Abstract

This study aims to see the construction of the preachers and preachers about the urgency of preventing corruption through the religious forum in the mosque of the Government of Malang Raya. In addition, this study also aims to analyze and analyze the role of the religious pulpit in the Malang Government mosque in preventing corruption. The approach used in this research is a qualitative approach with in-depth interviews, observation, and documentation as data techniques. The results of this study indicate that the construction of the preachers and preachers about the urgency of the religious pulpit as a basis for prevention and corruption in Malang Raya has a strong potential as well as cultural capital to inject the consciousness of the mustami 'or audiences who are mostly officials, although there are variants of construction between the preachers and the muballigh at the Masjid Government of Malang Raya, including theological construction, tasawuf construction, jinnayah fiqh construction, eschatological construction, and qawaidul fiqihiyah construction. Meanwhile, the role of prevention and resistance to corruption in the Baiturrohim mosque in the City Hall of Malang through the religious pulpit has been carried out even though studies on the theme of corruption are not specifically discussed, but are tucked into various themes of sermons and lectures. The beginning of what happened at the Baiturrahman Grand Mosque in Malang Regency and the An Nuur Mosque in Batu City, some of the momentum of the religious pulpit which was used as the basis for preventing and eradicating corruption was expressed in religious activities such as religious activities, weekly and monthly recitations, Friday sermons, and instructions. commemoration of Islamic holidays. Through the religious pulpit, the preachers and preachers play a significant role as spiritual generators capable of bringing about social change by expressing Allah's Jalali nature from His masculinity, such as the nature of Al-Mudzil which means Allah is the Most Humiliating Essence; Al-Dlar, the Danger-Givering Essence; Al-Qabidu, the Essence of the Most Narrowing; Al-Muntaqimu The Essence of the Most Giving Reply; Syadidul Iqab, the Essence of the Most Severe Torment, and; Syari'ul Hisab, the Essence of the Most Fast, His Audit Power. This effort is carried out as a shock therapy for officials so that they are able to behave honestly and trustfully.

Abstract

This article aims to identify and analyze the urgency and future of fiqh legislation for halal products in Indonesia. In addition, this article also aims to identify and analyze whether Law no. 33 of 2014 concerning the Guarantee of Halal Products is the result of authoritarianism in the name of Islamic law in Indonesia or is a constitutional guarantee for the majority of Muslims. The conclusion of this study shows that the effort to enact the jurisprudence of halal products through the Halal Product Guarantee Law is a constitutional necessity for Indonesian citizens who are predominantly Muslim. The regulation of halal certification in the Halal Product Guarantee Law is a form of legal certainty and constitutional protections for the majority of Muslims as consumers in Indonesia. In addition, the existence of the Halal Product Guarantee Law is also considered to provide benefits economically, socially, and healthily, which applies universally regardless of religion. Even the accusation that the Halal Product Guarantee Law is a product of authoritarianism that harms non-Muslims cannot be justified. Because the producers of food and medicine that are widely circulating in supermarkets and mini-markets in Indonesia are actually non-Muslim owners. Even with this halal certification, their products can enter the world market, especially in Muslim countries.

Abstract

ABSTRACT This study focuses on the news frame on the news title with the theme of the Shia conflict in Sampang. This qualitative descriptive research uses a critical paradigm. Data were obtained from Tempo.co, Kompas.com, Kabar Madura and Madura Indepth in 2011-2021. The media framed the Shia Sampang conflict in the government's frame, the Shia community's frame, and the case of intolerance. Tempo and Kompas frame the government as passive in dealing with conflicts and there is forced conversion of faith, but Kabar Madura and Madura Indepth frame the opposite. Furthermore, Tempo framed the government as being involved in intimidating Shia Sampang residents into converting their beliefs; Shia residents are framed as victims who suffer and are oppressed and peace initiators, and this conflict is a Sunni-Shia conflict. Meanwhile, Kompas framed that the government threw the responsibility for resolving the Shia Sampang conflict on other government institutions and did not anticipate the conflict; the Shia people of Sampang still empowered enough to resist; and this conflict is an internal family conflict. Kabar Madura and Madura Indepth framed that the Sampang Shia conflict had been completed, facilitated by the Sampang Regional Government and the Sampang Shia residents as citizens who were not persecuted and forced to convert. ABSTRAK Penelitian ini fokus mengkaji bingkai berita pada judul berita bertemakan konflik Syiah di Sampang. Penelitian deskriptif kualitatif ini menggunakan paradigma kritis. Data diperoleh dari media massa nasional, Tempo.co dan Kompas.com dan media massa lokal Kabar Madura dan Madura Indepth pada tahun 2011—2021. Dengan memanfaatkan pendekatan wacana kritis, ditemukan bahwa media membingkai konflik Syiah Sampang dalam bingkai pemerintah, bingkai warga Syiah, dan bingkai kasus intoleransi. Tempo dan Kompas membingkai pemerintah pasif dalam menangani konflik dan terdapat pemaksaan perpindahan keyakinan, dan Kabar Madura dan Madura Indepth membingkai sebaliknya. Selanjutnya, Tempo membingkai pemerintah terlibat dalam intimidasi warga Syiah Sampang agar berpindah keyakinan; warga Syiah dibingkai sebagai korban yang menderita dan terdzolimi dan inisiator perdamaian, dan konflik ini adalah konflik Sunni-Syiah. Sementara itu, Kompas membingkai pemerintah melemparkan tanggung jawab penyelesaian konflik Syiah Sampang pada lembaga pemerintahan yang lain dan tidak mengantisipasi konflik dan warga Syiah Sampang merupakan korban yang masih cukup berdaya untuk melakukan penolakan. Konflik ini merupakan konflik internal keluarga. Kabar Madura dan Madura Indepth membingkai konflik Syiah Sampang sudah selesai difasilitasi Pemerintah Daerah Sampang dan warga Syiah Sampang sebagai warga negara yang tidak didzholimi dan dipaksa berpindah keyakinan.

Abstract

The quality of law enforcement is determined by the character-building in the Faculty of Law. If so far, Indonesia is often faced with various poor quality law enforcement, and this portrait certainly does not occur naturally, but rather because the law faculty has not been able to play its role optimally in building the character of prospective law enforcers. This study explores Satjipto Rahardjo's thoughts on character-building for law enforcers at the faculty of law. The research method used in this article is a literature study with a qualitative descriptive approach using content analysis. The result of this study indicates that according to Satjipto Rahardjo, legal education at the Faculty of Law must be reoriented from the formation of a positivistic character to the formation of a progressive character of law that prioritizes ethical and moral values

Abstract

Indonesia has large fisheries and marine resources. However, most of Indonesia's marine ecosystems are still under threat. One of them is the coast of Lamongan. The damage is caused by destructive fishing using destructive gears such as tiger trawls, cantrang (a modified Danish seine), explosives, and others. Government  regulations  to  prevent  those  activities  have  not  been  effective. Therefore, alternative approaches are needed. One approach to be chosen is the Islamic law approach. Because the Lamongan coastal community has a strong Islamic  culture,  the  Islamic  view  of  destructive  fishing  is  expected  to  offer  a better alternative solution. Therefore, this article examines the ecological ijtihād of Nahdlatul Ulama (NU) and Muhammadiyah ulama in Lamongan. This is empirical legal research, with data from focused-group discussions and in-depth interviews.  The  study  finds  that  the  NU  Ulama  had  issued  a  fatwa  through Bahtsul Masail, stating that preserving marine ecology is the obligation of every Muslim  and  destructive  fishing  is  prohibited.  Meanwhile,  Muhammadiyah ulama have not issued fatwas institutionally. Nonetheless, the fatwa of the two communities has become a reinforcement for government policies in preventing marine ecosystems damage through eco-fishing.Keywords: destructive fishing; ecological ijtihād; NU; Muhammadiyah AbstrakIndonesia memiliki sumber daya perikanan dan kelautan yang besar. Namun, sebagian besar ekosistem laut Indonesia masih terancam di antaranya di  pesisir  Lamongan.  Kerusakan  ini  disebabkan  oleh  penangkapan  ikan  yang merusak dengan menggunakan alat tangkap yang merusak seperti pukat harimau,  cantrang,  bahan  peledak  dan  lainya.  Pencegahan  aktivitas  tersebut dengan peraturan pemerintah tidak berjalan efektif. Oleh karena itu, diperlukan pendekatan alternatif yang lebih efektif. Salah satu pendekatan yang dapat dipilih adalah pendekatan hukum Islam karena masyarakat pesisir Lamongan mempunyai kultur keislaman yang kuat. Artikel ini mengkaji ijtihād ekologis ulama pesisir Lamongan yang berafiliasi NU dan Muhammadiyah. Penelitian dilakukan dengan pendekatan yuridis-empiris, dengan data didapatkan dari diskusi kelompok dan wawancara mendalam. Penelitian ini menemukan bahwa Ulama NU di Paciran Lamongan telah mengeluarkan fatwa melalui Bahtsul Masail yang menyatakan bahwa  menjaga  kelestarian  ekologi  laut  adalah  kewajiban  setiap  umat  Islam sehingga  destructive  fishing  dilarang.  Sementara  ulama  Muhammadiyah  belum mengeluarkan  fatwa  secara  kelembagaan,  namun  mayoritas  secara  pribadi menyatakan bahwa kegiatan tersebut juga dilarang. Meskipun demikian, fatwa kedua  komunitas  tersebut  menjadi  penguat  bagi  kebijakan  pemerintah  dalam mencegah kerusakan ekosistem laut melalui eco-fishing.Kata Kunci: destructive fishing; ijtihād ekologi; NU; Muhammadiya

Abstract

After several years of suspension, agrarian reform was re-implemented as a way to achieve agrarian justice. This policy was stipulated in the Presidential Regulation Number 86 of 2018 concerning the Implementation of Agrarian Reform which is framed in the Agrarian Reform and Social Forestry (RAPS). However, many groups, mainly the Nahdlatul Ulama (NU) with their strong activism in the agrarian struggle, deeply criticized this policy. This research will examine how NU activists deconstruct the concept of agrarian reform in the RAPS policy using the priority fiqh theory. Fiqh of priorities was initiated to consider the implementation of charity acts or policies deserving the priority of concern based on Shariah principles. This study applied empirical and normative legal research by interviewing NU activists, who paid a specific concern in the agrarian sector, and by conducting a literature review of the results of NU’s ijtihad regarding agrarian reform. The result of this study indicates that agrarian reform in the RAPS policy has not fulfilled the priority fiqh principles. This article contributes to the accuracy of the concept and implementation of agrarian reform in Indonesia which is more just in accordance with the scale of priorities needed to achieve the goals of agrarian reform.Setelah bertahun-tahun ditangguhkan, reforma agraria kembali diterapkan sebagai salah satu cara untuk mewujudkan keadilan di bidang agraria. Kebijakan ini ditetapkan dalam Peraturan Presiden Nomor 86 Tahun 2018 tentang Pelaksanaan Reforma Agraria yang dibingkai dalam kebijakan Reforma Agraria dan Pergutanan Sosial (RAPS). Tetapi, kebijakan reforma agraria dalam RAPS dikritik banyak kalangan, salah satunya dari kalangan Nahdlatul Ulama (NU) yang aktif dalam perjuangan agraria. Penelitian ini akan mengkaji bagaimana dekonstruksi aktivis NU terhadap konsep reforma agraria dalam kebijakan RAPS dengan menggunakan teori fikih prioritas. Fikih prioritas merupakan salah satu teori dalam fikih kontemporer yang digagas untuk mempertimbangkan pelaksanaan amal atau kebijakan yang perlu diprioritaskan berdasarkan kaidah-kaidah syari’at. Metode penelitian yang digunakan yaitu penelitian hukum empiris dan normatif, dengan mewawancarai para aktivis NU concern di bidang agraria serta kajian literatur terhadap hasil ijtihad NU mengenai reforma agraria. Hasil penelitian ini menunjukkan bahwa reforma agraria dalam kebijakan RAPS belum memenuhi kaidah fikih prioritas. Artikel ini berkontribusi untuk mengakurasi konsep dan implementasi reforma agraria di Indonesia yang lebih adil sesuai dengan skala prioritas yang dibutuhkan untuk menggapai tujuan reforma agraria.

Abstract

Microtremor and geoelectrical resistivity surveys have been conducted in areas where the April 10, 2021, earthquake of 6.1 Mw caused the most damage. Wirotaman Village, Malang Regency, was one of the regions with the most extensive damage. This study aims to investigate the seismic vulnerability and subsurface conditions that result in severe damage at the research location. This study's Horizontal to Vertical Spectral Ratio Analysis (HVSR) curve was derived from the recorded microtremor signal in the frequency domain. The frequency parameter and amplification factor obtained from the curve are used to determine the seismic vulnerability index. In addition, a geoelectrical resistivity study with a dipole-dipole configuration was conducted at the site with the most extensive damage. The results of this study show the correlation between the results of the HVSR curve analysis and geoelectrical resistivity in determining the seismic vulnerability of an area. The results indicated that the high seismic vulnerability index value ranged from Kg= 12.0 to 18.0, with the most severe damage concentrated in the Southwest at SA 05 and SA 06. Based on the results of the geoelectrical survey, information was obtained that several points of damage to buildings at SA 05 (red circle) were on the same line, where this condition was associated with the possibility of new faults at that location. This microtremor and geoelectric resistivity investigation reveals thick sedimentary deposits with a high seismic vulnerability index and low resistivity. This study's findings can be utilized as a guide for micro zonation studies in research areas.
