Environmental management becomes the attention of environmental existence because the exploitation is always in contiguity with nature, including forest exploitation which has positive and negative effects. On the one hand, the forest provides economical growth, but it also brings the natural demage (environmental ecosystem) on the other hand. The legal norms become a border and a sign of legal subject flexibility at once for forest exploitation. According to Gustav Radburch, the purposes of law are fairness, certainty and usefulness; it will become the hope to create environmental management which has environmentally sound based on Law No. 32 of 2009 on the Protection and Environmental Management. This article uses a normative legal research based on legal system components including the structure, substance and legal culture. There are some rights and obligations in environmental management; the right to live in healty and good environment, and obligation to keep the environment as well as possible. Justice in environmental management can be actualized if rights and obligations are run inequilibrium. Whereas, the legal certainty lies in the rule of law that become the reference of legal subject to exploit the forest resources. The legal certainty can be run effectively if it supported by good law enforcement. The legal benefit is achieved when the domminant legal subject perceived to benefit happiness. Fairness, certainty and benefits provide significant functions to maintain the environmental management with environmentally sound. But it can not be implemented simultaneously because of different tasks and functions.

AbstractPopulation growth in Samarinda in 2017 and 2018 had an impact on the increasing development and significant growth of vehicles. Vehicle growth was not supported by the availability of parking lots, so the sidewalks became parking lots for vehicles. This research intended to find the legal protection for pedestrians in public spaces in Samarinda and its obstacles and supporting factors. The research method used was an empirical and juridical legal study by applying the laws and regulations as the basis for legal argumentation, as well as conducting interviews with relevant agencies related to research. Pedestrians in public spaces in Samarinda were protected by legal norms in Article 25 paragraph (1) of Law Number 22 of 2009 concerning Traffic and Road Transportation. Every road used for public traffic must have sidewalks for pedestrians. Sidewalks in Samarinda had become a place for hawkers to sell and for riders or drivers to park their vehicles. The inhibiting factors were the limited availability of the budget, sidewalks for trading by hawkers, sidewalks for parking lots. Supporting factors were legal certainty, the realization of law order, and legal protection for students. Bagaimana perlindungan hukum kepada pejalan kaki pada ruang publik di Kota Samarinda dan apa faktor penghambat dan pendukungnya. Metode penelitian yang digunakan yuridis empiris dengan menerapakan peraturan perundang-undangan sebagai landasan argumentasi hukum. Serta melakukan wawancara kepada instansi terkait yang berhubungan dengan penelitian. Pejalan kaki pada ruang publik di Kota Samarinda dilindungi oleh norma hukum dalam Pasal 25 ayat (1) Undang-undang Nomor 22 Tahun 2009 tentang LLAJ. Setiap jalan yang digunakan untuk lalu lintas umum wajib dilengkapi trotoar untuk Pejalan Kaki. Trotoar di Kota Samarinda menjadi tempat berjualan pedagang kaki lima dan parkir kendaraan bermotor. Faktor penghambat yaitu ketersediaan anggaran yang terbatas, trotoar digunakan berdagang oleh pedagang kaki lima, trotoar menjadi tempat parkir kendaraan bermotor. Faktor pendukung yaitu adanya kepastian hukum, terwujudnya ketertiban hukum dan perlindungan hukum kepada siswa/i. Kata Kunci: Trotoar; Pejalan Kaki

The existence of facilities and infrastructure are important parts of achieving justice in the community. The issue of justice so far has talked a lot about issues of infrastructure for people with disabilities. This study aims to examine normatively how the responsibilities of the East Kalimantan regional government in providing facilities in public spaces for people with disabilities. This research basically begins with a normative legal study which examines a behavior from the perspective of the prevailing legal norms. The focus of this research is aimed at examining the existence of normative local government responsibilities. Furthermore, the researchers explored social facts related to the provision of facilities for people with disabilities in East Kalimantan, especially in Samarinda. This study found the responsibility of local governments regarding the provision of facilities for disabilities with the issuance of Peraturan Daerah Nomor.1 of 2018 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities. The results of this study confirm that with the existence of Law Nomor 8 of 2016, local governments are the party responsible for fulfilling the rights of persons with disabilities. In addition, this study also indicates the existence of supporting and inhibiting factors in the implementation of the fulfillment of facilities for persons with disabilities.

Tulisan ini membahas tentang tinjauan yuridis terhadap hak pengasuhan anak yang tinggal di rumah tahanan. Anak sebagai generasi emas menjadi harapan penerus kemajuan bangsa. Untuk menjaga harapan, dimulai dari subyek pengasuh hingga pada pola pengasuhan. Data yang dirilis KPAI pada kasus pengasuhan dan alternatif dari tahun 2011-2016 mencapai 3.875 dengan menempatkan anak sebagai korban. Dengan menggunakan metode penelitian hukum normatif, penelitian difokuskan pada objek kajian tentang kaidah atau peraturan hukum tentang pengasuhan anak. Hasil kajian pada penelitian ini adalah pengasuhan anak menjadi tanggung jawab orang tua, namun pengasuhan akan dilimpahkan kepada keluarga sampai derajat ketiga maupun orang tua asuh, orang tua angkat, wali, Lembaga Kesejahteraan Sosial Anak serta pengasuhan berbasis residensial sebagai alternatif terakhir apabila timbulnya hambatan dalam pertumbuhan dan perkembangan anak, maka dapat dicabut kuasa asuhnya sebagai orang tua terhadap anaknya.

The law on child protection has been established since 2002 and was amended twice in 2014 and 2016. Local governments based on their authority to establish regional regulations on child protection such as that carried out by Samarinda City and Kutai Kartanegara District. The spirit of regional regulations is to strengthen the regulations that have been formed above by adjusting local wisdom. However, the child protection agency, the Center for Integrated Services for the Protection of Women and Children (P2TP2A), Samarinda City and Kutai Kartanegara Regencyin handling cases using laws rather than regional regulations. P2TP2A reports directly to the Women’s and Child Protection Unit (PPA) at the nearest Police station, so that the subject of law enforcement is carried out by the Police based on the provisions of the law not the enforcement of local regulations by the civil service police unit. The factor is that sanctions in the law are higher than the regulations, there are no special units such as the Protection of Women and Children (PPA) in the Pamong Praja police unit (Satpol PP) and personnel who do not have certificates handling child cases.How to cite item: Murjani, M., Sagama, S. The state capital will be moved from Jakarta to East Kalimantan. The buffer zone for the new State Capital must prepare early for the presence of the State Capital. There will be a new development, population migration, job competition, transport overcrowding, and air pollution. Therefore, it is necessary to know the legal policies issued by the buffer zone of the new State Capital in determining the Regional Spatial Plan (RTRW) and the factors that influence it. Normative legal research method by using a positive legal system to get a juridical answer. As a result, the buffer zone of the state capital has not issued a legal policy on the RTRW in dealing with the new state capital. There are other policies issued, for example, the North Penajam Paser Regency issued regent regulation number 22 of 2019 concerning Supervision and Control of Land Sale/purchase Transactions/Transfer of Land Rights. The issuance of the RTRW legal policy can become the legality of development carried out by local governments and the prevention of legal actions, both violations, and crimes.

This article discusses the hierarchy of regulation formation. The problem being discussed in this article is related to the regulations that are formed contrary to the rules above and therefore, they are canceled or revised. Although explicitly in the formation of regulations, it is mandatory to follow the regulation hierarchy. Hence, it causes financial problems because the regulations cannot be implemented. It is juridical normative based research. The result of this research suggests that it is necessary to reformulate the regulations hierarchy on the formation of state regulations. It also suggests that the hierarchy of the regulations formation has positive and negative values. It is positive because it can maintain orderliness in the formation of regulations, while negative values will occur in the formation of the regulations. Therefore, to strengthen the hierarchy of the formulation of laws and regulations, it is necessary to have specifically certified legal drafter to form the regulations. As in the principle of legal fiction, that person is considered to know the rule can be realized properly.

Bawaslu was formed to oversee elections and elections to run in a direct, free, confidential, honest, and fair manner. Bawaslu's authority is only to supervise in stages. In 2024, elections and elections will be held simultaneously. The stages will start again before the elections and elections in 2029. Researchers are interested in knowing the existence of Bawaslu post-election and elections in 2024. The research uses a normative legal research method with a statutory approach. Based on Law Number 7 of 2017 concerning Elections, Bawaslu only has supervisory authority at the election and election stages for 20 months. Bawaslu oversees the stages set by the KPU based on the PKPU. After the general election and simultaneous elections in 2024, Bawaslu does not have supervisory authority until it enters the stages for implementation in 2029. The existence of Bawaslu without any supervisory activities can return to being an ad hoc body at the beginning of its formation.
