Abstract

The development of digital technology has encouraged the use of big data in various sectors, such as government, banking, health and electronic commerce. This large-scale data processing provides strategic benefits for economic development and public services, but also poses risks to privacy rights and personal data protection. This research aims to analyze legal protection for big data in the perspective of Law Number 27 of 2022 concerning Personal Data Protection (UU PDP). The research method used is normative legal research with a statutory approach and a conceptual approach. The research results show that the PDP Law regulates the principles of personal data processing, data subject rights, obligations of data controllers and processors, as well as administrative and criminal sanctions mechanisms. However, implementation challenges still arise, especially related to surveillance, cyber security, and the complexity of big data technology based on algorithms and artificial intelligence. Therefore, it is necessary to strengthen institutions, harmonize regulations, and increase literacy and data security to ensure the effectiveness of legal protection in the era of digital transformation

Abstract

The rapid growth of Financial Technology (Fintech) has transformed the delivery of digital financial services by providing greater accessibility, efficiency, and convenience for consumers. However, this advancement has also increased the risk of personal data breaches, unauthorized data processing, and cyber threats that may undermine consumer trust. The enactment of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) represents a significant milestone in strengthening Indonesia's legal framework for safeguarding personal data and enhancing consumer protection in the digital financial ecosystem. This study aims to analyze the effectiveness of the implementation of the PDP Law in protecting consumers using fintech platforms and to identify the challenges encountered in its enforcement. This research employs a normative legal research method using statutory and conceptual approaches. The data were collected through a comprehensive literature review of laws and regulations, academic publications, scientific journals, and official documents related to personal data protection and fintech regulation. The findings indicate that the implementation of the PDP Law has improved legal certainty by clearly defining the rights of data subjects, the obligations of personal data controllers, and legal accountability mechanisms in cases of personal data breaches. Nevertheless, its effectiveness remains constrained by several factors, including the limited compliance of some fintech providers, inadequate regulatory supervision, insufficient public awareness of personal data rights, and difficulties in enforcing legal sanctions against cross-border violations. Therefore, stronger inter-agency coordination, enhanced regulatory oversight, stricter administrative and criminal sanctions, and continuous public education are essential to ensure effective implementation of the PDP Law. This study is expected to contribute to the development of legal policies on personal data protection and support the establishment of a secure, trustworthy, and consumer-oriented fintech ecosystem in Indonesia.

Abstract

Politik dan hukum adalah dua hal yang mempengaruhi satu sama lain. Dalam proses pembentukan aturan hukum oleh lembaga-lembaga politik, peran kekuatan politik yang duduk di lembaga-lembaga politik sangat menentukan. Ketika posisi hukum lebih menentukan dari politik, maka kegiatan politik diatur oleh dan harus sesuai dengan aturan hukum. Di sisi lain, ketika politik lebih menentukan dari hukum, maka hukum adalah produk dari kehendak politik yang saling berinteraksi dan bahkan bersaing satu sama lain. Namun, sistem yang ideal adalah sistem ketika hukum dan politik berada di keseimbangan. Dalam kondisi seperti itu, keteraturan mungkin bisa dicapai. Terkait dengan konseps hukum tersebut, maka politik hukum diartikan sebagai aktivitas yang menentukan pola dan cara membentuk hukum, mengawasi bekerjanya hukum, dan memperbarui hukum untuk tujuan Negara. Sehingga hukum dipengaruhi oleh politik dan bahkan hingga saat ini seringkali otonomi hukum di Indonesia di intervensi oleh politik, bukan hanya dalam hal pembuatannya, tetapi juga dalam penerapannya baik dalam hal penegakan hukum sekalipun.
