Abstract

Perselisihan hubungan industrial secara normative terdiri atas perselisihan hak, perselisihan kepentingan, perselisihan Pemutusan Hubungan Kerja dan perselisihan antara serikat pekerja dalam satu perusahan. Perselisihan hak dan perselisihan kepentingan memungkinkan melibatkan pengusaha, pekerja maupun serikat pekerja dengan demikian perselisihan yang terjadi antara serikat pekerja dengan pengusaha dibatasi dengan perselisihan hak dan kepentingan. Ketika perselisihan yang timbul antara serikat pekerja dan  pengusaha itu terkait dengan usaha untuk menghalangi terbentuknya atau berjalannya serikat pekerja maka undang-undang tentang Serikat Pekerja mengkategorikan sebagai tindak pidana kejahatan. masalah yang dibahas dalam tulisan ini adalah apakah union busting tepat dikategorikan sebagai tindak pidana kejahatan dan bagaimana penempatan union busting dalam perselisihan hubungan industrial? tulisan ini merupakan penelitian normative dengan data sekunder. hasil dari kajian ini adalah union busting tidak tepat dikategorikan sebagai tindak pidana kejahatan. semestinya union busting dapat dikategorikan sebagai perselisihan hubungan industrial.

Abstract

State Civil Apparatus assist in carrying out the government's duties to achieve Indonesia's national goals. However, issues arise when a Civil Servant is dismissed for actions detrimental to the state. This research addresses two main questions: whether the administrative sanctions were imposed in accordance with statutory regulations, and whether they complied with Law Number 5 of 2014 concerning State Civil Apparatus. The research method is qualitative, employing normative legal research. The findings reveal that the dismissal decree was not based on appropriate legislation, as the Plaintiff had pursued a legal remedy through cassation. However, the sanctions were in accordance with Law Number 5 of 2014, as the Plaintiff was found guilty of fraud and sentenced to 2 years and 8 months in prison. The conclusion is that the Defendant erred in their consideration of the administrative sanction, basing it on the Bengkulu District and High Courts' decisions, which had not yet gained permanent legal force. Thus, the dismissal is deemed invalid

Abstract

Dishonorable Dismissal of Brigadier Iis Sudarsono according to No. Put. KEPP/02/VIII/2020/KKEP. Discrepancies were found in the formal juridical process of PTDH law enforcement as regulated in Perkap No. 19 of 2012 and Perkap no. 14 of 2011 concerning the Police Professional Code of Ethics, which should be strict and rigid. The legal issues in this research are; Is the Code of Ethics Commission's decision in Decision No. PUT. KEPP./02/VIII/2020/KKEP in accordance with Law no. 2 of 2002 concerning the National Police of the Republic of Indonesia, and what are the legal consequences of this decision according to Law no. 2 of 2002? Normative research method with secondary data. The research results and conclusions are that the decision is not in accordance with Law no. 2 of 2002, so it was declared null and void and invalid. The legal consequence is decision no. Put. KEPP/02/VIII/2020/KKEP is considered null and void and has legal consequences for the decisions that will be taken in this Professional Code of Ethics hearing.

Abstract

The Constitutional Court was established primarily to provide judicial review. Two main questions are whether Decision No. 2/MKMK/L/11/2023 of the Constitutional Court's Honorary Council complies with Law No. 24 of 2003 and Constitutional Court Regulations No. 4 of 2012 and No. 1 of 2023, and why the judges of the Constitutional Court's Honorary Council did not dismiss the Chairman of the Constitutional Court, Anwar Usman, as a constitutional judge in that decision. This thesis employs normative research methodology that is descriptive in character. backed up by secondary information obtained from primary, secondary, and tertiary legal sources. Anwar Usman should have been dismissed dishonourably for serious ethical violations, but the judges of the Constitutional Court Honorary Council chose not to dismiss him in order to uphold the legitimacy of Decision No. 2/MKMK/L/11/2023 and prevent appeals that might jeopardize legal certainty, according to the analysis.

Abstract

This study evaluates the inconsistencies in the decisions of the Constitutional Court (MK) regarding the judicial review of laws, specifically concerning the decision MK No. 29-51-55-90/PUU-XXI/2023. The aim of this study is to understand the reasons behind the differing positions of the MK when reviewing the same article, namely Article 169 letter q of Law No. 7 of 2017 on General Elections. The method used is normative legal research with a descriptive nature, utilizing secondary data as the source. Data collection is conducted through literature study, data analysis is qualitative, and conclusions are drawn using the deductive method. The research findings reveal inconsistencies in the MK's decisions. In Decision No. 90/PUU-XXI/2023, the MK added a new norm by establishing alternative requirements for Article 169 letter q of Law No. 7 of 2017. In contrast, in Decision No. 29-51-55/PUU-XXI/2023, the request to review the same article was rejected on the grounds that the regulation of the minimum age is an open legal policy of the lawmakers and does not violate the 1945 Constitution. This inconsistency raises questions about the integrity of the MK and reduces public trust in the institution. The study recommends that the MK maintain consistency in judicial review decisions to preserve its authority and public trust.

Abstract

Settlement of industrial relations disputes between companies and workers based on regulations on the settlement of industrial relations disputes must go through bipartite negotiations, mediation, or conciliation. The problem in this study is whether the settlement of the layoff conflict between Zainal Hakim and PT. Sukses Wijaya Adimakmur is in accordance with the Law on the Settlement of Industrial Relations Disputes and whether the decision of the Banjarmasin Industrial Relations Court judge in deciding the conflict between Zainal Hakim and PT. Sukses Wijaya Adimakmur is in accordance with Ministerial Regulation Number 35 of 2021. This writing uses a descriptive normative research method, data sources come from secondary data and are analyzed qualitatively, and conclusions are drawn using deductive methods. The result and conclusion are the procedure for resolving the layoff conflict carried out by the parties is not in accordance with regulations because it did not go through the initial stages of bipartite, mediation, or conciliation, so in the Banjarmasin District Court Decision Number 25/Pdt. Sus-PHI/2022/PN.Bjm there are formal defects in its settlement. In the judge's decision regarding the Demotion and Termination of Employment, it is legally valid, but in terms of the provision of severance pay, it is not accordance with statutory regulations.

Abstract

The existence of a mechanism for judicial review of laws against the Constitution is a fundamental aspect that ensures all legislation is aligned with the principles of the Constitution. This mechanism upholds the supremacy of the Constitution, protects the constitutional rights of citizens from potential violations that may occur through legislation that does not comply with constitutional provisions. In Indonesia, the Constitutional Court is responsible for assessing the constitutionality of laws based on the 1945 Constitution. In Germany, this is carried out by the Federal Constitutional Court (Bundesverfassungsgericht), which has the authority to review laws against the Grundgesetz (German Constitution). The research problem in this study is how the mechanism of judicial review of laws against the Constitution is carried out by the Constitutional Court in Indonesia and Germany, and how the differences and similarities in judicial review mechanisms are based on the law in Indonesia and Germany. This research uses secondary data sources and is therefore normative legal research, with a descriptive-analytical nature and conclusions drawn using deductive logic. The result and the conclusion reached is that the German Constitutional Court has broad authority, including the review of both abstract and concrete norms, and its decisions are both final and binding.

Abstract

Law Number 23 of 2014 grants Regional Governments the authority to protect, manage, and solve environmental issues within their jurisdiction. This research aims to identify the type of violation committed by PT RUM against the environment according to laws and regulations, as well as evaluate the effectiveness of the settlement between PT RUM and the community by the Sukoharjo Regency Government. The research follows a normative legal research approach, using secondary data as the primary source and interviews for supporting data. The research result and concludes that PT RUM has committed various violations, including improper pipe installation, failure to meet environmental quality standards, water and air pollution, and human rights violations. According to Appendix to Law Number 23 of 2014, the Sukoharjo Regency Government is responsible for supervising activities that require environmental permits and PPLH permits.

Abstract

Testing legislation against the Republic of Indonesia's 1945 Constitution is one of the Constitutional Court's several powers. Every law that is passed must comply with the Constitution and not be in contradiction with it, according to the Constitutional Court. The problem formulations in this article are how the Constitutional Court Panel of Judges' considerations of constitutional losses in the Constitutional Court Decision Number 90/PUU-XXI/2023 are reviewed from the General Election Law, as well as how the Petitioner's constitutional losses are reviewed from the General Election Law. The research method used is normative research, with primary and secondary data sources, and is qualitatively examined before drawing conclusions using deductive techniques. The results and conclusions are the Applicant's constitutional loss in Constitutional Court Decision Number 90/PUU-XXI/2023 was incorrect and did not adhere to Article 51 paragraph (1) of the Constitutional Court Law in conjunction with Article 4 paragraph (2) of PMK 2/2021, as well as that the Panel of Constitutional Justices' considerations of the constitutional loss in that same Constitutional Court Decision Number 90/PUU-XXI/2023 were incorrect and did not adhere to Article 51 paragraph (1) of the Constitutional Court Law in conjunction with Article 4 paragraph (2) of PMK 2/2021.

Abstract

The Constitutional Court, in conducting judicial review, has the authority to decide cases by granting, rejecting, or declaring the petition inadmissible. Furthermore, the Constitutional Court may issue decisions declaring certain provisions conditionally unconstitutional, meaning the law must be interpreted under specific conditions. However, there are instances where the Constitutional Court not only interprets existing norms but also introduces new norms in its rulings. The problem of this article analyzes the Constitutional Court Decision Number 143/PUU-XXI/2023. The considerations of Constitutional Court Judges are evaluated for their conformity with Article 73 of Constitutional Court Regulation Number 2 of 2021. Decisions that add new norms are also reviewed for their conformity with these regulations. This research adopts a normative legal method with a descriptive approach, relying on secondary data comprising primary, secondary, and tertiary legal materials. Conclusions are drawn using deductive reasoning. The findings and the conclusion indicate that the Justices, in this case, incorporated new norms into their considerations, exceeding mere legal interpretation. The decision is deemed inconsistent with Article 73 paragraphs (3) and (4) of PMK 2/2021, which limits the Constitutional Court's authority in deciding judicial review cases.
