Abstract

Putusan Mahkamah Konstitusi No. 18/PUU-XVII/2019 tanggal 06 Januari 2020, merupakan sebuah putusan fenomenal yang menghapus kelembagaan parate eksekusi sebagaimana tercantum dalam Pasal 15 Ayat (2) dan (3) Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Terhadap putusan ini diajukan kembali oleh pihak ketiga dan diputus oleh Mahkamah Konstitusi dengan putusan No. 2/PUU-XIX/2021 tanggal 31 Agustus 2021. Kedua putusan tersebut mengeliminasi kedudukan parate eksekusi dalam Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Parate eksekusi merupakan legalitas yang dimiliki lessor dalam upaya melakukan eksekusi bila lessee wanprestasi. Kedudukan parate eksekusi sebagai pranata hukum jaminan pasca putusan Mahkamah Konstitusi merupakan permasalahan hukum dalam penarikan jaminan, yang secara yuridis belum dimiliki oleh lessee. Dari permasalahan diatas, maka tujuan dalam penulisan ini hendak mengkaji kedudukan parate eksekusi pasca putusan Mahkamah Konstitusi No. 18/PUUXVII/2019 dan No. 2/PUU-XIX/2021 terhadap hak eksekutorial lessor berdasarkan pranata parate ekekusi. Metode penelitian yang digunakan dalam penulisan ini adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Hasil penelitian menunjukan bahwa kedudukan parate eksekusi sebagaimana diatur Pasal 15 Ayat (2) dan (3) UndangUndang Nomor 42 Tahun 1999 tentang Jaminan Fidusia telah dieliminasi dan eksekusi jaminan harus berdasarkan kesepakatan dengan debitur yang telah mengakui wanprestasi atau mengajukan permohonan pelaksanaan eksekusi kepada Pengadilan Negeri.

Abstract

There are many forms of crime that occur on our beloved Earth. The crime of rape is a crime of depriving women of honor and virginity. Although rape crime has been regulated normatively in the Criminal Code, in reality, the protection of rape victims remains inadequate. From the perspective of Hindu Law, committing rape is a great sin. In Sad Atatayi, rape is called Dratikrama. As such, the authors formulated the following research questions to be explored further: How is the regulation of rape delict from the perspective of criminal law and Hindu law? What is the sanction for rape crime in criminal law and Hindu law? This research is normative research. The results of this research are: the regulation of rape delict against women is contained in Article 285-289 of the Criminal Code and in the Hindu Law Compendium (Manawa Dharmasastra). Sanctions for rape against women in criminal law still vary, depending on the provisions that are violated in the Criminal Code and Hindu Law. It depends on the type of crime, whether it is an aggravated crime or an ordinary crime.

Abstract

UMKM memegang peranan penting sebagai penggerak perekonomian negara. Meskipun berskala kecil, namun perbandingan jumlah UMKM dibandingkan industri besar di Indonesia jauh lebih banyak. Tiap tahun, jumlah UMKM mengalami peningkatan, namun belum berbanding lurus dengan peningkatan pendapatan dan kualitas UMKM serta dampaknya dalam kehidupan ekonomi masyarakat. Persaingan di era digital justru membuat UMKM tidak menyadari bahwa usahanya cenderung stagnan. Ada dua hal penting yang menjadi pondasi guna mendungkung keberlangsungan usaha UMKM yaitu akuntansi dan pemasaran. Akuntansi dan bisnis tidak dapat dipisahkan. Bila perusahaan didukung oleh sistem akuntansi yang tepat maka akan memudahkan pemilik dalam mengevaluasi hasil kegiatan perusahaan. Akuntansi tidak hanya sekedar mencatat namun juga alat untuk memberikan gambaran juga alat untuk membuat perencanaan, pengendalian dan melakukan evaluasi. Maka, sangat penting bagi UMKM untuk menyusun laporan keuangan dengan sistem pencatatan akuntansi yang baik. Banyaknya usaha baru, menjadi masalah krusial bagi UMKM tradisional. Karena sebagian besar usaha baru tersebut mampu memanfaatkan media social dan e- commerce. Sedangkan UMKM tradisional tidak, padahal UMKM tradisional memiliki potensi dan keunikan. Trend masyarakat tentang produk yang klasik semakin tinggi peminatnnya, namun produknya masih sulit untuk dijangkau konsumen karena minimnya akses transaksi. Sehingga perlu diadakannya sosialisasi dan pelatihan penggunaan sosial media dan e- commerce serta akuntansi berbasis digital. PkM dilaksanakan secara Hybrid dengan metode ceramah dan petatihan mengenai e-commerce, pentingnya akuntansi dan membuat catatan keuangan (arus kas, neraca, catatan utang dan piutang) melibatkan 219 partisipan yang sangat antusias mengikuti seminar dan pelatihan. Diharapkan setelah mengikuti kegiatan PkM, kemampuan pemanfaatan media teknologi untuk pemasaran dan akuntansi lebih meningkat.

Abstract

Pada masa pandemi covid-19 telah membawa perubahan besar pada struktur perekonomian dan perpajakan. Fungsi pajak yang utama adalah sebagai sumber keuangan Negara, namun jika keadaan sudah berubah, maka fungsi pajak pun beralih kepada fungsi mengatur (regular) di bidang ekonomi dan sosial. Di masa pandemi ini pemerintah mengeluarkan banyak Peraturan Pemerintah sehubungan menstimulus pertumbuhan ekonomi masyarakat. Mulai PP23, 44,86,110 dan 143/KMK.03/2020 semua itu dimaksudkan agar wajib pajak merasa diringankan dari kewajiban perpajakannya. Namun disisi lain maksud pemerintah meringankan beban wajib pajak malah berakibat memberatkan apabila perlakuan dari pihak pemotong dan pemungut pajak tidak sesuai dengan yang diharapkan oleh pemerintah. Bendaharawan pemda memiliki fungsi pemotongan dan pemungutan pajak atas PPh 22, pph 23 dan PPN kepada rekanan, namun dalam masa pandemi ini pemerintah memberikan insentif bagi pengusaha yang menjual barang yang berhubungan dengan penyediaan sarana dan prasarana penanganan covid-19. Bagi bendaharawan yang tidak tahu aturan tersebut cenderung tidak berani melakukan pembebasan pemotongan, maka bendaharawan akan memotong dan memungut pph dan PPN kepada rekanan seperti biasa. Disinilah kerugian yang diderita rekanan, sehingga perlu diberikan pelatihan untuk update pengetahuan dan tata cara pemotongan dan pemungutan.

Abstract

Abstract The emergence of tourism as a major industry is one of the most remarkable changes that have occurred in global economic activity. Over the last three decades, issues related to the environment and sustainable development related to tourism, especially in Bali, have developed from a marginal topic into a focus of consideration and research. The purpose of this research is to find a novelty in the use of the concept of green tourism as a method that is seen as capable of supporting sustainable tourism development based on local wisdom, especially in Bali. The research used is normative legal research on Law no. 10 of 200b concerning Tourism with a statutory and conceptual approach. This study found that various statutory regulations, including Law no. 10 of 2009 concerning Tourism, namely through sustainable tourism all resources can be managed so as to meet needs and maintain cultural integrity, ecological dimension biodiversity, and system life.Keywords: Bali; Green Tourism; Sustainable Tourism; Local Wisdom.

Abstract

Investment is one of the driving means of strengthening the country's economy. One of the expected ways to increase investment is through foreign investment. Various regulatory measures have been carried out by evaluating and analyzing regulations and policies related to the licensing process for foreign investment. A new legal breakthrough is in the form of the enactment of the Omnibus Law on the Job Creation Law that is being pursued by the government aims to make it easier for foreign investors to obtain a permit. The formulation of problems that can be studied include how the omnibus law applies to simplifying licensing in an effort to facilitate the licensing process related to foreign investment. This study aims to examine the urgency of the implementation the Omnibus Law to simplify the licensing process in an effort to facilitate foreign investment in Indonesia. This research is a normative legal research, which uses primary, secondary, and tertiary legal materials. The results of the study show that efforts to simplify the licensing process for foreign investment in Indonesia become a reference for the government with foreign investors in facilitating sustainable development efforts in the tourism sector which aims to increase large amounts of investment, the availability of jobs, and is expected to improve the country's economy. So in the application of the Omnibus Law, it is expected to be able to accommodate interests that aim to prosper the community.

Abstract

This study analyzes the implementation of good governance principles in the formation of Regional Regulations (Perda) in Indonesia with a focus on the aspects of transparency, public participation, and accountability. The research method uses a qualitative approach through document studies of 15 problematic Perda and in-depth interviews with 10 stakeholders in Bandung City and Sleman Regency. The results of the study indicate that the implementation of good governance principles is still low, where only 40% of regions are transparent in publishing Perda drafts, public participation reaches 25-30%, and accountability is recorded at 20%. The main obstacles include structural limitations (70% of regions do not have a policy analysis unit), cultural (bureaucratic resistance), and technical (limited human resource capacity). However, the study also identified good practices such as the E-Legislation system in Surabaya which increased youth participation by 40%, and the Perda Law Clinic in Yogyakarta which reduced problematic Perda by 35%. These findings conclude that institutional strengthening, increasing legislative capacity, and utilizing technology are the keys to realizing the formation of more participatory and accountable Perda. The study recommends three strategic steps: (1) the establishment of a regulatory analysis unit in each region, (2) technical training for Perda drafters, and (3) the development of a digital platform for public participation.

Abstract

Restorative justice is an alternative to solving criminal cases, which in the resolution mechanism involves the perpetrator, victim, perpetrator’s family, victim’s family, community leaders, or stakeholders to jointly find a fair solution and emphasize returning to the situation as before. The implementation of the concept of restorative justice is needed in an effort to reform the law of the criminal justice system. This study aims to understand, explain, analyze, and make a comparison with the implementation of the concept of restorative justice as an effort to reform criminal law. The method used in this study is normative legal research. There are efforts to reform the law or legal findings in a criminal justice system regarding the resolution of criminal cases. The concept of restorative justice can be adopted and simultaneously applied. In addition to minimizing the accumulation of case files, restorative justice prioritizes the rights of perpetrators and victims and the restoration of the situation.

Abstract

Women’s participation in legislative elections is one of the key indicators of the success of substantive democracy in Indonesia. The Indonesian Constitution guarantees equality between men and women in all aspects of state life. However, women’s representation in legislative bodies remains far below expectations, despite the existence of several legal regulations governing quotas and women’s participation in politics. This article examines two main issues: (1) the legal framework regulating women’s participation in legislative elections in Indonesia, and (2) the implementation of these regulations by political parties in the legislative nomination process. This research employs a normative juridical method using a statute approach and an analytical approach. Data were obtained through an examination of the Constitution, statutory regulations, regulations issued by the General Elections Commission (KPU), and relevant academic literature. The findings show that the regulation of women’s participation in legislative elections is embedded in various legal instruments, such as Articles 28H and 28I of the 1945 Constitution, Law Number 7 of 2017 on General Elections, and KPU Regulation Number 10 of 2023. However, in practice, the implementation of these provisions continues to face several challenges, particularly relating to political party structures, entrenched patriarchal culture, and the limited institutional commitment to gender equality. It can be concluded that although the normative framework governing women’s participation is adequate, its implementation remains ineffective. Political parties require internal political reform, and stronger oversight from electoral management bodies is necessary to ensure that women’s representation is not merely formalistic but also substantive.

Abstract

Perkawinan beda agama merupakan isu hukum yang terus menimbulkan perdebatan di Indonesia karena melibatkan pertentangan antara norma agama, peraturan perundang-undangan, dan prinsip hak asasi manusia (HAM). Secara yuridis, Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan serta Instruksi Presiden Nomor 1 Tahun 1991 tentang Kompilasi Hukum Islam menegaskan larangan terhadap perkawinan beda agama. Namun, keberadaan Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan dan beberapa putusan pengadilan justru membuka peluang terjadinya perbedaan tafsir dalam praktik. Secara khusus, penelitian ini memiliki dua tujuan utama, yaitu untuk menganalisis kedudukan dan pengaturan hukum perkawinan beda agama dalam peraturan perundang-undangan maupun putusan pengadilan, serta untuk mengkaji keterkaitan antara prinsip hak asasi manusia dengan larangan perkawinan beda agama, guna menemukan arah pembaruan hukum yang menjamin keseimbangan antara hak individu dan norma keagamaan. Penelitian ini menggunakan pendekatan hukum normatif dengan menelaah peraturan perundang-undangan dan putusan pengadilan, termasuk Putusan Mahkamah Konstitusi Nomor 24/PUU-XX/2022 dan Putusan Mahkamah Agung Nomor 1400/K/Pdt/1986. Hasil kajian menunjukkan adanya disharmoni antar-norma hukum yang menimbulkan ketidakpastian dalam pelaksanaan hak untuk menikah. Oleh karena itu, diperlukan pembenahan pengaturan hukum yang dapat menyeimbangkan perlindungan hak beragama dan hak untuk menikah dengan tetap berlandaskan pada prinsip Ketuhanan yang Maha Esa sebagaimana diatur dalam konstitusi. ABSTRACT Interfaith marriage is a legal issue that continues to spark debate in Indonesia because it involves a conflict between religious norms, legislation, and human rights principles. Legally, Law No. 1 of 1974 on Marriage and Presidential Instruction No. 1 of 1991 on the Compilation of Islamic Law prohibit interfaith marriage. However, the existence of Law No. 23 of 2006 on Population Administration and several court decisions have opened up opportunities for differences in interpretation in practice. Specifically, this study has two main objectives, namely to analyse the position and legal regulation of interfaith marriage in legislation and court rulings, and to examine the relationship between the principle of human rights and the prohibition of interfaith marriage, in order to find a direction for legal reform that guarantees a balance between individual rights and religious norms. This study uses a normative legal approach by examining legislation and court decisions, including Constitutional Court Decision Number 24/PUU-XX/2022 and Supreme Court Decision Number 1400/K/Pdt/1986. The results of the study indicate that there is a disharmony between legal norms, which causes uncertainty in the implementation of the right to marry. Therefore, it is necessary to reform legal regulations that can balance the protection of religious rights and the right to marry while remaining based on the principle of Belief in One God as stipulated in the constitution.
