Abstract

The marriage agreement is a means to protect the property of the bride and groom. Through this agreement, the parties can determine their respective assets. Marriage agreements are also for the people of Indonesia is an unusual thing even though it has been regulated in the Marriage Law. This is because, the problem of marriage can’t be separated from customs. An understanding based on traditional thinking that marriage is a bond that cannot be separated/broken except for death by the will of God Almighty. The type of research used in this paper is normative legal research. The approach used by the author is a statute approach. The data sources in this study are divided into two, namely primary law and secondary law. The method used to collect legal materials is through literature study to make a marriage agreement, the parties, in this case the husband and wife who carry out the marriage, are free to determine the desired legal form for the assets that are the object. The marriage agreement is not an obstacle in marriage but can actually help in marriage. However, in order to be useful, the making of the agreement must be in accordance with the applicable legal rules or regulations. The marriage agreement has a useful value for the parties to the marriage. Apart from being a legal protection for the parties, the marriage agreement also provides benefits in the event of a conflict in the court institution when a divorce occurs.

Abstract

Transactions require costs for each party's needs, and in some cases, significant expenses necessitate additional funding. This additional funding is often obtained through debt agreements. A debt agreement may involve collateral owned by the debtor, which is pledged to the creditor. If the debtor defaults, the collateral can be executed to recover the debt.However, Constitutional Court Decision No. 18 of 2019 amended Article 15 of Law No. 49 of 1999 on Fiduciary Security. Previously, if a debtor defaulted, the creditor had the right to execute the fiduciary collateral by selling the pledged asset. However, the ruling removed the automatic executorial power of fiduciary guarantees. As a result, creditors can no longer execute collateral directly. Instead, they must first submit an execution request to the District Court. This change ensures greater legal oversight and protection for debtors in the execution process

Abstract

This study aims to comprehensively analyze the legal responsibility of notaries and the legal consequences arising from the creation of nominee agreements in land ownership involving Foreign Nationals and Indonesian Citizens. Nominee agreements are frequently used as a legal mechanism to circumvent statutory restrictions on land ownership by foreign nationals, thereby posing a serious challenge to the fundamental principles of Indonesian agrarian law. This research employs a qualitative juridical approach using a normative-descriptive research method, supported by statutory, conceptual, and case-based approaches. Data were collected through an extensive review of legal literature, analysis of court decisions, and examination of applicable positive law, particularly the Basic Agrarian Law (UUPA) and the Notary Office Act. The findings reveal that nominee agreements constitute a form of legal evasion (fraus legis) that directly contradicts the principle of nationality and the social function of land rights as stipulated in Article 21 paragraph (1) and Article 26 paragraph (2) of the UUPA. Notaries who prepare or authenticate nominee deeds may be held legally accountable under civil, criminal, and professional ethical frameworks. The legal consequences of such agreements include their classification as null and void, with the transferred land rights being reverted to state ownership. This legal enforcement mechanism is essential to safeguard Indonesia’s legal sovereignty over land, ensure legal certainty, and uphold the integrity and professionalism of notaries within the national legal system.

Abstract

Setiap manusia pasti berkeinginan untuk melakukan perkawinan, dan agar terhindar dari masalah dalam konteks perkawinan modern, perjanjian perkawinan semakin populer sebagai alat untuk mengatur aspek finansial hubungan. Hakikat hukum perkawinan adalah mengikuti perintah Allah dan Rasul untuk menciptakan kehidupan rumah tangga yang mendatangkan kesejahteraan bagi semua yang terlibat, untuk keluarga sakinah, mawaddah wa rahmah adalah tujuan pernikahan muslim. Tujuan lain untuk menenangkan jiwa, memenuhi kebutuhan biologis dan memikul tanggung jawab. Perkawinan dalam Islam merupakan salah satu cara menghindari dosa dan dianjurkan dalam Al-Quran. Secara umum perjanjian perkawinan berisi tentang pengaturan harta kekayaan calon suami istri. Sedangkan tujuannya untuk mengatur akibat-akibat perkawinan yang menyangkut harta kekayaan. Dokumen ini memungkinkan pasangan untuk perlindungan hak para pihak bagaimana harta mereka akan dikelola, dibagi, atau dilindungi selama dan setelah pernikahan. Meskipun sering dianggap tabu, perjanjian perkawinan memiliki sejumlah manfaat, seperti memberikan kepastian hukum, melindungi aset,dan mencegah konflik dimasa depan. Perjanjian perkawinan dapat berfungsi sebagai tindakan prefentif “pengaman” dengan memberikan kerangka hukum yang jelas mengenai pembagian harta, hak asuh anak, dan tanggungjawab financial jika terjadi perpisahan. Perlindungan hukum bagi kedua belah pihak sangat penting justru dapat memperkuat ikatan pasangan, dan dapat meminimalkan potensi konflik hukum di masa depan dan dapat membantu pasangan membangun komunikasi yang lebih baik dan fondasi pernikahan yang lebih kuat. Perjanjian perkawinan hadir sebagai solusi yang memungkinkan pasangan untuk mengantisipasi berbagai kemungkinan yang mungkin terjadi di masa depan. Dengan adanya perjanjian perkawinan, pasangan dapat lebih tenang dalam menjalani kehidupan berumah tangga, karena telah memiliki kesepakatan tertulis yang jelas. Penelitian ini bertujuan untuk menganalisis pentingnya perjanjian perkawinan dalam konteks perkawinan modern, serta mengidentifikasi poin-poin penting yang perlu diperhatikan dalam menyusun perjanjian tersebut.

Abstract

The expression of traditional cultural expressions as intellectual property is the result of the community's collective creativity and intellectuality and must receive effective legal protection. In practice, there is often a phenomenon of filtering claims between countries regarding the existence of a particular cultural expression. This research is normative legal research that emphasizes philosophical, conceptual, and legislative approaches. The research findings confirm that the state plays a role in promoting respect for and recognition of traditional cultural expressions as intellectual property, serving as a collective human identity through policy, education, and public awareness programs. From a legal philosophical perspective, the recognition of traditional cultural expressions faces dilemmas and conflicts, primarily due to the communal nature and cross-border existence of such cultures. Therefore, an update to international regulations is needed, particularly the Convention on the Safeguarding of the Intangible Cultural Heritage (CSICH), which must affirm the communal nature of such intellectual property and regulate fair and pluralistic mechanisms for resolving disputes between countries. The main recommendation is to revise the CSICH to accommodate communal characteristics and clarify mechanisms for resolving disputes over cultural recognition between countries.
