Abstract

The Corona Virus Disease 2019 pandemic was first discovered in the city of Wuhan, China at the end of December 2019. This virus spreads very quickly and has spread to almost all countries, including Indonesia. As a result of the spread of the Corona virus, it has a negative impact on several sectors such as the economic sector, business, tourism, industry, health and so on. The tourism sector has been hit hard by the Covid-19 pandemic. Until now, almost all tourist destinations in Indonesia are closed. This is a very difficult condition, in Indonesia almost all tourist destinations, hotels, facilities, and entertainment are closed and are only allowed for 50% of visitors based on Government recommendations. The Karo Regency Government is also facing the same problem, one of the sectors that is relied upon to support Karo Regency's Original Regional Revenue (PAD) is from the tourism sector, and Brasatagi Subdistrict is one of the sub-districts that is the mainstay of the tourism sector in Karo Regency. Speaking of the tourism sector, the industry that is most closely related is Hotels and Restaurants. Throughout 2020 until mid-2021, the hotel occupancy rate in the Brastagi District fell by almost 90%. The very significant decline in the level of tourist visits, hotel occupancy and restaurant visitors in Brastagi District has caused entrepreneurs of tourist sites, hotels and restaurants to suffer huge losses. Employers are no longer able to cover all operational costs, including the cost of wages for workers. This forces employers to rearrange their working hours and calculate the number of workers that they still allow them to employ. Some of this is done by applying alternate vacations or leave to their employees, some of them who are no longer able to survive, are forced to lay off temporarily, cut wages. or terminate the employment of its employees. The findings in this study are that employers are still required to pay wages in full in the form of basic wages and fixed allowances as long as workers are laid off during the COVID-19 pandemic and are required to provide severance pay for workers who have been laid off in accordance with Article 156 of Law No. 2003 concerning Manpower and the Ninth Part, Article 37 concerning Payment of Wages in a State of Bankruptcy in the Government Regulation concerning Wages no. 78 of 2015.

Abstract

The working relationship between employers and workers/labourers is civil/private in nature because it was born after the existence of a work agreement. The existence of jobs, orders and wages as elements of work relations is left to the parties. The work agreement as the basis of the employment relationship is an autonomous rule for employers and workers/laborers in exercising their rights and obligations. However, work agreements do not fully contain private elements. The position of the worker/laborer and the entrepreneur is not balanced, for example in terms of "work" and "orders" the worker/laborer is in a weak position because the employer has previously determined it according to the type of work agreed upon. Likewise the issue of "wages", even though the entrepreneur has set the amount, it may not conflict with the provisions of labor regulations. Labor is very crucial because it is one of the main pillars in carrying out national development. Therefore, a heteronomous rule is needed as a safeguard in supervising the working relationship between the parties. This raises the public aspect in the field of employment. This research will discuss the authority of the government in employment relations. The research method uses normative juridical with a focus on laws and regulations. The presence of the government is principally in order to monitor and balance the relationship between the two parties through labor law instruments that apply as heteronomous rules. Abstract

Masalah mendasar penataan aset dan akses tanah di Indonesia adalah lemahnya pengakuan dan perlindungan hukum terkait keberadaan masyarakat dalam pemanfaatan tanah antar berbagai sektor pembangunan akibat pertambahan penduduk dan penurunan kualitas yang menyebabkan kemiskinan, keterbatasan kesempatan kerja dan akses pendapatan yang tidak merata. pemanfaatan tanah. Cita-cita hukum dalam mewujudkan tujuan negara hukum agraria diwujudkan dalam bentuk kebijakan Reforma Agraria yang merupakan salah satu cita-cita dalam pemerintahan Presiden Joko Widodo. Rumusan masalah yang akan menjadi pokok pembahasan adalah Bagaimana mekanisme pelaksanaan reforma agraria di Kabupaten Langkat, Bagaimana bentuk pengelolaan aset tanah melalui Program Pembaruan Agraria di Kabupaten Langkat, Bagaimana program penataan akses dalam rangka peningkatan kesejahteraan berbasis tata guna lahan. Metode penelitian ini menggunakan metode kualitatif untuk menggambarkan reforma agraria melalui retribusi tanah secara komprehensif dari segi administrasi pertanahan.

Abstract

In the business world capital turnover is an indication for it's a good effort. Based on this often entrepreneurs need capital in a short period of time in order to ensure the liquidity of its business, so no longer wait for a fall due on receivables to be collected later the payment. The method generally used to obtain fresh funds in the near future on outstanding receivables is by way of selling its receivables to others who are willing to buy it, generally at a price lower than the value of the bill to be paid by the debtor at maturity. Regarding the high and low prices as well depending on the illiquid receivables and whether there is a guarantee that accompanies the debt. Abstract

Posisi ini akan membantu Kelompok Tani Rawa dengan solusi pelaporan keuangan yang dapat diberikan oleh peneliti. Peneliti mengunjungi Desa Rawa di Geban pada saat layanan ini diluncurkan, dan kelompok tani Rawa menjelaskan kelebihan dan kekurangan UMKM. Mereka menjelaskan kekurangan mereka selama kunjungan tersebut. Ada banyak desa di Rawa yang mendapat subsidi pemerintah. Mereka mempunyai masalah karena tidak mengetahui cara membuat laporan keuangan. Pertanyaan ini membantu peneliti mengurangi kesulitan dalam menulis laporan keuangan. Kekurangan dari kelompok petani UMKM ini adalah mereka hanya berstatus pelajar SMA sehingga belum mengetahui cara membuat laporan keuangan yang baik. Peneliti memberikan kelas akuntansi dan pembukuan untuk membantu petani memahami laporan keuangan. Ini akan dimuat di surat kabar setelah memahami perhitungan terbaru. Abstract

Hak Cipta sebagai benda bergerak yang tidak berwujud memiliki aspek Hak Ekonomi dan Hak Moral yang dapat dialihkan melalui pewarisan. Namun Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta tidak menjelaskan dan mengatur secara rinci tata cara pengalihan Hak Cipta melalui pewarisan. Adapun pengalihan Hak Cipta termasuk Hak Cipta atas Karya Buku harus diajukan dengan permohonan pendaftaran pada Direktorat Jenderal Kekayaan Intelektual (Dirjen KI) dan diumumkan dalam Berita Resmi pada Dirjen KI. Permasalahannya adalah bagaimana pengaturan hukum tentang Hak Cipta atas karya Buku dan bagaimana kajian yuridis tentang pengalihan Hak Cipta atas karya Buku ditinjau menurut Hukum Waris Perdata di Indonesia. Sedangkan tujuan penelitian adalah untuk mengetahui pengaturan hukum tentang Hak Cipta atas karya Buku dan untuk mengetahui kajian yuridis tentang pengalihan Hak Cipta atas karya Buku ditinjau menurut Hukum Waris Perdata di Indonesia. Penulisan artikel ini menggunakan jenis Penelitian Hukum Normatif dengan metode pengumpulan data Penelitian Kepustakaan dan jenis data dari Data Sekunder, yang berasal dari dokumen resmi, buku, jurnal ilmiah, internet dan peraturan perundang-undangan. Pengalihan Hak Cipta melalui pewarisan dapat dilakukan setelah Pencipta atau Pemegang Hak Cipta meninggal dunia dan warisan secara otomatis diberikan kepada Ahli Waris. Sistem Hukum Waris yang digunakan dalam pengalihan Hak Cipta adalah melalui Hukum Waris Perdata. Pengalihan Hak Cipta atas karya Buku ditinjau dari sudut Hukum Waris Perdata di Indonesia dapat dilakukan berdasarkan Surat Wasiat, Perjanjian Tertulis dan ditetapkan berdasarkan Golongan Ahli Waris. Kesimpulannya diundangkannya Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang mengatur tentang Ciptaan atas karya Buku dan peralihan Hak Cipta dapat dilakukan dengan cara Surat Wasiat, Perjanjian Tertulis dan berdasarkan Golongan Ahli Waris yang diatur dalam KUH Perdata dan Buku dapat dijadikan warisan dalam bentuk lisensi atau royalti yang diatur dalam UUHC. Diharapkan pemerintah memberikan penyuluhan kepada masyarakat mengenai Hak Cipta khususnya karya Buku dan Pencipta Buku dapat mengalihkan ciptaannya dengan mengajukan Permohonan Pendaftaran pada Direktorat Jenderal Kekayaan Intelektual (Dirjen KI) di Jakarta atau melalui Kantor Wilayah Kementerian Hukum dan HAM di daerah.

Abstract

A fiduciary guarantee certificate or deed is required for the execution or withdrawal of cars, according to Law Number 42 of 1999 respecting Fiduciary Guarantees. The question that this essay seeks to answer is: How are fiduciary guarantees governed in Indonesia? What factors lead to creditors forcibly retaking motorcycles? Regarding PT. Adira Dinamika Multifinance Branch 0601 Medan Graha Niaga's Law No. 42 of 1999 concerning Fiduciary Guarantees, how well-protected are debtors against attempts to forcibly withdraw motorized vehicles? This study employs a descriptive interviewing method in conjunction with an empirical research design. Primary, secondary, and tertiary legal sources are used as secondary data in qualitative research, and the research site is the PT office. Branch 0601 of Adira Dinamika Multifinance, Medan Graha Niaga The Fiduciary Guarantee Law, the Housing and Settlement Law, and the Copyright Law all regulate fiduciary guarantees in Indonesia. Aspects of Debtor Default, The creditor may withdraw the object of fiduciary collateral in order to transfer fiduciary objects and prevent them from being freely surrendered. The inference drawn is that fiduciary promises must underpin all commercial agreements in order to provide debtors with fair and transparent legal certainty. The government and police have been advised to keep offering debtors legal protection when it comes to carrying out fiduciary guarantees.

Abstract

Intellectual Property Rights (IPR) are rights to property that arise and are born from human intellectual abilities. Whereas Communal Intellectual Property (KIK) is the result of copyrights, works, and cultural traditions that have been passed down from generation to generation by a group of people. Communal Intellectual Property includes Traditional Knowledge (PT), Traditional Cultural Expressions (EBT), Genetic Resources (SDGs), and Geographical Indications (GI). The purpose of this study is to study of Intellectual Property Rights in Indonesia and to determine the role of the Regional Government in protecting and guaranteeing the Communal Intellectual Property of the Batak Toba ethnicity. This type of thesis research uses normative legal research with a qualitative approach method, the research method used, namely Library Research, with data collection techniques using Secondary Data which is divided into Primary Legal Materials, Secondary Legal Materials and Tertiary Legal Materials. The efforts to know about the Batak Toba KIK are based on a statutory regulation, namely Law Number 28 of 2014 concerning Copyright and the efforts of the Regional Government to protect and develop the Batak Toba KIK by registering it with the Directorate General of Intellectual Property (DJKI). Suggestions from researchers are that Batak Toba KIK can be protected by establishing separate KIK laws and regulations, forming a KIK handling group in the midst of society and changing the concept of Batak Toba people's thinking about preserving and protecting Batak Toba ethnic KIK
