of the Research: The management of the waqf land of Tengku Darwisyah is still far from expectations because it has not been managed perfectly and only has a traditional and consumptive nature, and there has been no good management. In addition, the trustee of the waqf of Tengku Darwisyah is passive and even fatalistic by allowing tenants to build permanent structures such as places of worship, sports halls (GOR), farms, and trading companies, which should be productive, and this policy is not based on any contract or agreement.

Abstract

This study aims to explain the Legal Protection for Child Prisoners of Narcotics at the Class I Special Development Institution for Children in Medan based on Law No. 11 of 2012 concerning the Juvenile Criminal Justice System. The type of research used by the author is field research with a qualitative descriptive method. It employs a socio-legal approach and a statute approach, while the types of data used consist of primary and secondary data. The problem in this study is that Article 98 paragraph 1 of the Compilation of Islamic Law states that the age limit for a child who is able to stand independently or is considered an adult is 21 years, provided that the child does not have physical or mental disabilities and has never been married. The results of this study indicate that the Legal Protection for Child Prisoners of Narcotics at the Class I Special Development Institution for Children in Medan based on Law No. 11 of 2012 concerning the Juvenile Criminal Justice System is, in Islamic law, known as Maqāsid Al-Syarī’ah, which consists of two words: Maqāsid, meaning objectives and purposes, and Al-Syarī’ah, meaning the establishment of Allah’s law, which serves as a guide for humans to achieve happiness in this world and in the hereafter.

Abstract

Indonesia’s Marriage Law No. 16/2019 mandates marriage registration, yet cultural-religious norms perpetuate nikah sirri (unregistered marriages), particularly in polygamy, denying wives spousal rights. While Islamic law validates such unions via rukun and syarat, statutory exclusion strips wives of inheritance, alimony, and child legitimacy, violating maqashid sharia principles like hifz al-nasl (lineage) and hifz al-mal (property). Prior studies identify this dissonance but lack systemic reforms bridging Islamic jurisprudence and comparative law. This research addresses this gap by analyzing wives' legal status in unregistered polygamy under Islamic and Indonesian law, designing reforms reconciling religious validity with enforceable safeguards. Using normative legal research, it combines doctrinal analysis of Islamic texts/statutes with qualitative analysis of Religious Court rulings. Findings reveal 78% of nikah sirri wives face economic disenfranchisement, and 89% lack alimony recourse due to burdensome retroactive marriage validation. Comparatively, Malaysia’s and Morocco’s laws slashed polygamy rates (95%, 99.7%) via judicial oversight absent in Indonesia. Legal pluralism enables patriarchal qiwamah interpretations: 67% of Java’s polygamy permits bypass spousal consent; 72% of rural nikah sirri involve child brides. Consequently, 81% of unregistered wives suffer disinheritance; 54% of children endure stigma. The study innovates by proposing a hybrid reform model integrating maqashid sharia with feminist jurisprudence, advocating specialized courts, simpler isbat nikah, and criminalizing unregistered solemnization. Aligning with Moroccan/Malaysian models could cut nikah sirri by 40%, upholding hifz al-ird (dignity) and constitutional equity, offering a blueprint for Muslim-majority nations

Abstract

This paper aims at explaining the criminal provisions in government regulation number 9 of 1975, according to Law Number 12 of 2011. The research method used in conducting this article is a qualitative research method with a normative juridical research type using the statute approach. Sources of data are divided into two forms, namely primary data sources obtained directly from main sources such as the head of the Regional Office of the Ministry of Religions of the Republic of Indonesia, Commission III of the House of Representatives of the Republic of Indonesia, the Head of the High Court of Religion of North Sumatra, and Experts in the field of Islamic Law. In addition, laws and regulations and the book of ushul fiqh are used as secondary materials. Data analysis was carried out in the stages of data reduction, data presentation, and conclusion. The results show that the criteria for marriage that can be punished or fined are divided into two, namely, First, is the presence of intention. Second, the action is detrimental to another person, in other words, the injured person reports or complains about the detrimental action to the police so that it can be processed because the provision is a complaint offense. Tulisan ini bertujuan untuk menjelaskan ketentuan pidana dalam peraturan pemerintah nomor 9 tahun 1975 menurut Undang-Undang Nomor 12 Tahun 2011. Adapun metode penelitian yang digunakan dalam penulisan artikel ini adalah metode penelitian kualitatif dengan jenis penelitian yuridis normative menggunakan pendekatan statute approach. Sumber data terbagi pada dua bentuk yaitu sumber data primer yang diperoleh langsung dari sumber utama seperti Kepala Kanwil Kementerian Agama RI, Komisi III DPR RI, Ketua Pengadilan Tinggi Agama Sumatera Utara, dan Pakar dibidang hukum Islam. Selain itu, peraturan perundang-undangan dan kitab ushul fiqih dijadikan sebagai bahan sekunder. Analisis data dilakukan dengan tahapan reduksi data, penyajian data, dan kesimpulan. Hasil penelitian menunjukkan bahwa kriteria pernikahan yang dapat dipidana atau didenda terbagi kepada dua, yaitu; Pertama, adalah adanya niat atau unsur kesengajaan. Kedua, tindakan tersebut merugikan orang lain, dengan kata lain, bahwa orang yang dirugikan tersebut melaporkan atau mengadukan perbuatan yang merugikannya kepada pihak kepolisian, sehingga dapat diproses, karena ketentuan tersebut merupakan delik aduan.
