Abstract

Good governance can be realized with the implementation of the formation of laws and regulations in accordance with the principles, especially the principle of openness. The importance of implementing the principle of openness is to make it easier for the public to provide input orally and/or in writing. Each Draft Legislation must be easily accessible to the public, with the aim that the government works fairly and transparently, and the public can also better understand how the government works, both in preparation, implementation and maximum results achieved. This study uses qualitative data with a normative juridical method or approach. The conclusion of this study is that there must be participation from the public starting from the stage of drafting the Law to the end, during the discussion stage in the DPR it must be carried out in a transparent, careful and unhurried manner. Also, the substance must be ensured that it meets the material and formal requirements in the formation of statutory regulations as stipulated in Law Number 12 of 2011 concerning the formation of statutory regulations.

Abstract

The government's efforts to overcome the global economic crisis with its citizens, especially business people, are one of the main reasons to stabilize the economy, maintain financial balance, and avoid bankruptcy for most businesses. Causes termination of employment and termination of employment. The problem of this research is to clarify whether labor law can be projected as a normative based law, namely a philosophical based law based on legal certainty and justice as well as benefits for producers (goods or services). In compiling this journal, the author uses the method of writing prescriptive law. This method aims to use legal norms and conduct normative legal research from an internal perspective. Labor law helps maintain order in the employment relationship between workers and employers. To maintain order, we need a code of conduct in the form of legal ideals, normative law (legal certainty) based on justice and expediency. These three values underlie compliance with labor law and as a rule of law Indonesia upholds caste equality before the law. (Equality before the Law).

Abstract

Dalam dunia kerja, perlindungan hukum dan penegakan hak-hak individu sangat penting untuk menjaga keadilan dan keberlanjutan hubungan kerja yang sehat. Status hukum pekerja tanpa perjanjian atau kontrak tertulis sangat bergantung pada kesepakatan lisan yang jelas antara pekerja dan pengusaha. Perlindungan hukum bagi pekerja tanpa perjanjian tertulis mencakup hak-hak dasar seperti upah yang adil, jam kerja yang manusiawi, dan perlindungan terhadap diskriminasi atau pelecehan di tempat kerja. Pemerintah memainkan peran kunci dalam menjalankan ketiga jenis perlindungan hukum dalam ketenagakerjaan: perlindungan sosial, perlindungan teknis, dan perlindungan ekonomis. Upaya hukum yang dapat diambil jika terjadi pelanggaran hukum di tempat kerja meliputi mediasi, pengaduan internal, gugatan hukum, perlindungan pelapor, dan berbagai opsi lainnya. Pekerja harus memilih upaya hukum yang tepat sesuai dengan sifat perselisihan dan preferensi kedua belah pihak. Perlindungan hukum adalah bagian penting dari usaha untuk menjaga hak-hak pekerja dan memastikan hubungan kerja yang adil dan seimbang. Dengan pemahaman yang baik tentang aspek-aspek ini, pekerja dapat menjaga hak-hak mereka dan menghadapi pelanggaran hukum di tempat kerja dengan tepat dan adil sesuai dengan hukum yang berlaku.
