Abstract

Lattely, the businessmen’s society had realized more about the function of capital market for their bussinesses development, that’s right, the investors require information about the situation of company as the basic consideration in commiting decision to invest. The information which is served in prospect that is published when the company commited public negotiation for capital market instrument to the society, basically contains description about the situation of company, which is observed from several aspects of law, finance, production industry, and marketing. however, another think that is also need to be attention in the capital market’s activity is how important the law inforcement’s improvement is for the violations they did. This is the taste of BAPEPAM and supportime profession institution to anticipate or to organize an inspection to every suspect for commiting or contributed in the violation. in this examination, the writer discusses about the rule of BAPEPAM and supportive profession institution of BAPEPAM in capital market’s activity. The used examination method is normative juridic method, an examination which oppresses in secondary data by examining and studying the foundations of law, especially the rules of positive law from literature materials in the rule of legislation and the valid term, especially that is related to the capital market, based on the analysis result and discussion, it is concluded that in the capital market’s activity, BAPEPAM acts as the organizing institution or as a faster-father of capital market’s actors by giving reaction if the exchange activity is weak, straightening if the capital market’s actors have deviated from the served lines, and executing law sanction if they violate the terms. And also need to be paid with attention to create a better quality of capital market, then the capital market’s activity demands participation from supportive profession institutions, especially in ‘’go public’’ process, because all activities which is related to capital market’s activity. The suportive professiob institutions are public accountant, notary, law consultant, appraiser, investment advisor. Key words : Capital Market, BAPEPAM, Supportive Profession Institutions

Abstract

The purpose of granting regional autonomy is to empower the region in the form of improving care, protection, welfare, initiative, creativity, and community participation in development, foster democracy, equity and justice, and unity, unity, and national harmony in the remembrance of the origin of an area, diversity and characteristics, as well as potential areas that lead to the improvement of the welfare of the people in the system of the Republic of Indonesia. In that regard, it has been made Cooperation Agreement between PT. (Persero) IPC I Branch Tanjung Pinang Tanjung Pinang with the City Government B.XIV-1/TPI-US.15 Numbers and Number 552.3/091.A/HUBLA signed on March 15, 2011 on the Management of Pas Log of Domestic Passenger Terminal in port of Sri Bintan Pura Tanjung Pinang. Examined in this study are some of the regulations that form the basis of law in the cooperation agreement which according to the author it is important to study whether the regulation is used as a legal basis in the agreement is appropriate or not. Also on the principles and factors that must be considered in the drafting of the contract. Methods The approach used in this study is normative methods. From these results it can be concluded that in principle any drafting the contract is to be an agreement of the parties ranging from the use of the term contract until the dispute settlement while referring to the legislation in force, is not contrary to public order and decency. Factors that must be considered by the parties and will hold the legal authority to make the contract are the parties, taxation, over a legal right, the problem keagrarian, choice of law, dispute resolution, termination of contract, and the agreed standard form of agreement. That the legal basis used by PT. IPC I (Persero) Branch Tanjung Pinang in the partnership agreement is in conformity with the applicable regulations. That the legal basis used by the Local Government Tanjungpinang in the partnership agreement does not conform and contrary to regulations. Abstract

The Village funds are part of the State Revenue and Expenditure Budget which are allocated for villages and disbursed through the district/city expenditure budget. During the period of 2015 – 2018, two village heads (village of Malang Rapat and Penaga) were the suspects of corruption cases in Bintan District in the province of Riau Islands. There was no evaluation of the use of the village funds by the district government. The objective of this study was to gain an insight into the use of village funds in the province of Riau Islands. The study problem was how to evaluate the use, impact, and constraints in the utilization of village funds in the province of Riau Islands in 2018 (Case study in Bintan District and Lingga District). This study used a qualitative descriptive method, using interviews and observations for data collection. The results showed that a large portion of village funds was used for physical development in the village, while human development in the village was not yet properly implemented due to the limited allocation of village funds for empowerment and community development. The impact of village funds felt by the community for the addition of physical facilities in the village was significant, while the impact on empowerment and economy of the community was not. The constraints of the usage of the village funds were regulation, human resources, and coordination.

Abstract

PT. Tanjungpinang Makmur Bersama (PT. TMB) is a Regional Owned Company in Tanjungpinang City; the company's current activities are: Running a business in the field of regional asset monitoring services in the form of leasing: stores and places of business by renting out to tenants as small entrepreneurs and traders of essential goods for the people of Tanjung City. This study aims to discover and explore the possibility of how BUMD can develop economic resources. This research focuses on identifying internal and external factors for what happened to PT. Tanjungpinang Makmur Bersama to be able to analyze the right business strategy to be implemented. The data collected in this study came from two sources: The primary data collection method was carried out by direct interviews with informants. The informants in this study are the management of PT. Tanjungpinang Makmur Bersama. Secondary data used in this research can be in the form of documents in the format of Financial Statements, Work Plans and Company Budgets, Company Business Plans. The results of the research are presented qualitatively and quantitatively in this study, while the managerial implications and suggestions are also explained in detail at the end of this study.

Abstract

Proses penegakan hukum merupakan rangkaian yang panjang dalam sistem peradilan pidana yang puncaknya pada putusan hakim. Putusan hakim merupakan pernyataan hakim secara lisan dan tulisan yang terbuka untuk umum dari suatu perkara apakah akan menjatuhkan pidana, bebas atau melepaskan berdasarkan berbagai pertimbangan hukumnya. Setiap orang dapat menilai putusan hakim berdasarkan perannya masing-masing tapi dengan tetap menghormati putusan itu. Terkadang putusan hakim dapat diterima oleh masyarakat namun juga ada yang menjadi polemik apalagi sudah mendapat sorotan publik. Kebanyakan yang mendapat sorotan publik karena dinilai kurang mencerminkan keadilan, tidak proporsional dan tidak dengan pertimbangan yang lengkap. Oleh sebab itu, tulisan ini menggali masalah tersebut dengan melihat dasar pertimbangan agar putusan hakim menjadi proporsional berdasarkan ide keseimbangan dengan menggunakan penelitian normatif. Hasilnya terlihat hakim cenderung kurang lengkap mempertimbangkan baik kepentingan korban, pelaku, masyarakat dan dampak sosial dari putusan itu. Untuk mengatasinya maka perlu meperhatikan ide keseimbangan antara legalitas formal dan hukum yang hidup di masyarakat, antara aspek kepastian hukum, kelenturan dan keadilan, dan keseimbangan antara kepentingan si pelaku dengan korban (masyarakat).

Abstract

Penelitian ini bertujuan untuk mengetahui pengaruh induksi hormon Oodev Optimal terhadap tingkat kematangan gonad ikan kakap putih jantan. Metode yang digunakan ialah eksperimental dengan Rancangan Acak Lengkap (RAL) dengan 4 perlakuan dan 3 ulangan. Dosis yang digunakan adalah kontrol Nacl, hormon Oodev 20 IU/kg, 40 IU/kg dan 60 IU/kg. Wadah yang digunakan dalam pemeliharaan ikan uji berupa Keramba Jaring Apung (KJA) dengan ukuran 1,5x3x3m. Hasil Optimal dalam penelitian ini adalah perlakuan 60 IU Oodev dengan nilai GSI sebesar 0,029%, dan tingkat kematangan gonad mencapai TKG III.

Abstract

Abstract Policies of decentralization and regional autonomy have provided opportunities for regional governments to increase regional revenue sources through local ownership revenue (PAD). One source of PAD is the distribution of profits (dividends) obtained through regionally owned enterprises (BUMD). This study simulates the calculation of rental rates for kiosks, tables, booths, and buildings managed by PT. Tanjungpinang Makmur Bersama (TMB) which is a BUMD owned by the Government of Tanjungpinang City. With this rental rate adjustment, it is expected to increase TMB's revenue,which in turn, will increase Tanjungpinang City's PAD and encourage PT. TMB to become an independent BUMD. This study was conducted in a quantitative descriptive manner using a case study research strategy (CSR). Based on this study, four simulations were performed to calculate the rental rate adjustments. In the first simulation, increasing the price of kiosks/tables/shops by 146.90% will provide dividends to the Tanjungpinang City Government of IDR 500 million a year, excluding other businesses. The second simulation, by increasing the price of the kiosk/table/shop by 99.14%, will provide a dividend of IDR 100 million per year. In the third simulation, if the price of the kiosk/table/shop increases by 93.17%, it will provide a dividend of IDR 50 million a year, excluding other businesses. In the fourth simulation, if the price rate for the kiosk/table/booth is increased by 87.20%, it will provide a dividend of IDR 0 a year, excluding other businesses. Abstrak Kebijakan desentralisasi dan otonomi daerah telah memberikan peluang bagi pemerintah daerah untuk meningkatkan sumber pendapatan daerah melalui pendapatan asli daerah (PAD). Salah satu sumber PAD adalah pembagian keuntungan (dividen) yang diperoleh melalui Badan Usaha Milik Daerah (BUMD). Penelitian ini melakukan simulasi perhitungan tarif sewa kios, meja, booth, dan gedung yang dikelola oleh PT. Tanjungpinang Makmur Bersama (TMB) yang merupakan BUMD milik Pemerintah Kota Tanjungpinang. Dengan penyesuaian tarif sewa ini, diharapkan pendapatan TMB meningkat yang pada gilirannya dapat meningkatkan PAD Kota Tanjungpinang dan mendorong PT. TMB menjadi BUMD mandiri. Penelitian ini dilakukan secara deskriptif kuantitatif dengan menggunakan strategi Penelitian Studi Kasus yang disebut penelitian studi kasus (CSR). Berdasarkan penelitian ini, empat simulasi dilakukan untuk menghitung penyesuaian tarif sewa. Pada simulasi pertama, kenaikan harga kios/meja/toko sebesar 146,90% akan memberikan dividen kepada Pemerintah Kota Tanjungpinang sebesar Rp500 juta setahun, di luar usaha lainnya. Simulasi kedua, dengan menaikkan harga kios/meja/toko sebesar 99,14%, akan memberikan dividen sebesar Rp100 juta per tahun. Pada simulasi ketiga, jika harga kios/meja/toko naik sebesar 93,17%, maka akan memberikan dividen sebesar Rp50 juta setahun, tidak termasuk usaha lainnya. Pada simulasi keempat, jika tarif harga kios/meja/booth dinaikkan sebesar 87,20% maka akan memberikan dividen sebesar Rp0 setahun, tidak termasuk usaha lainnya.

Abstract

Purpose: To explain the struggle in obtaining and utilizing natural resources, including land, the current legislation is unable to protect the rights of the community and tends to give more rights to the owners. Methods: This research is typical (normative). Primary legal materials, or primary legal materials that have authority, and secondary legal materials are two types of research sources Result: The government must also play a role in placing land along the coast because someone must regulate land to ensure the safety of people living along the coast. Agrarian regulations for coastal communities have legal certainty regarding the possibility of eliminating land rights if the land is given to the state and destroyed. The allocation, use, provision and maintenance of land are all regulated and managed by the state. Limitations: Law Number 27 of 2007 concerning Management of Coastal Areas and Small Islands, management of coastal areas and small islands must have HP-3 (Coastal Water Management Rights) (UU PWP-PPK). Contribution: Basic Agrarian Regulations, promulgated based on Law no. 5 of 1960, provides legal certainty regarding the elimination of ownership rights to land when it is handed over to the state and destroyed.
