Abstract

Para ulama berbeda pendapat tentang pengertian nikah siri berikut hukumnya. Sebagian kalangan menganggap nikah siri tidak melanggar hukum, sedangkan sebagian lainnya memandangnya melanggar hukum atau setidaknya sebagai pemicu ketidaktertiban dalam masyarakat sehingga perlu dilarang. Tulisan ini mengurai aneka ragam nikah siri berikut pandangan-pandangan tersebut. Kemudian, dengan menggunakan metode qiyās, sadd al-źarī`ah, dan maşlaĥah, serta memperhatikan tujuan-tujuan nikah, penulis berkesimpulan bahwa tujuan-tujuan pernikahan sebagaimana digambarkan oleh al-Qur’an seperti saling melindungi tidak akan dicapai dengan nikah siri. Di samping itu, peraturan perundang-undangan yang berlaku mengenai saksi, wali, dan pencatatan pernikahan harus dipatuhi umat Islam Indonesia, karena telah menjadi qānūn yang mengikat sehingga tidak ada ruang lagi untuk mengikuti pendapat yang berbeda dengan peraturan hukum tersebut. Hal ini berdasarkan kaidah h}ukm al-qadi ilzam wa yarfa’ al-khilaf (keputusan hakim adalah memaksa/mengikat dan meniadakan perbedaan). Dengan demikian, saya menyimpulkan bahwa nikah siri harus dilarang karena jelas melanggar hukum dan memicu ketidaktertiban dalam masyarakat.

Abstract

Terdapat kontroversi tentang kesaksian perempuan dalam hal nilai kesaksian, cakupan kesaksian, dan hukum mempersaksikannya. Sementara, disimpulkan bahwa jika teks diinterpretasikan secara tekstual, maka nilai kesaksian perempuan adalah separuh kesaksian laki-laki, dan hal ini hanya mencakup hal-hal yang berkaitan dengan harta benda. Adapun hukum mempersaksikannya hanya sebagai anjuran. Akan tetapi, jika teks diinterpretasikan secara kontekstual, maka nilai kesaksian perempuan sama dengan kesaksian laki-laki. Dalam tulisan ini saya berargumen bahwa kesaksian perempuan menurut al-Qur’an sama dengan kesaksian laki-laki, baik ditafsirkan secara tekstual maupun secara kontekstual,baik dalam hal yang berkaitan dengan harta benda maupun yang berhubungan dengan masalah ĥudūd. Adapun mengenai hukum mempersaksikannya, secara umum dalam al-Qur’an digunakan kata berbentuk ‘amr sehingga dapat dipahami sebagai perintah.There are some controversies concerning woman witnesses in terms of their testimony, the scope of the subjects, and the legal status of testimony.  It is tentatively concluded that if texts are normatively interpreted textually, then, the testimony of a woman is valued only one half of that of a man, and this is only for the matters concerning with goods, while the law on the subjects of these matters is only recommendation.  However, if normative texts are interpreted contextually, then, the testimony of a woman has an equal value with that of a man.  In this study, I argue that the testimony of a woman according to the texts of Holly Qur’an equals to the testimony of a man, no matter the texts are interpreted textually or contextually in both subjects concerning with goods and with hudūd.  Regarding the legal status of testimony, in the Qur’anic texts generally the word amr is used, so this can be considered as compulsary.

Abstract

Terdapat kontroversi di kalangan para ulama tentang keluarga berencana (KB) dalam Islam. Sebagian menyatakan bahwa keluarga berencana itu boleh, tetapi sebagian memandangnya tidak sesuai dengan ajaran Islam. Di samping itu, ia dicurigai sebagai agenda tersembunyi asing (non muslim). Selain itu, KB dicurigai karena berasal dari negara asing yang (mayoritas non - Muslim ) dengan agenda yang tersembunyi untuk melemahkan umat Islam. Jadi, apa substansi keluarga berencana? Apakah metode dalam melakukannya? Apa tujuan melakukannya? Lalu, bagaimana jika hal ini dikaitkan dengan ekonomi dan ekosistem? Siapa yang berhak untuk menentukan pelaksanaan keluarga berencana? Apa keluarga berencana dalam hukum Islam? Tulisan ini akan membahas hal-hal tersebut dengan menggunakan metode deskriptif dan analisis terhadap argumen yang diajukan oleh kedua kalangan baik yang menerima maupun yang menolak. Penulis berpendapat bahwa dalam kondisi yag sangat tidak seimbangan antara pertumbuhan populasi manusia dan ekosistem, keluarga berencana tidak hanya diperbolehkan tetapi dapat diwajibkan oleh Pemerintah sebagai wakil dari masyarakat.

Abstract

The basic concept of Shihab’s Islamic family, if viewed from gender perspective is gender responsive on several aspects, but on other aspects looks gender biases. This phenomenon also revealed on Shihab's concept about manwomen relation inside family. On several aspect, Shihab trying to look equal by frequently using phrase “equal” when discussion man-wife relation. Meanwhile, when confronting differences in reality, Shihab looks bias, because every difference always covered with different function, therefore he can't refuse role differences between man and wife.

Abstract

This paper examined the interpretation of ngaji (reading al-Qur’an) in the traditions of Banyumas people. This research was conducted by a survey method through interactive interviews with several persons who read the Qur’an in Banyumas. The data were then analyzed by using the typology of worshipers. The results showed that reading the Qur’an has different interpretations depending on the community views of how to read and the purpose of reading it. Reading the Qur’an in the Banyumas community is unique depending on the community traditions and social events and the interaction patterns of their daily life. Furthermore, read- ing the-Qur’an is believed to be able to calm their soul, to become a medicine, to protect from the disturbances of other creatures, and to become a part of the rites of life (from birth to death). They obtained these beliefs from scholars, clerics, teachers, and from their social communication as well as from their own spiritual and empirical experiences. We concluded that reading the Qur’an for the Banyumas people tended to be “hoping for God’s grace” directly, in other words, they were being in the tujjar (merchant) type worshipers.

Abstract

Charity  (ṣadaqa) is commonly given for religious reasons: Muslims donate voluntarily to earn Allah’s pleasure and receive His blessings. However, there have been changes in the way Muslims perceive charity and what significance it has in their life. Many studies have addressed this issue but failed to explore the connection between ṣadaqaand mental state. This paper was aimed to complement the existing studies by analyzing the process of the shifting interpretation of charity and its positive effects on the donors. This study used qualitative analysis of primary and secondary data. The data was processed through descriptive methods and content analysis. In particular, it focused on analyzing the religious background of the donors, including the biological processes underlying their tendency to give generously. The study concluded that the practice of giving ṣadaqa increases social, emotional, and spiritual wellbeing, depending on the level of spirituality of the donors and their intention.

Abstract

This study aims to explore the urgency of history as a science in an effort to re-awaken the Indonesian nation identity to the young generation in Era Society 5.0. The method used in this study is use qualitative research method by collecting data from reading written sources such as journals articles, books and other written sources to be analyzed objectively based on the data obtained from these written sources. The results and discussion of this study indicate that the young generation should know the importance of the struggle of the nation's heroes in achieving Indonesian independence and need historical learning as a provision to face the Era of Society 5.0. Through this research, it can be concluded that the provision of history as a science is an alternative step taken in an effort to raise awareness of history as the national identity of the Indonesian nation to the young generation in the Era of Society 5.0. This study recommends historians, educators or history teachers, the government and Indonesian society as a whole in an effort to raise awareness of the importance of studying history, especially Indonesian history which still needs to be explored further in order to reconstruct history properly.
