Abstract

Command responsibility is essential in international human rights enforcement, namely the 1998 Rome Statute. This is also regulated in Article 42 of Law No. 20 of 2000 on the Human Rights Court. Along the way, there are several areas for improvement in Law No. 20 of 2000 concerning the Human Rights Court, namely mistranslations, interpretations and unclear norms relating to command responsibility. This study aims to: (1) To be able to identify and analyze the Command Responsibilities in Law No. 26 of 2000; and (2) To be able to find out and analyze the comparison of Law No. 20 of 2000 on the Human Rights Court and the 1998 Rome Statute of command responsibility. This research is classified as normative research with a philosophical and analytical approach. Materials are collected through document studies and then analyzed prescriptively. The study results show that the Command Accountability in Law Number 26 of 2000 concerning the Human Rights Court has several weaknesses, interpretations and unclear norms related to command responsibility. Therefore, it is necessary to synchronize the 1998 Rome Statute with the Elaborated Approach, namely by adopting the provisions in the Rome Statute, which are elaborated with the National Legal Interest.

Abstract

The essence of the right to vote for Non-e-KTP Voters in the democratic system and Human Rights in the general election system in Papua Province consists of the essence of the right to vote Non-e-KTP from a democratic perspective in Papua, which is very different from the highest defeat in the hands of the people but based on law, so In Papua, the noken system applies, whose democracy is based on consensus deliberation with a delegation system represented by big people or a bond system without being questioned about the use of e-KTP, and a direct voting system by those who have the right to vote determined by e-KTP. As well as the essence of the right to vote for non-e-KTP voters from the perspective of human rights in Papua, namely the rights of citizens to vote as human rights and constitutional rights of citizens can be through the use of the right to vote directly by voters who have e-KTP to exercise their rights and can represented by a traditional leader who represents and on behalf of the community to determine elections. From the perspective of human rights and justice, theoretically it can be said that it fulfills a sense of cumulative justice, but individually it can be said that it does not fulfill a sense of justice.Esensi hak memilih Pemilih Non e-KTP pada sistem demokrasi dan Hak Asasi Manusia dalam sistem pemilihaan umum di Provinsi Papua terdiri dari esensi hak memilih pemilih Non e-KTP perspektif demokrasi di Papua yaitu sangat erat hubungannya dengan kedaulatan tertinggi berada ditangan rakyat namun berdasarkan hukum, sehingga di papua berlaku sisten noken yang demokrasinya berdasarkan musyawarah mufakat dengan sisten delegasi yang diwakili oleh big man atau sistem ikat tanpa dipermasalhakan penggunaan e-KTP, dan sistem pencoblosan lansung oleh yang memiliki hak memilih yang ditentukan oleh e-KTP.  Serta esensi hak memilih pemilih Non e-KTP perspektif Hak Asasi Manusia di Papua yaitu hak-hak warga negara untuk memilih sebagai hak asasi manusia dan hak konstitusional warga negara dapat memalui penggunaan hak memilih langsung oleh pemilih yang ber e-KTP untuk menggunakan haknya dan dapat diwaili oleh ketua adat yang mewakili dan atas nama masyarakat untuk menentukan dalam pemilu yang dilihat dari perspektik hak asasi manusia dan kedilan secara teoritik dapat dikatakan memenuhi rasa keadilan komulatif namun secara individu dapat dikatakan tidak memenuhi rasa keadilan.

Abstract

Situasi darurat Pandemi Covid-19 ini semakin dirasakan oleh masyarakat, karena pada dasarnya sudah ada aturan tentang karantina, sebagaimana dalam Undang-undang Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan. Arab Saudi adalah negara yang terkenal dengan tradisi sosial dan agama yang kental dalam masyarakatnya, masyarakat negara ini terkenal cukup konservatif dalam beragama terlihat dari masih kentalnya agama Islam dan tradisi leluhur dinegara ini, banyak kegiatan keagamaan seperti shalat jamaah dan tabligh sering dilakukan secara berjamaah, serta Arab Saudi menjadi negara yang menjadi tujuan bagi umat muslim untuk melakukan kegiatan ibadah seperti ibadah umrah yang tentunya akan menimbulkan keramaian dalam melakukan ibadah tersebut. Namun demikian kegiatankegiatan tersebut harus segera ditutup dengan dikeluarkannya kebijakan penutupan akses ibadah oleh otoritas Arab Saudi karena maraknya penyabaran Covid-19 yang belum tau kapan dapat ditangani

Abstract

This paper aims to deepen the understanding of the Pancasila concept as a legal source within the context of national culture in the framework of the unitary state of the Republic of Indonesia. The research employs a documentary literature review approach. The analysis results conclude that "Panca" signifies five, while "Sila" refers to principles or principles encompassing essential values such as belief in the Almighty, humanity, nationalism, democracy, and social justice. The article explores the manifestation of Pancasila values and concepts in culture by referring to three main concepts: cultural materials, where individuals are considered cultural realities; social interactions; and tangible creative products. The analysis, study, and description provided in this paper lay the foundation for practical recommendations, emphasizing the necessity of embodying Pancasila values and applying these concepts as a national legal foundation. Beyond mere text, the embodiment of Pancasila values must be an integral part of the daily actions of all citizens. This article advocates for the crucial implementation of concrete Pancasila values in societal life, forming a solid foundation for cultural law in Indonesia.
