Abstract

Tulisan ini bertujuan untuk mengetahui konsep kewarganegaraan non muslim dalam fiqih siyasah dan negara bangsa serta pengakuan-pengakuan terhadap hak-hak mereka. Tulisan ini merupakan studi kepustakaan dengan mengkaji berbagai literatur dan sumber bacaan baik buku maupun artikel mengenai konsep negara bangsa (nation state), prinsip equality before the law dan konsep fiqih siyasah tentang non muslim. Hasil penelitian ini menunjukkan bahwa konsep non muslim dalam fiqih siyasah yang membedakan warganegara non muslim dengan istilah dzimmi perlu pembacaan ulang. Konsep dzimmi didalam fiqih siyasah sudah tidak relevan diterapkan di rezim negara bangsa dewasa ini.

Abstract

Marriage renewal is a belief carried out by the Madurese people as a way to strengthen household relationships from all unwanted things such as divorce. So the implementation of the Marriage Renewal that takes place in Parit Lalang Village, Pangkalpinang City has different views regarding its implementation for the surrounding community and not all of the Madurese people carry out the Marriage Renewal in Parit Lalang Village, only some of the Madurese people still have this belief. So this phenomenon encourages researchers to conduct research to look for the factors behind the Marriage Renewal process and will review Maslahah's implementation process.This research is qualitative research using a field approach (Field Research). The source of this research is primary data obtained from observations and interviews with couples who have carried out marriage renewal as well as religious figures who usually accompany the marriage renewal process to find out the reasons and consequences that occur after the marriage renewal process takes place. And equipped with secondary data as support.Based on the research results, the implementation of Marriage Renewal occurred because of household problems, namely the economy was not running smoothly, resulting in frequent arguments, loss of feelings of love and affection towards the partner, carried out as a form of commemorating the wedding day and so on. Then, regarding the marriage renewal process, there are couples who carry out marriage renewal more than once. So this is contrary to Islamic law, because the implementation that occurs in the field of the process is carried out in accordance with the pillars and conditions of marriage in general and in this process also provides a new dowry to the wife. So the law of marriage renewal which uses a new dowry in the marriage contract is the same as the husband admitting that the divorce will occur between them. If it is related to the Ushul Fiqh method, Maslahah is included in the Maslahah Mulgoh group, because it is contrary to the text, even though this action creates benefits for their household relations.

Abstract

This study aims to analyze the contestation, patterns, and forms of social movements among Gen Z Muslims in the era of digital citizenship. In this era, social movements are shaped by issue-based networks, and the key actors driving this transformation are Gen Z activists—particularly Muslim university students affiliated with Islamic student organizations. This article focuses on two main objectives: (1) to analyze the social contestation of Gen Z Muslim movements in the digital citizenship era and (2) to examine the patterns and forms of these movements in relation to their religious identity. This study employs a qualitative research method, with research subjects drawn from Islamic student organizations in Bandung and Pangkalpinang. Data collection techniques include: first, interviews, which were conducted to explore participants' perspectives on the ideology and activities of their movements; second, participatory observation, used to understand internal dynamics, patterns of interaction, and activism practices among Gen Z Muslims; and third, social media observation, utilized to analyze datasets from online platforms. The findings reveal two main categories of Gen Z Muslim social movements in the digital citizenship era: moderate and non-moderate. Moderate movements primarily focus their digital activism on issues of religious tolerance, inclusivity, interfaith dialogue, social justice, gender equality, and minority rights. In contrast, non-moderate movements center their activism on exclusive and conservative religious discourse, often using hashtags such as #Khilafah and #Hijrah as part of their outreach. These movements also tend to idolize figures advocating for religious purification and hijrah (religious migration). Furthermore, the patterns and forms of Gen Z Muslim social movements in the digital citizenship era are characterized by two key practices: volunteerism and crowdfunding, both of which serve as mechanisms for social engagement and mobilization.

Abstract

Penelitian ini bertujuan memperoleh hasil analisis pustaka mengenai piagam Madinah sebagai strategi politik dakwah Nabi Muhammad pada periode Madinah dengan menggunakan metode literature review. Hasil penelitian ini menunjukkan bahwa Piagam Madinah memenuhi tiga pengertian yaitu treaty, sahifat dan constitution. dokumen itu merupakan kesepakatan beberapa golongan; Muhajirin, Anshar, Yahudi dan sekutunya bersama Nabi. Dilihat dari pengertian constitution, la juga memuat prinsip-prinsip pemerintahan yang bersifat fundamental, artinya kandungan sahifat itu dapat mencakup pengertian ketiga istilah tersebut. Sebab ia adalah dokumen perjanjian persahabatan antara Muhajirin, Anshar, Yahudi dan sekutunya bersama Nabi yang menjamin hak-hak mereka menetapkan kewajiban-kewajiban dan memuat prinsip-prinsip pemerintahan yang mengikat untuk mengatur pemerintahan di bawah pimpinan Nabi Muhammad saw. Dengan Piagam madinah masyarakat dapat hidup berdampingan untuk memperjuangkan kepentingan bersama melalui semangat persatuian yang dilandasi dengan kebersamaan dan cinta kasih.
