Abstract

The prominent legal issues in balinese law can be classified in two problems, inheritance and purusa ( descendant ), purusa is an inherent status (comonly for male) after marriage. If there is later a divorce, the judge must consider the decision in applying the law that was enforced in deciding the divorce case. Referring to Balinese customary law, when there is a divorce, the child's custody will fall on the purusa / father because the child will become a descendant of the father's family, whereas in the Decision of the Supreme Court of the Republic of Indonesia number: 126K / Pdt. / 2001 dated August 28, 2003 states that "If the father and mother divorce, then the care of the underage child is left to the closest and familiar person to the child, namely the mother". Therefore, the basis for weighing judges in determining custody of children in Hindu religious divorce in Balinese customary law is to combine two legal mechanisms between customary law and national law, where from the aspect of Balinese customary law which adheres to the purusa system, the right is on the purusa party but because the child is still underage, the child is under the mother's care until the child become an adult, and mother can not prevent the child to exercising rights and obligations in the father's family as purusa.

Abstract

Kasus kematian anak yang diduga akibat gagal ginjal akut menjadi persitiwa luar biasa dalam dunia kesehatan di Indonesia pada pertengahan tahun 2022. Berbagai spekulasi bermunculan sampai dengan adanya sebuah penelitian dan kajian dimana hal tersebut disebabkan oleh kandungan zat kimia etilen glikol (EG) dan dietilen (DEG) dalam obat sirup penurun demam yang dikonsumsi oleh anak-anak. Berdasarkan berita dalam media online setidaknya tercatat 324 anak dari 28 provinsi di Indonesia meninggal dengan gejala gagal ginjal akut. Peristiwa tersebut menyorot badan pengawas obat dan makanan yaitu BPOM. Para pihak baik pemerintah, swasta, LSM dan komisi perlindungan konsumen meminta pertanggungjawaban kepada BPOM yang diduga lalai dalam melakukan pengawasan sehingga obat-obatan yang berbahaya tersebut dapat lolos izin edar dan izin produksi. Menyikapi permasalahan tersebut, telah muncul isu hukum mengenai pertanggungjawaban hukum BPOM terhadap peredaran obat sirup yang mengakibatkan gagal ginjal akut pada anak sehingga menyebabkan kematian. Untuk memecahkan permasalahan hukum tersebut, dilakukan dengan metode penelitian hukum yang bersifat yuridis normatif. Berdasarkan hasil penelitian akan ditemukan bagaimanan BPOM sebagai lembaga negara dan subjek hukum wajib melakukan pertanggungjawaban secara hukum akibat dugaan kelalaiannya.

Abstract

The massive development of online loans in society not only makes it easier for people to get loans, but also raises new legal problems. Theproblem is related to the billing process which is sometimes carried out unethically. Unethical online loan billing is not only directed at the debtordirectly but also against third parties (non-debtors) who have no relationship at all with online loan transactions. Non-debtor victims are generally family members, co-workers, or people whose contacts are randomly stored in the debtor's phone contactswhose personal data is accessed and misused without consent. This article examines the urgency of recognizing legal protection for non-debtorvictims who experience violence in unethical online loan collection. The main problem to be studied is how there is no recognition of the legalstatus of non-debtor victims in online loan collection regulations, and how effective legal protection efforts are to provide legal protection to non-debtor victims. The research method used is a normative juridical method using a legislative approach. The results of the study show that the current regulationshave not given a position to non-debutur victims as legal subjects who must be protected in online loan collection. Therefore, a legalreformulation is needed to provide explicit recognition of non-debtor victims as part of human rights to obtain legal protection for various actsthat are contrary to human rights.
