Abstract

The quality of law enforcement is determined by the character-building in the Faculty of Law. If so far, Indonesia is often faced with various poor quality law enforcement, and this portrait certainly does not occur naturally, but rather because the law faculty has not been able to play its role optimally in building the character of prospective law enforcers. This study explores Satjipto Rahardjo's thoughts on character-building for law enforcers at the faculty of law. The research method used in this article is a literature study with a qualitative descriptive approach using content analysis. The result of this study indicates that according to Satjipto Rahardjo, legal education at the Faculty of Law must be reoriented from the formation of a positivistic character to the formation of a progressive character of law that prioritizes ethical and moral values

Abstract

After several years of suspension, agrarian reform was re-implemented as a way to achieve agrarian justice. This policy was stipulated in the Presidential Regulation Number 86 of 2018 concerning the Implementation of Agrarian Reform which is framed in the Agrarian Reform and Social Forestry (RAPS). However, many groups, mainly the Nahdlatul Ulama (NU) with their strong activism in the agrarian struggle, deeply criticized this policy. This research will examine how NU activists deconstruct the concept of agrarian reform in the RAPS policy using the priority fiqh theory. Fiqh of priorities was initiated to consider the implementation of charity acts or policies deserving the priority of concern based on Shariah principles. This study applied empirical and normative legal research by interviewing NU activists, who paid a specific concern in the agrarian sector, and by conducting a literature review of the results of NU’s ijtihad regarding agrarian reform. The result of this study indicates that agrarian reform in the RAPS policy has not fulfilled the priority fiqh principles. This article contributes to the accuracy of the concept and implementation of agrarian reform in Indonesia which is more just in accordance with the scale of priorities needed to achieve the goals of agrarian reform.

Abstract

Simojayan Village in Malang Regency has long experienced unresolved agrarian conflicts. Addressing these issues requires not only innovative legal strategies but also increased public legal awareness. In response, a legal outreach program was conducted, involving expert presentations and interactive dialogue, and attended by over 70 participants. The program successfully enhanced the community’s understanding of agrarian law, particularly regarding the legal status of former HGU lands and the opportunities presented by agrarian reform. A notable outcome of the outreach was the community’s initiative to form a citizen forum for agrarian advocacy and their commitment to collaborate with legal organizations, including the Forum of Law Students for Justice (FORMAH PK). Follow-up plans include legal counseling, participatory land mapping, and paralegal training. These results indicate that legal education can serve as an effective entry point for community empowerment and equitable conflict resolution.

Abstract

This study aims to analyze the factors underlying the transfer of infrastructure, facilities, and public utilities (PSU) land into residential ownership and to examine its juridical and social consequences for residents of Sigura Gura Residence Housing in Malang City. This research employs an empirical legal method with a juridical-sociological approach through statutory, conceptual, and case approaches. The findings reveal that the transfer of PSU land was caused by weak governmental supervision, inadequate land administration, developers’ economic orientation, and delays in the handover of PSU. The conversion of a mushola into residential property resulted in juridical consequences in the form of violations of the social function of land principle and inconsistencies with the approved housing site plan. Socially, the practice led to the loss of worship facilities and communal interaction spaces, thereby affecting residents’ rights to a proper and sustainable living environment.

Abstract

This study aims to analyze the authority of Notaries and Land Deed Officials (PPAT) in controlling land-use conversion of Sustainable Food Agricultural Land (LP2B) during the transfer of land rights and to examine the juridical implications arising from such authority. The research is grounded on the existence of normative ambiguity and the lack of integration between notarial authority and spatial planning control systems, which creates legal gaps enabling formal yet unlawful land conversion. This research employs a normative juridical method with statutory, conceptual, and case approaches. The findings indicate that the authority of Notaries and PPAT remains general in nature and does not explicitly impose obligations to verify LP2B status, resulting in the suboptimal preventive function as gatekeepers. The juridical implications include potential invalidity of authentic deeds, administrative, civil, and criminal liabilities, as well as legal uncertainty and weakened spatial control effectiveness. Therefore, a comprehensive regulatory reconstruction is required to strengthen the preventive role of Notaries and PPAT in controlling land conversion in order to support national food sovereignty.
