Abstract

ABSTRACTThis study aimed to evaluate the mechanism for settling disputes in the Constitutional Court containing elements of constitutional complaint. In particular, this study focused on two things: first assessing the urgency/ importance of the idea of setting constitutional complaint in the Constitutional Courts authority. Secondly, to formulate recommendations on setting constitutional complaint in the Constitutional Courts authority.The method used in this research is descriptive qualitative. This type of research is a doctrinal law. This research studied the concept and implementation of the judicial settlement of cases that contain elements of constitutional complaint (complaint constitution) by the Constitutional Court.The conclusion of this study is an important constitutional complaint mechanism is contained within the competence of the Constitutional Court to solve problems of injustice experienced by citizens as a result of public policies undertaken by the government in a broad sense, namely the executive, legislature and judiciary. Setting constitutional complaint within the competence of the Constitutional Court does not have to be explicitly stipulated in the constitution, but enough in the explanation of the Constitutional Court Act. That is not to add direct authority of the Court, but expand the meaning of the authority of the Court in testing the law.

Abstract

Election system that is not carried out simultaneously, among others, has led to high political costs of local election. One of the objectives of the simultaneous local election design is the budget efficiency of the election implementation. This study aims to evaluate whether the simultaneous local election implementation may create a more effective and efficient local elections in the Special Region of Yogyakarta and South Kalimantan. This research was conducted using a normative juridical approach by analysing the applicable legal regulations, particularly Law Number 8 of 2015. In addition, an empirical juridical approach was used to see the implications of the establishment of Law Number 8 of 2015 on the Local Election. The results of study showed that the simultaneous local elections held in the Special Region of Yogyakarta and South Kalimantan were more effective and efficient in terms of controlling and solving problems, budgeting and time used for the implementation of the local election.

Abstract

Tujuan penelitian ini adalah, pertama, untuk mengetahui dan mengkaji secara yuridis pelaksanaan putusan uji materiil oleh Mahkamah Konstitusi yang tidak berbentuk Undang-Undang. Kedua, untuk mengetahui dan mengkaji pengaturan ke depan mengenai pembentukan Undang-Undang yang Berlaku sebagai implementasi dari putusan Mahkamah Konstitusi. Penelitian ini menggunakan metode penelitian dengan jenis penelitian hukum normatif. Sumber data yang digunakan dalam penelitian ini adalah sumber data sekunder dengan bahan hukum primer dan sekunder. Metode pengumpulan data yang digunakan adalah studi pustaka dan analisis dengan teknik analisis deskriptif kualitatif. Berdasarkan hasil pembahasan dapat dijelaskan sebagai berikut. Pertama, putusan Mahkamah Konstitusi tentang uji materi yang dilaksanakan dengan bentuk hukum selain undang-undang dengan menguji Undang-Undang Nomor 12 Tahun 2011 tidak sesuai jika bentuk hukum selain undang-undang yang mengimplementasikan atas putusan Mahkamah Konstitusi tentang uji materi tersebut. Kedua, putusan Mahkamah Konstitusi tentang uji materi harus dilaksanakan dengan undang-undang. Maka dari itu penulis memberikan rekomendasi pelaksanaan terhadap putusan Mahkamah Konstitusi mengenai uji materiil tersebut, agar tidak terdapat berbagai bentuk hukum pelaksanaan terhadap putusan Mahkamah Konstitusi tersebut; regulasi yang tumpang tindih; dan ketidakpastian hukum.

Abstract

The candidacy threshold of President and Vice President in Act Number 7 the Year 2017 concerning Elections causes the Political Party of Elections Participants unable to submit the President and Vice President candidates independently and the recent political parties that participated in 2019 elections. Political Parties have lost their constitutional rights as they cannot propose the candidates of President and Vice President. It is required to find an alternative mechanism of President and Vice President candidacy which grants more protection to the Political Parties' constitutional rights and achieves the essence of people's sovereignty. Article 222 of Act Number 7 the Year 2017 requires the Political Party to have a minimum of 20% seats in the House of Representatives or a minimum of 25% votes of the previous legislative election to submit presidential candidacy. Meanwhile, article 6A section (2) of the 1945 Indonesian Constitution does not govern regarding President and Vice President candidacy; thus, article 222 of Act Number 7 the Year 2017 contradicts the Constitution. The provision in the Elections Act has several implications, among others, limiting the freedom of political parties to submit president candidate, causing discrimination, injustice, and a material loss to the new political party. Moreover, the threshold is not in accordance with the essence of people's sovereignty as granted in the Constitution.

Abstract

The article aimed to analyze the comparison of electoral systems in Indonesia and Malaysia due to relevant differences and similarities. In Malaysia, the legislative election system was implemented to elect members of the People Council using a district platform. Meanwhile, Indonesia used an Open Proportional system to elect members of the National and Regional Representative Councils. A total of three aspects were also compared between both countries through a legal research and comparative approach, namely Government, Election, and Party Systems. Data collection was subsequently carried out through empirical studies, including interviews and literature reviews. The results showed that differences in government systems, state forms, and administration were observed between Indonesia and Malaysia, where proportional and district electoral platforms were implemented, respectively. Despite the differences, the two countries still had various similarities, such as the implementation of a multiparty system using different party coalition platforms. Variations were also observed in the implementation of voting rights by soldiers and convicts within both countries.

Abstract

Kelurahan Balong, Kecamatan Girisubo, Kabupaten Gunung Kidul, menghadapi permasalahan keterbatasan air bersih akibat kondisi geologis daerah karst yang sulit menyimpan air tanah. Studi ini meneliti implementasi sistem penampungan dan penyaringan air hujan (PAH) sebagai solusi berkelanjutan untuk mengatasi permasalahan tersebut. Program ini melibatkan survei lapangan, pemasangan instalasi PAH, serta sosialisasi kepada warga. Hasil penelitian menunjukkan bahwa sistem PAH mampu meningkatkan ketersediaan air bersih secara signifikan, dengan kapasitas tampungan 1.000-1.500 liter per unit. Selain mengurangi ketergantungan pada sumber air konvensional, sistem ini juga berkontribusi terhadap konservasi lingkungan dan efisiensi ekonomi masyarakat. Pendampingan oleh Sekolah Air Hujan Banyu Bening turut memperkuat keberlanjutan program dengan memberikan edukasi mengenai pengelolaan air hujan. Dengan pendekatan berbasis partisipasi masyarakat, sistem PAH tidak hanya berfungsi sebagai solusi teknis, tetapi juga sebagai model pemberdayaan komunitas dalam pengelolaan sumber daya air. Oleh karena itu, program ini diharapkan dapat direplikasi di wilayah lain yang mengalami permasalahan serupa.

Abstract

This International Community Service program was initiated to address the early signs of inheritance disputes among the Muslim minority community in Yala, Thailand. The initiative aimed to enhance mediation skills through structured training in Islamic inheritance law (faraid) as a preventive strategy to reduce potential familial conflicts during the inheritance distribution process. The program employed a blended learning approach consisting of both online and offline training. The online sessions delivered foundational knowledge on Islamic inheritance principles, mediation techniques, and conflict early warning systems. The offline sessions emphasized the practical application of these materials through case analysis and role-playing exercises. Community leaders, including mosque imams and school teachers, were selected as primary participants based on their strategic roles as mediators within the local dispute resolution culture. The effectiveness of the training was evaluated using a pre-test and post-test design involving a validated mediation skills scale. The results demonstrated a statistically significant improvement in participants’ mediation competencies (t(19) = 6.413, p < 0.001), confirming the positive impact of the training intervention. Qualitative feedback further revealed improvements in participants’ empathy, neutrality, problem-solving ability, and confidence in handling inheritance disputes. Overall, the program has proven to be an effective legal empowerment initiative, contributing not only to conflict prevention but also to strengthening social harmony and resilience among a vulnerable minority group. The outcomes highlight the importance of integrating religious legal knowledge with mediation skills to support peaceful dispute resolution in culturally sensitive contexts.

Abstract

The constitutional dilemma surrounding the authority of the Constitutional Court to review electoral laws during an ongoing election cycle reflects the complex tension between the protection of rights and the maintenance of legal order. The Constitutional Court’s judicial activism, particularly when issuing landmark rulings close to or during electoral stages, often intensifies what constitutional law scholars refer to as the counter-majoritarian difficulty—a legitimacy problem that arises when a non-majoritarian judicial body invalidates laws enacted by democratically elected institutions. In this context, the Purcell Principle, a judicial restraint doctrine developed by the United States. Supreme Court, offers an important framework to prevent last-minute changes to electoral regulations that may cause legal uncertainty and confusion among voters. However, directly transplanting this principle into Indonesia is problematic due to significant differences in legal systems, institutional structures, and the fragmented nature of its democratic processes. To address this challenge, this article proposes an adaptive concept called the limited Purcell principle, comprising four key pillars: (1) temporal limitation on the Constitutional Court’s rulings during the election period; (2) postponement of the implementation of rulings which have fundamental legal consequences; (3) exceptions to safeguard the constitutional rights of citizens; and (4) screening mechanisms during the preliminary examination phase. This model aims to strike a balance between protecting constitutional rights and ensuring electoral stability, while encouraging the Constitutional Court to exercise its constitutional mandate more prudently and proportionally within the framework of Indonesia’s constitutional democracy.
