Abstract

ABSTRAK Tujuan dari penelitian ini untuk mengetahui dan memahami bentuk perlindungan konsumen pada ruang lingkup produk yang tidak sesuai dengan yang dibeli melalui aplikasi tiktok shop dan mengetahui bentuk pertanggung jawaban produsen terhadap barang–barang yang dipasarkan melalui Internet. Dalam artikel ini memakai metode penelitian normatif. Berdasarkan Undang-Undang No. 8 Tahun 1999 mengenai Perlindungan Konsumen jika pada Undang-Undang Nomor 11 Tahun 2008 mengenai Informasi dan Transaksi Elektronik (UU ITE) menyatakan adanya suatu pertanggung jawaban hukum terhadap konsumen yang telah dirugikan atas kelalaian dari pelaku usaha ketika mengirimkan produk yang berbeda dari keasliannya, bertujuan agar konsumen bisa mendapatkan kembali haknya selaku pihak yang dirugikan.Oleh sebab itu, mesti ada kejelasan hukum yang memberikan keamanan serta kemudahan bagi komunitas pembelian Undang-Undang. Kata Kunci : UU ITE, Perlindungan Konsumen, Transaksi Elektronik, Tiktok Shop ABSTRACT The purpose of this study to find out and understand the form of consumer protection in the scope of products that are not in accordance with those purchased through the tiktok shop application and to find out the form of producer responsibility for goods marketed via the Internet. This article uses a normative research method. Based on Law no. 8 of 1999 concerning Consumer Protection if Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) states that there is a legal responsibility for consumers who have been harmed by negligence of business actors when sending products that are different from the authenticity, with the aim that consumers can regain their rights as the aggrieved party. Therefore, there must be legal clarity that provides security and convenience for the law-buying community. Keywords: UU ITE, Consumer Protection, electronic transaction, Tiktok Shop.

Abstract

The purpose of this writing is to explain the legal position and role of a Notary in the preparation and approval of land sale and purchase agreements, as required by the legislation. This research focuses on the changes that have occurred in the authority of a Notary, as well as the rights and obligations of the parties involved in making a Sale and Purchase Agreement (PPJB) in accordance with Article 43 paragraph (1) of the Job Creation Law. The research method used is a normative legal approach by analyzing legal regulations and philosophical principles, as well as a prescriptive analysis method. The results of this research confirm that the authority of a Notary in making PPJB is a direct authority granted by the law to a Notary as a public official. This research uses the theory of contract to analyze the legal relationship between the Notary and the parties involved in the contract, while the theory of authority is used to analyze the scope of authority of the Notary in making the contract. The aim of this research is to provide a comprehensive understanding of the dynamics of Notary authority in the context of the Job Creation Law.
