Abstract

Era modernisasi saat ini, masih banyak masyarakat yang belum mengerti arti penting dalam mendaftarkan dan menyertifikatkan tanah mereka yang kemudian diperjual belikan tanpa adanya sertifikat hak milik. Dalam kondisi ini penelitian dibutuhkan guna memahami akibat hukum terhadap akta jual beli tanah tanpa sertifikat hak milik. Penelitian ini menggunakan metode penelitian hukum normatif dan penelitian empiris sehingga dapat menarik kesimpulan dari perbandingan antara literatur dan hal yang berkaitan dengan jual beli tanah tanpa sertifikat hak milik dimasyarakat khususnya Kabupaten Pangkep. Kekuatan pembuktian dari hasil jual beli tanag tanpa sertifikat hak milik ini sangatlah lemah karena tanpa adanya sertifikat hak milik, transaksi tersebut hanya bernilai sebagai perjanjian antara penjual dan pembeli. Sehingga jual beli tersebut berakibat yang sangat merugikan bagi seluruh pihak dan memiliki resiko timbulnya perkara baik secara perdata, pidana maupun tata negara. Penelitian ini berimplikasi pada penekanan tanggung jawab oleh pihak Pejabat Pembuat Akta Tanah (PPAT) sebagai pihak yang berwenang untuk memeriksa status tanah sebelum terjadinya jual beli. In the current era of modernization, there are still many people who do not understand the importance of registering and certifying their land which is then traded without having a certificate of ownership. In this condition, research is needed to understand the legal consequences of deed of sale and purchase of land without a certificate of ownership. This study uses normative legal research methods and empirical research so that it can draw conclusions from a comparison between the literature and matters related to buying and selling land without a certificate of ownership in the community, especially Kabupaten Pangkep. The strength of proof of the sale and purchase of land without a certificate of ownership is very weak because without a certificate of ownership, the transaction is only valuable as an agreement between the seller and the buyer. So that the buying and selling results are very detrimental to all parties and has the risk of arising civil, criminal and constitutional cases. This research has implications for emphasizing responsibility by the Land Deed Making Officer (PPAT) as the party authorized to check the status of land before a sale and purchase occurs

Abstract

Penelitian ini bertujuan untuk mengetahui substansi perjanjian penitipan anak dan pelaksanaan tanggungjawab Baby Daycare Khalifah 4 Makassar terhadap orang tua anak dalam perjanjian penitipan anak. Penelitian ini merupakan penelitian normatif empiris. Data penelitian ini diperoleh melalui wawancara dari pemilik dan pengasuh di Baby Daycare Khalifah 4 Makassar dan orang tua anak, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa 1) Substansi pernjanjian penitipan anak di Baby Daycare Khalifah 4 Makassar telah sesuai dengan peraturan Undang-undang No. 35 Tahun 2014 tentang Perlindungan Anak, Undang-undang No. 8 Tahun 1999 tentang Perlindungan Konsumen dan ketentuan umum mengenai perjanjian diatur melalui Pasal 1320 KUHPerdata yaitu dengan tujuan untuk pihak pertama menghendaki hak bahwa anaknya terjaga dan tumbuh dengan baik, sedangkan pihak kedua menghendaki adanya upah atau uang. 2) Pelaksanaan tanggungjawab penitipan anak di Baby Daycare Khalifah 4 Makassar sebagai pelaku usaha telah sesuai dengan Undang-undang Perlindungan Konsumen Pasal 19 ayat (1) dan (2) mengenai Tanggungjawab pelaku usaha yaitu Baby Daycare Khalifah 4 Makassar harus bertanggung jawab atas apapun kerugian konsumen akibat mengkonsumsi jasa yang dihasilkan penitipan anak. This study aims to determine the substance of the child care agreement and the implementation of the responsibilities of the Baby DayCare Khalifah 4 Makassar towards the child's parents in the child care agreement. This research is an empirical normative research. The research data were obtained through interviews with the owners and caregivers at Baby Daycare Khalifah 4 Makassar and the children's parents, then analyzed qualitatively. The results of the study show that 1) The substance of the child care agreement at Baby Daycare Khalifah 4 Makassar complies with Law No. 35 of 2014 concerning Child Protection, Law no. 8 of 1999 concerning Consumer Protection and general provisions regarding agreements are regulated through Article 1320 of the Civil Code, namely with the aim that the first party wants the right that their child is cared for and grows well, while the second party wants wages or money. 2) The procedure for implementing child care at Baby Daycare Khalifah 4 Makassar is by means of parents and their children coming directly to the place to get a form and a joint agreement between the child's parents and Daycare. This form serves as an agreement between the parties, which listed the rights and obligations of the parties.

Abstract

Tindak pidana pemerasan diatur dalam Pasal 368 KUHPidana. Tindak pidana pemerasan ini dilakukan oleh preman kepada pelaku UMKM dan dilakukan secara berlanjut. Penegakan hukum merupakan upaya penegak hukum yaitu kepolisian berdasarkan Pasal 13 Undang-undang Nomor 2 Tahun 2002 tentang Kepolisian Republik Indonesia. Upaya penegakan hukum yang dilakukan oleh Kepolisian Sektor Bontoala adalah upaya pre-emtif, upaya preventif, dan upaya repsesif. Upaya pre-emtif adalah sosialisasi dengan cara menghimbau kepada pelaku UMKM agar tidak memberikan jatah preman kepada preman yang melakukan pemerasan. Upaya preventif adalah penyuluhan dengan cara membuat perjanjian suatu komitmen antara penegak hukum dengan preman untuk tidak melakukan tindak pidana pemerasan. Upaya represif adalah melaksanakan operasi patuh kepada preman sesuai dengan peraturan perundang-undangan yang mengatur. Penelitian ini bertujuan untuk mengetahui upaya penegakan hukum terhadap tindak pidana pemerasan di Kecamatan Bontoala. Metode penelitian menggunakan pendekatan kualitatif. Jenis dan sumber data dapat berupa data primer dan data sekunder. Data primer merupakan data dari hasil observasi. wawancara, dan kuesioner kepada responden. Data sekunder merupakan data dari penelitian bahan pustaka yaitu peraturan perundang-undangan, buku, jurnal dan artikel tentang tindak pidana pemerasan. Hasil dan pembahasan dalam penelitian ini meninjau pada upaya penegakan hukum yang dilakukan oleh Kepolisian Sektor Bontoala. The criminal act of extortion is regulated in Article 368 of the Criminal Code.  This criminal act of extortion is carried out by thugs against MSME actors and is carried out continuously.  Law enforcement is an effort to uphold the law, namely the police based on Article 13 of Law Number 2 of 2002 concerning the Police of the Republic of Indonesia.  Law enforcement efforts carried out by the Bontoala Sector Police are pre-emptive efforts, preventive efforts, and recessive efforts.  The pre-emptive effort is socialization by appealing to MSME actors not to give thugs rations to thugs who extort money.  Preventive efforts are counseling by means of making an agreement a commitment between law enforcers and thugs not to commit criminal acts of extortion.  Repressive efforts are carrying out operations obeying thugs in accordance with the laws and regulations that govern.This study aims to determine law enforcement efforts against criminal acts of extortion in Bontoala District.  The research method uses a qualitative approach.  Types and sources of data can be in the form of primary data and secondary data.  Primary data is data from the results of observations.  interviews, and questionnaires to respondents.  Secondary data is data from research on library materials, namely laws and regulations, books, journals and articles about the crime of extortion.  The results and discussion in this study review the law enforcement efforts carried out by the Bontoala Sector Police.

Abstract

Penelitian ini bertujuan untuk mengetahui proses lelang objek Hak Tanggungan oleh KPKNL Palopo dan untuk mengetahui akibat hukum jika hasil lelang tidak diterima oleh debitur. Penelitian ini dilakukan di Kantor Pelayanan Kekayaan Negara dan Lelang Palopo, Kota Palopo, Provinsi Sulawesi Selatan dan menggunakan metode tipe penelitian Normatif-Empiris. Pendekatan dilakukan dengan kepustakaan dalam kenyataan berdasarkan wawancara dengan para pihak yaitu pihak debitur dan pihak KPKNL Palopo serta dokumentasi. Hasil penelitian menunjukkan bahwa, pelaksanaan proses lelang objek hak tanggungan oleh KPKNL Palopo telah dilaksanakan sesuai dengan Peraturan Menteri Keuangan No. 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang. Akan tetapi pelaksanaan lelang tersebut tidak berlandaskan asas keadilan oleh karena penentuan nilai limit ditentukan oleh pihak penjual berdasarkan pasal 17 ayat (1) huruf e PMK No 27/PMK.06/2016 Selain itu, akibat hukum dari hasil lelang yang tidak diterima oleh debitur, oleh karena menurut debitur tidak sesuai perkiraannya, sehingga sisa hasil lelang tersebut dititipkan di Pengadilan Negeri Makale. Sesuai ketentuan pasal 1404 KUHPerdata yang mengatur tentang uang penitipan di Pengadilan Negeri. This study aims to determine the auction process for dependent rights objects by KPKNL Palopo and to find out the legal consequences if the auction results are not received by the debtor. This research was conducted at the Palopo State Wealth and Auction Service Office, Palopo City, South Sulawesi Province, and used a Normative-Empirical research type method. The approach is carried out with literature in reality based on interviews and documentation. The results showed that the implementation of the auction process for dependent rights objects by the Palopo KPKNL had been carried out in accordance with the Minister of Finance Regulation No. 27 / PMK.06 / 2016 concerning Instructions for Auction Implementation. However, in fulfilling the conditions for the auction process, there are some deviations where there are principles that are not accommodated by the rights of one of the parties in this case the owner of the goods or debtor because the auction process does not meet the principle of fairness. In addition, the legal consequence is that if the auction proceeds are not received by the debtor, this is because they do not attend/receive the remaining money from the auction due to objections and do not receive the auction proceeds, the remaining money from the auction can be deposited in the District Court in accordance with the provisions of article 1404 of the Civil Code which regulates deposit money in the District Court.
