Abstract

In general, Indonesians are still fairly unfamiliar with online investment, including online investment platforms and current rapid technological developments. This is the capital for perpetrators of illegal investment fraud online to commit their crimes. Often the illegal investment crime ends up being a case of fraud, even the victim's funds are difficult to return. This research is intended to find out about the statutory policies in handling criminal cases of illegal investment fraud online, and steps in suppressing cases of illegal investment fraud so as to create legal protection for investors. The method used in this study is normative juridical by combining various literature related to illegal online investment in Indonesia. Research shows that the legal protection of investors in illegal online investments has met the formulation contained in Articles 1 and 2 of the ITE Law. However, not all provisions stipulated in the ITE Law are related to online investment fraud. Only one clause in article 28 paragraph (1) contains acts as stipulated in article 378 of the Criminal Code on fraud. Although the elements in Article 378 of the Criminal Code are fully fulfilled, there is an element of online fraud. Abstract

Conflicts between several legal regulations and the existence of a legal vacuum make it problematic that chemical castration can be implemented, especially in Article 66 paragraph (1) of Law no. 1 of 2023 does not yet accommodate the implementation of chemical castration as an additional crime, so there is a need for changes and harmonisation of related legal regulations. The method used in this research is a qualitative method. The application of police medicine as an alternative to the execution of chemical castration has not yet received definite legality regarding the procedures and other rules for carrying out chemical castration in the police environment. In the implementation of chemical castration in Indonesia there are still several things that need to be clarified, especially for those carrying out the duties or executors. The existence of overlapping policies requires that efforts be made to harmonise both the health law perspective, medical practice, medical ethical code, human rights perspective, and also based on the Indonesian Criminal Code, and derivative legal regulations that must be harmonised.

Abstract

This study is a case study that analyzes the handling of sexual violence in Cianjur Regency, examining the relationship between social morality, the role of law enforcement officials, and the effectiveness of criminal law policy after the enactment of Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law). This study uses a descriptive qualitative approach with an empirical juridical method through a sociological approach to law. Data was obtained through interviews with law enforcement officials, field observations, and a literature review of relevant legislation and scientific literature. The results of the study show that the handling of sexual violence cases in Cianjur Regency still faces obstacles in the form of weak social morality, strong stigma against victims, and a patriarchal culture that affects reporting and law enforcement processes. In addition, the role of law enforcement officials has not been optimal due to limited capacity, coordination between institutions, and a lack of sensitivity to the victims' perspective. This study recommends strengthening the capacity of law enforcement officials through training on gender perspectives and the implementation of the TPKS Law, continuous education on social morality at the community level, and strengthening inter-agency coordination to improve victim protection and the effectiveness of criminal law policy in Cianjur Regency.

Abstract

Abstract. This study aims to examine the causes, forms, and strategies for combating violence against female Indonesian migrant workers (PMI) from a legal, sociological, and gender perspective. The background of this research is based on the vulnerability of female PMI to various forms of physical, psychological, sexual, and economic violence, which occurs from the pre-placement stage to the post-placement stage, as well as the long-term impact on mental health, human rights, and socio-economic reintegration. The method used is empirical legal with primary data collection through in-depth interviews with female PMI victims of violence and accompanying institutions, as well as secondary data in the form of literature reviews, laws and regulations, and scientific publications. The analysis was conducted using descriptive qualitative methods, integrating human rights theory, Feminist Legal Theory, and international migration policy. The results of the study show that the vulnerability of female migrant workers is caused by economic factors, education, patriarchal culture, non-transparent recruitment processes, the characteristics of work in the informal sector, power imbalances with employers, and weak legal protection in the destination country. The forms of violence experienced include beatings, sexual harassment, threats, social isolation, wage withholding, and structural exploitation practices. Protection efforts implemented include preventive approaches through training, legal education, legal document guarantees, and assistance from law enforcement agencies, as well as repressive approaches through action against perpetrators of violence and bilateral cooperation with destination countries. This study emphasizes the importance of comprehensive and sustainable protection for female Indonesian migrant workers, covering all stages of labor migration as well as strengthening digital-based monitoring systems, officer capacity, and cross-sector collaboration to ensure the safety, dignity, and fulfillment of the human rights of female Indonesian migrant workers.

Abstract

Penelitian ini bertujuan menganalisis latar belakang permohonan pengujian materiil terhadap Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum serta mengkaji dinamika pertimbangan Mahkamah Konstitusi dalam Putusan Nomor 114/PUU-XX/2022 yang mempertahankan sistem pemilu proporsional terbuka pada Pemilu Tahun 2024. Penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual melalui analisis terhadap perundang-undangan, putusan Mahkamah Konstitusi, serta bahan hukum sekunder yang relevan. Hasil penelitian ini menujukan bahwa permohonan pengujian materiil dilatar belakangi oleh pandangan bahwa sistem proporsional tertutup dinilai lebih mampu memperkuat kelembagaan partai politik dan mendorong kaderisasi yang lebih efektif. Namun, Mahkamah Konstitusi menolak permohonan tersebut dengan mempertimbangkan prinsip kepastian hukum, stabilitas penyelenggaraan pemilum, dan perlindungan hak konsitusional warga negara untuk memilih calon legislatif secara langsung. Putusan tersebut mencerminkan adanya pertautan antara logika stabilitas, yang mengedepankan konsistensi sistem pemilu menjelang Pemilu 2024, dan logika status quo, yang menunjukan kecenderungan aktor politik mempertahankan sistem proporsional terbuka karena memberikan ruang bagi kompetisi berbasis popularitas. Penelitian ini menyimpulkan bahwa Mahkamah Konstitusi menempatkan stabilitas demokrasi, kepastian hukum, dan perlindungan hak pilih sebagai dasar utama dalam mempertahankan sistem pemilu proporsional terbuka.

Abstract

Indonesia saat ini mengalami darurat tindak pidana kekerasan seksual, diperlukan langkah yang masif untuk penyelesaiannya. Tak hanya itu, hak dari pada korban harus dapat terakomodir dengan baik, selaras dengan komitmen Bangsa Indonesia untuk menghapus segala bentuk penyiksaan dan perlakuan yang merendahkan martabat manusia serta diskriminasi terhadap perempuan, anak, dan penyandang disabilitas. Tujuan penelitian ini adalah untuk mengetahui perbandingan hukum perlindungan korban tindak pidana kekerasan seksual dalam hukum positif Indonesia dan hukum internasional berdasarkan Beijing Declaration. Hasil pembahasan yakni terdapat persamaan dan perbedaan dalam pemberian perlindungan dan hak terhadap korban tindak pidana kekerasan seksual baik berdasarkan hukum positif maupun berdasarkan hukum internasional. Kesimpulan dari penelitian ini adalah bahwa kekerasan terhadap perempuan perlu dicegah dan dihapuskan, berpedoman pada pengadopsian Beijing Declaration and Platform for Action Indonesia sebagai salah satu negara yang terlibat harus menerapkan aksi-aksi tersebut terkhusus pada kekerasan seksual dalam bentuk peraturan atau hukum nasionalnya. Maka berdasarkan penjelasan tersebut, perlu kiranya Pemerintah Negara untuk bekerja sama dalam memberikan bantuan terhadap korban kekerasan seksual dan perlu adanya penyebaran informasi dan edukasi dalam berbagai bentuk untuk mencegah terjadinya kekerasan seksual. Selain itu, meluasnya pelaku tindak pidana kekerasan seksual yang mana pelaku merupakan seorang anak dibawah umur membuat diperlukannya perubahan undang-undang sistem peradilan anak.

Abstract

Smoking poses health risks, both to the smoker and those around them. Therefore, policies regulating tobacco use are necessary. Asian countries have different policies on smoking, such as those in Indonesia and Singapore. Therefore, this study focuses on analyzing and comparing smoking ban policies in Indonesia and Singapore through a literature review, in order to determine the effectiveness of the policies and their implementation, as well as the potential adoption of relevant policies for Indonesia in strengthening the smoking ban. This study uses a literature review method, which involves analyzing various existing literature sources to gain a broader understanding of the topic being studied. The policies regulating smoking bans in Indonesia and Singapore have several similarities, but also significant differences. Singapore has strict law enforcement related to cigarettes, while in Indonesia the law enforcement system is still weak because cigarettes are a source of state revenue that makes a positive contribution. This shows the importance of strengthening smoking ban policies, especially in Indonesia, in relation to the implementation of policies that have been enacted.
