Abstract

This article aims to analyze the dispute between Indonesia and China regarding the Natuna Islands from an international law perspective. As a maritime country with many islands, Indonesia has abundant natural wealth in its territory. However, Indonesia and China's conflicting claims over the Natuna Islands have created tensions and disputes between the two countries. The dispute is related to the ownership and utilization of resources on Natuna Island which is in the Indonesian Exclusive Economic Zone. The impact of this dispute includes economic instability, divisions between countries, political losses, and social problems. In dealing with these impacts, it is necessary to carry out effective resolution efforts. Settlement of the Natuna islands dispute between Indonesia and China can be done through several strategic steps. First, regional border management is improved, economic activity is improved by exploring for oil in the Natuna Islands, then through an international legal approach, this article will review the relevant legal basis, legal arguments used by both parties, as well as possible settlement efforts.

Abstract

Kemajuan teknologi dalam Revolusi Industri 4.0, seperti Kecerdasan Buatan (AI), robotika, dan Internet of Things (IoT), serta Blockchain, telah mengubah lanskap tradisional di berbagai sektor, termasuk Ekonomi, Sosial, Budaya, Hukum, dan Politik. Revolusi ini menciptakan transformasi yang mendalam dalam cara kita bekerja, berinteraksi, dan mengelola sistem di era modern ini. Pada saat ini berhukum di indonesia melibatkan dua aspek utama, yaitu perancangan hukum dan implementasi penegakan hukum. Dengan memanfaatkan blockchain, kita dapat menciptakan lingkungan dengan integritas, transparansi, dan keamanan informasi sebagai prioritas utama. Blockchain dapat digunakan untuk mencatat dan mengamankan bukti digital, menyederhanakan pelacakan transaksi, dan meningkatkan akurasi serta kepercayaan dalam sistem peradilan. Dalam penelitian ini, digunakan metode yuridis empiris dengan menerapkan pendekatan perundang-undangan. Kata Kunci: Revolusi Industri 4.0, Perancangan Hukum, Penegakan Hukum, Blockchain.

Abstract

This paper explores the connection between Article 33(3) of the 1945 Constitution of Indonesia, the welfare state theory, and the Kaldor-Hicks efficiency principle in the management of natural resources, particularly in the oil and gas sectors, using a normative juridical method. Since independence, Indonesia has been founded on the rule of law, ensuring justice, equality, and protection for its citizens. Article 33(3) establishes the philosophical and economic foundation of Indonesia’s welfare state by mandating that vital sectors and natural resources be controlled by the state for the people’s prosperity. However, globalization and excessive state monopolization have created inefficiency, corruption, and slow growth. Integrating the welfare state theory, which emphasizes public welfare, with the Kaldor-Hicks principle, which values policies that increase overall societal well-being even if some are disadvantaged, provides a more balanced framework. Allowing private participation under strict state supervision can enhance efficiency and innovation while maintaining constitutional integrity. The term “state control” should be understood as a regulatory and supervisory function rather than absolute ownership, ensuring accountability, transparency, and fairness. Thus, effective governance requires the state to act as both facilitator and regulator, balancing social justice and economic efficiency. This combination of welfare and efficiency theories, analyzed through a normative juridical approach, supports a constitutional model that promotes equitable and sustainable national prosperity.
