Abstract

Usūl fiqh as a methodology of islamic law is rooted from al-Qur’an and Sunnah. But text of al-Qur’an and Sunnah is a little bit give speaking of methodology, even only give an indication from which syariah law can be deducted in order to order islamic teaching in the sphere of economic problem, such methodology need to elaborated. But al-Qur’an, Sunnah and Ijtihad, remained to priority guidence in the development of islamic economic methodologies. Even, maxims of usūl fiqh such as qiyās, istihsān and maslahah when did so fourth can be used to develop the methodology of islamic economic. Abstract

Economic development of a country cannot be separated from the capital market. Capital market serves as a means to mobilize public funds and to search the ownership of shares of a company by selling it. Islamic capital market serves as an investment medium for Muslims in the capital market that is in line with Islamic principles. Some criteria for the establishment of the Islamic capital market are forming price fairly, the presence of perfect information, free from riba, gharar, gambling and other transactions that contradict against sharia rules. Stocks traded in the Islamic capital market should come from issuers that meet the Islamic criteria and bonds issued should use mudarabah, musharaka, ijara, istisna' and salam.

Abstract

Stock transactions in the capital market were considered as speculative activities so they are prohibited by Islam and not in accordance with the Shari'a because they lead to gambling. This study aims to provide an explanation to potential investors about stock investment law from the perspective of sharia economic law. This research method use a literature study that was used to examine the legal basis of Islamic economics regarding stock investment. The results of the study show that the stock transaction is a muusahamah contract (trade union or partnership). Then buying and selling shares on the Indonesia Stock Exchange is allowed because shares are proof of ownership of a company in the form of assets, the fiqh experts who allow it are Abu Zahrah, Abdurrahman Hasan and Abdul Wahab Khalaf.

Abstract

This article examines the way and urgency of making fatwas of National Sharia Board of the Indonesian Ulama Council (DSN-MUI) on Islamic banking into a positive law in Indonesia. The background of this article is the fact that the only basis on the implementation of compliance with sharia principles in the operations of Islamic banking in Indonesia is a fatwa of DSN-MUI about Islamic banking. However, the fatwa position in the Indonesian legal system does not have a binding force for citizens included in the business activities of Islamic banking. This is because Indonesia is not an Islamic state, which makes the fatwa as a legal basis. Thus, making the fatwas of DSN-MUI about Islamic banking into a positive law is very urgent for the development of Islamic banking operations in Indonesia in order to have a strong legal foundation. The making of fatwa of DSN-MUI into a positive law is conducted by Central Bank of Indonesia (Bank Indonesia). Members of Islamic Banking Committee at Bank Indonesia along with the DSN-' MUI compose a draft of a regulation based on the fatwa and then it is submitted to the Governor of Bank Indonesia to be enacted as some of Bank Indonesia's regulations, for example Bank Indonesia's Regulation, Bank Indonesia's Circular Letter, or the Compilation of Sharia Banking Products and Services.

Abstract

Abstract: The results of this study indicate that: (1) DPS DPS at BMT-BMT in Purwokerto yet fully run seven role in BMT. They've run four roles that include directing, reviewing, supporting and playing. Three other role includes supervising, marketing, and mediating has not been implemented by the DPS of BMT-BMT in Purwokerto, (2) BMT-BMT in Purwokerto yet fully apply the shariah compliance. Of the six elements contained in the shariah compliance, BMT-BMT only applicate two elements, namely the conduct of halal profit business activities and trustful in paying and managing zakat and sadagah donation. Four other elements that have not been applied, that is, free of usury, gharar, gambling and trustworthy in operation; and (3) Constraints faced by DPS in their role as a watchdog of shariah compliance in BMT-BMT in Purwokerto are: (a) DPS's lacking knowledge about banking operations; and (b) DPS tend to occupied by their original jot. Abstract

Dewan Pengawas Syariah (DPS) di Lembaga Keuangan Islam merupakan pihak yang bertanggung jawab dalam pengawasan prinsip-prinsip syariah. Oleh karenanya, anggota dewan dituntut untuk menguasai ilmu fiqh muamalah, keuangan dan ekonomi. Tapi dalam prakteknya, sangat sulit mendapatkan orang-orang yang benar-benar menguasai dua bidang ilmiah tersebut. Untuk mengatasi masalah ini, maka anggota DPS harus mendapatkan pendidikan khusus untuk mendukung profesi, profesional dan bekerja penuh waktu (full-time), memiliki dan menjadi anggota asosiasi profesional, memiliki komitmen untuk meningkatkan pengetahuan dan keterampilan yang berkualitas, serta berani menegur Lembaga Keuangan Islam manajer yang menyimpang dari ketentuan syariah.

Abstract

Research on philanthropy for financing educational institutions aims to find out about how the philanthropy of financing is carried out at PAUD Wadas Kelir Purwokerto. This research is included in qualitative descriptive research with a case study method. Data collection techniques were obtained through observation (researchers went directly to the PAUD Wadas Kelir institution), interviews (to principals and parents) and documentation (learning activities, activity programs, school financing sources). The results of this study show that the philanthropy of financing educational institutions in PAUD Wadas Kelir carried out by the community also supports learning activities so that the PAUD Wadas Kelir institutions have survived until now.  The existence of this institutional financing philanthropy is very helpful in improving the quality of learning, completing school facilities, and improving the quality of early childhood education.

Abstract

IMCV (Indonesian Muslim Community in Victoria) was founded in 1997. Its existence and activities have been widely published in print and online media. However, these publications have yet to present IMCV as an organization that synergizes in counteracting radical Islamic ideology. The existence of IMCV is very strategic because its members are comprehensive and supported by several militant organizations, namely the young Indonesian generation in Australia, such as YIMSA (Young Islamic Muslim Students Association). This article found evidence of the synergy of IMCV as an Islamic organization of Indonesians in the state of Victoria will describe the synergy of IMCV in winning over Islamic radical ideas.

Abstract

Saving has a very important role for the future because saving is one way to manage finances. Saving means setting aside the money we have to save. Saving is also part of financial planning to deal with future needs. This study aims to measure the effect of education level and income on the interest in saving in the people of Pondoknangka Barat Hamlet, Beluk Village, Belik District, Pemalang Regency. Sampling using accidental sampling with a total of 100 respondents. The data obtained was then processed using the SPSS program using multiple linear regression analysis techniques. The results of the study show that there is a significant influence between education level and income simultaneously on the intention to save.
