Abstract

The Malang City Government is very concerned about the potential of women's associations, most of which are engaged in women's empowerment. Today's women not only devote themselves to their families, but also become creative mothers who can earn money even from home. To be able to equip women who are members of the Dasawisma mangosteen women's association to be able to enrich creativity and also increase the business potential that can be run, the service team will provide training on making ecoprint batik using natural colors and using steaming or steam techniques. There are many types of batik making, but ecoprint batik has the advantage that the colors come from various kinds of living plants that are around us as well as the coloring materials which are more environmentally friendly with unique motifs that are popular today.The method used to carry out the training program for making ecoprint batik is to start with theoretical debriefing, which will then be followed by practice on making ecoprint batik using the steaming technique. The two methods above will be followed by all training participants who are expected to provide capital in the form of knowledge for partners to be applied as one of the efforts to empower women in Malang City. Partners during the training carry out with enthusiasm, the knowledge gained can be used as capital to have a creative business at home and the products produced are good enough and will continue to develop expertise and products from partners.

Abstract

Land is a valuable asset that can be owned by legal subjects. Owning land can be done in several ways, one of which is through the buying and selling process. Legal transfer of land rights can only be done by making a Sale and Purchase Deed (AJB) made before the Land Deed Making Officer (PPAT). Making an AJB all administrative requirements both related to the subject and object are complete. In the field there are several conditions that result in the requirements for making an AJB not being able to be done, so there is a deed called a Sale and Purchase Binding Agreement (PPJB). PPJB is a preliminary agreement made to bind the seller and buyer, until an AJB can be made. PPJB and AJB are different, but many people still understand the two to be the same. The purpose of this study is to determine the position of PPJB in the land buying and selling process, and to analyze the differences between PPJB and AJB. The formulation of the problem raisedare (1) What is the position of PPJB in the process of buying and selling land and (2) What are the differences between PPJB and AJB? This paper is a type of empirical legal research, with an interview research approach method and questionnaire distribution, and using a descriptive analysis method. The results of this are (1) The position of PPJB and AJB is different in the process of buying and selling research land, (2) The differences between PPJB and AJB are as follows. PPJB is a preliminary agreement used to bind the parties and has no legal effect on the transfer of a land right, while AJB can prove the transfer of land rights made by the parties before a PPAT. Abstract

Penggelapan dana dalam lingkup perusahaan merupakan salah satu bentuk white collar crime yang menimbulkan kerugian serius, baik secara finansial maupun terhadap reputasi perusahaan. Kajian ini bertujuan untuk menganalisis bentuk pertanggungjawaban pidana berdasarkan ketentuan Kitab Undang-Undang Hukum Pidana (KUHP) serta tanggung jawab perdata pelaku penggelapan dalam memulihkan kerugian yang dialami perusahaan. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa secara pidana, penggelapan dana diatur dalam Pasal 372 KUHP, dengan ancaman pidana lebih berat dalam Pasal 374 KUHP apabila dilakukan oleh pihak yang memiliki hubungan khusus dengan perusahaan. Sementara itu, dalam ranah perdata, pelaku diwajibkan mengganti kerugian berdasarkan Pasal 1365 KUHPerdata, baik berupa kerugian nyata maupun kerugian immateriil. Kombinasi pertanggungjawaban pidana dan perdata mencerminkan fungsi hukum yang tidak hanya represif, tetapi juga restoratif, sehingga mampu memberikan perlindungan menyeluruh bagi perusahaan sebagai korban tindak pidana

Abstract

Industrial design is a form of intellectual property that is closely linked to people’s lifestyles, as every product created takes into account not only functionality but also user preferences, comfort, and aesthetic appeal. Social, cultural, and technological trends influence the development of industrial design, serving as a source of inspiration for designers in creating relevant and sought-after products. However, the proliferation of these ideas presents challenges for new designers, as there is a risk of designs resembling previous ones. This is often the root cause of disputes with specific characteristics. This study aims to analyze how industrial design characteristics can influence the emergence of factors causing disputes, as well as the factors causing disputes that can be used to determine the most effective form of resolution. This empirical legal study employs an interview approach and the distribution of questionnaires. The results of the discussion indicate that the characteristics of industrial design disputes can influence the identification of the factors causing such disputes, including: the novelty of the protected object; a lack of understanding regarding industrial design; the evidence held by the parties; public awareness; and economic factors. Furthermore, these causal factors influence the selection of dispute resolution mechanisms, which in Indonesia can be pursued through litigation in the Commercial Court or through non-litigation avenues such as mediation, arbitration, and negotiation. Non-litigation resolution is considered more effective for resolving disputes related to business interests and commercial relationships, whereas litigation is more appropriate for disputes requiring legal certainty and the firm enforcement of rights. Understanding the characteristics and factors causing industrial design disputes is crucial in determining a resolution method that is efficient, fair, and provides legal certainty for the parties involved.   Keywords: industrial design, welfare, intellectual property, resolution, legal protection.
