Abstract

The implementation of primary education in Cimahi City in 2023 raises issues related to the exercise of the Regional Head’s authority within the framework of regional autonomy. This is due to a gap between the policies stipulated in Regional Regulation of Cimahi City Number 8 of 2021 concerning the Implementation of Education and their practical implementation in the field. The research problems formulated in this study are: how does the Regional Head play a role in administering primary education in Cimahi City in 2023? and what obstacles are encountered in its implementation? This study employs a normative juridical method using statutory and case study approaches. The findings and conclusions show that Regional Regulation Number 8 of 2021 provides a clear and firm legal foundation for the administration of education. However, its implementation still faces several obstacles, such as limited budget allocation, shortage of teaching personnel, inadequate educational infrastructure, and weak cross-sectoral coordination

Abstract

Since the tools are manual and can transmit between people when used simultaneously with fingerprint trackers, online presence is a mechanism that is used to stop the Covid-19 virus from spreading. Formulation of the issue; how to use online presence in the Directorate General of Customs and Excise, Ministry of Finance, in accordance with the hierarchy of laws and regulations during the COVID-19 pandemic; and arrangements for enforcing sanctions if they violate the rules regarding working hours for civil servants in the Directorate General of Customs and Excise, Ministry of Finance. This article is normative juridical method is the research methodology. The main data source consists of the outcomes of interviews The results of the research were analyzed qualitatively and conclusions used deductive logic. Research results and discussion as well as conclusions; first, the online attendance of the Director General of Customs and Excise was held based on SE-15/BC/2020 which is in accordance with the Minister of Finance Regulation Number 221/PMK.01/2021 where there is an obligation for civil servants to comply with civil servant discipline regulated in the Government Regulation on Civil Servant Discipline which is a follow-up rule from the State Civil Apparatus Law.

Abstract

The Constitution of the State is the foundation or basis for the establishment of a State. However, in practice, the fulfillment of election activities has several processes, one of which is party data verification which is used as a prerequisite for political parties to participate in the implementation of elections. The problem is whether the Elimination of Factual Data Verification of Political Parties Parliamentary Threesholds in KPU regulation No. 6 of 2018 is in accordance with Election Law No. 7 of 2017. This research method is normative. The nature of this research is analytical descriptive. The method of drawing conclusions is deductive logic. With qualitative data processing. The results of this research and discussion refer to the Election Law Number 7 of 2017 to discuss this research. The conclusion of the research is KPU Regulation Number 6 of 2018 regarding verification.

Abstract

Determination of Highest Retail Price LPG is important matter to highlight because it’s important for many people. HET in DKI Jakarta is based on the current Governor's Regulation that was made because the mandate from Minister of Energy and Mineral Resources regarding the Provision and Distribution of LPG. But in 2021 this Candy has changed and becomes a juridical problem for the validity and existence of Governor Regulation issued in 2015. This study is a normative juridical research that will be analyzed qualitatively. The conclusions chosen from a deductive logic point of view. The authority of the Governor of DKI Jakarta in Setting the HET for subsidized Gas in terms of laws and regulations from the Minister of Energy and Mineral Resources Number 28 of 2021 concerning Amendments to Minister of Energy and Mineral Resources Number 26 of 2009. Local governments are given authority to make regulations that shows the role of governor in deconcentration. implementation of Governor Regulation Number 4 of 2015 is running well and effectively. It’s hoped that consistency of local government to become a supervisor in implementing regulations regarding the HET for LPG gas is expected so there are no parties selling LPG gas above HET price

Abstract

Acting Officer is a temporary position specifically assigned to fill vacancies that occur with the aim of keeping the wheels of government running. The formulation of the problem in this article is whether the appointment of the acting Bogor Regency Regent is appropriate based on Law Number 23 of 2014 concerning Regional Government and how the authority of the acting Bogor Regency Regent in carrying out Regional Government duties based on Law Number 23 of 2014 concerning regional government. The research method used is normative, analyzed descriptively qualitative and drawing conclusions with deductive logic. The results of the research and discussion are the authority and duties of the PLT Regent of Bogor Regency are only based on general regulations, namely Article 65 paragraphs (1) and (2) concerning Regional Government which contains the Authority and Regional Head, not the PLT, and the authority of the PLT is limited by Article 132 A paragraph 1 of Law Number 49 of 2008. The conclusion is that there are no regulations that specifically regulate the Appointment of PLT Officials.

Abstract

A football match on October 1, 2022 at the Kanjuruhan stadium in Malang ended in a riot. Related to this, the security forces used tear gas to overcome the riots, but allegedly due to the excessive use of tear gas, it resulted in the loss of 135 lives in the stadium. The large number of casualties certainly raises issues regarding human rights. The problems to be examined in this article are whether there was a violation of human rights in the riot at Kanjuruhan stadium and how is the recovery of victims of the riot at Kanjuruhan stadium based on human rights law. This article is a normative legal research, descriptive in nature, then using primary and secondary data. Conclusions are drawn using the deductive method. Result and concludes that there was a violation of human rights to the right to life of people who were in the stadium during security that led to the loss of hundreds of lives. Recovery of the victims of the riot at the Kanjuruhan stadium in Malang was carried out by the government through Kemenkopolhukam by providing money of IDR 50 million for each victim who died and free health services for the injured.

Abstract

Prosecutors have the legal authority to request a judicial review under Article 30C letter h of Law Number 11 of 2021, which pertains to the Prosecutor's Office of the Republic of Indonesia. The prosecutor's submission of a judicial review has the capacity to create discord and uncertainty. The author will employ normative juridical research methodology for conducting this thesis research. The data utilized in this research consists of secondary data derived from primary, secondary, or tertiary legal materials. The result research and conclusion, according to Constitutional Court Decision No. 20/PUU-XXI/2023, the authority of the Prosecutor to perform a Judicial Review has been deemed unconstitutional. The decision affirms that the convicted individual or their successors possess the right to judicial review, whereas the prosecution lacks the power to initiate such a review. Under Law No. 11/2021 on the Prosecutor's Office, prosecutors are granted the authority to carry out judicial reviews.

Abstract

Restaurant tax is a crucial component of local taxes that significantly contributes to the fiscal autonomy of regional governments. This study highlights the vital role of the Regional Revenue Agency in enhancing Local Own-Source Revenue through effective restaurant tax collection in South Tangerang City. The main legal issues examined include the extent to which the collection process aligns with South Tangerang Mayor Regulation No. 65 of 2019, and the challenges faced in its implementation. Employing a normative juridical method with descriptive-analytical analysis, the research utilizes both primary and secondary data, analyzed qualitatively. The findings show that in 2023, restaurant tax revenue exceeded the target by 26.34%, indicating compliance with the Mayor Regulation and reflecting its practical effectiveness. However, several obstacles hinder optimal tax collection, including low taxpayer compliance particularly among MSMEs uneven technological infrastructure such as tapping box installations, insufficient qualified personnel in BAPENDA, and weak coordination among government sectors. the regulation is considered a progressive legal instrument and serves as a model for other regions in developing a modern, transparent, and adaptive tax system that supports regional economic resilience and governance.

Abstract

Penelitian ini mengkaji pelanggaran netralitas Aparatur Sipil Negara (ASN) yang dilakukan oleh Saodah dan Darmawati pada masa Pemilihan Umum (Pemilu) calon anggota legislatif tahun 2024 di Kabupaten Gowa, Provinsi Sulawesi Selatan. Netralitas ASN merupakan prinsip penting dalam penyelenggaraan pemerintahan yang bersih dan profesional, di mana setiap pegawai ASN tidak berpihak dari segala bentuk pengaruh serta tidak memihak kepentingan lain di luar kepentingan bangsa dan negara. Namun, dalam praktiknya, masih terjadi pelanggaran netralitas ASN, seperti yang dilakukan oleh Saodah dan Darmawati dengan menggunakan atribut partai peserta pemilu dan terlibat aktif dalam kegiatan kampanye salah satu calon anggota legislatif.Penelitian ini bertujuan untuk menganalisis bentuk pelanggaran netralitas ASN yang dilakukan Saodah dan Darmawati berdasarkan Undang-Undang Nomor 20 Tahun 2023 tentang Aparatur Sipil Negara, serta mengkaji akibat hukum yang akan diterima oleh keduanya sesuai dengan Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil. Metode penelitian yang digunakan adalah yuridis normatif dengan menganalisis data sekunder berupa peraturan perundang-undangan dan literatur terkait. Hasil penelitian menunjukkan bahwa tindakan kedua ASN tersebut melanggar Pasal 5 huruf n PP No. 94 Tahun 2021 dan bertentangan dengan kewajiban ASN untuk menjaga netralitas. Akibat hukum yang akan diterima adalah Hukuman Disiplin Sedang berupa pemotongan tunjangan kinerja sebesar 25% selama 6, 9, atau 12 bulan sesuai rekomendasi KASN.
