Abstract

Abstract The development of the tourism industry in Badung regency is interesting to foreign investors to invest in Badung regency, especially in the area of ​​tourism accommodation services. What are the local government authorities of Badung Regency in granting approval and permission of foreign investment in tourism accommodation? How is the regulation of foreign investment in tourism accommodation services in Badung regency? The type of research used in this study was normative legal research. The results showed (1) the authority of the local government of Badung regency related to the granting of foreign investment permit in the tourism accommodation can be seen from the provision of Article 19 of Badung Regulation No. 2 of 2012 which generally states that the local government of Badung regency is entitled to regulate tourism activities in the region; (2) The arrangement of foreign investment in tourism accommodation services in Badung Regency has not been accommodated in a more specific way through the regulation of Badung Regency. The absence of the specification of this rule would also affect the legal security and legal protection for foreign investors for their investment in tourism accommodation in the area. Abstract

Article 14 of Law Number 29 of 2004 concerning Medical Practice states that the Indonesian Medical Discipline Honorary Council (MKDKI) is the body authorized to determine whether doctors and dentists have made mistakes in the application of medical and dental disciplines and to impose sanctions. This provision indicates that any medical dispute appears to be resolved through the Indonesian Medical Discipline Honorary Committee. However, the current medical dispute settlement through MKDKI is not in accordance with the principle of impartiality, as seen from the process of resolving medical disputes which takes a long time and may not necessarily be executed, including whether the applicant/patient won the case in the Indonesian Medical Discipline Honorary Council (MKDKI) session. What is the legal certainty of equitable medical dispute resolution? And how to realize a just MKDKI decision? The research method is carried out in a normative juridical manner. The results of the study show that justice can be obtained through civil lawsuits, either unlawful acts or defaults on the implementation of therapeutic agreements between patients and doctors in district courts. Legal certainty will be realized if medical dispute resolution arrangements are formed. Meanwhile, the applicant/patient in resolving medical disputes using the MKDKI mechanism, in this case between the patient and the doctor, has not received justice because the MKDKI decision does not contain an unlawful act clause, but rather the application of medical science to patients.

Abstract

Kasus kematian anak yang diduga akibat gagal ginjal akut menjadi persitiwa luar biasa dalam dunia kesehatan di Indonesia pada pertengahan tahun 2022. Berbagai spekulasi bermunculan sampai dengan adanya sebuah penelitian dan kajian dimana hal tersebut disebabkan oleh kandungan zat kimia etilen glikol (EG) dan dietilen (DEG) dalam obat sirup penurun demam yang dikonsumsi oleh anak-anak. Berdasarkan berita dalam media online setidaknya tercatat 324 anak dari 28 provinsi di Indonesia meninggal dengan gejala gagal ginjal akut. Peristiwatersebut menyorot badan pengawas obat dan makanan yaitu BPOM. Para pihak baik pemerintah, swasta, LSM dan komisi perlindungan konsumen meminta pertanggungjawaban kepada BPOM yang diduga lalai dalam melakukan pengawasan sehingga obat-obatan yang berbahaya tersebut dapat lolos izin edar dan izin produksi. Menyikapi permasalahan tersebut, telah muncul isu hukum mengenai pertanggungjawaban hukum BPOM terhadap peredaran obat sirup yang mengakibatkan gagal ginjal akut pada anak sehingga menyebabkan kematian. Untuk memecahkan permasalahan hukum tersebut, dilakukan dengan metode penelitian hukum yang bersifat yuridis normatif. Berdasarkan hasil penelitian ditemukan bahwa BPOM sebagai lembaga negara dan subjek hukum wajib melakukan pertanggungjawaban secara hukum akibat dugaan kelalaiannya dalam melakukan pengawasan dari obat-obatan yang mengakibatkan kematian pada anak.

Abstract

This study aimed at analyzing government’s efforts to provide protection for medical record data of patients as a form of legal protection for patient’s medical data. In the midst of the flurry cases of personal data leakage by hackers, it has raised concerns from various parties about the possibility of medical records leaking of someone’s medical history. Medical history or medical record contains confidential information about a person’s condition related to health and the history of health care that has been carried out. It becomes particularly serious when it records certain diseases of the patient that should not be spread out to the public. In Indonesia, several regulations regarding the protection of personal data which is a person’s privacy rights have been formed. However, this is not enough to deal with the development of digital technology to provide legal certainty for the protection of personal data including medical records as one of the objectives of the law, namely to provide legal certainty and protection. Therefore, this study examines how the legal protection of medical record data based on legal protection according to positive law and the Personal Data Protection Act.

Abstract

Hilangnya bagian tubuh pasien akibat kelalian tenaga medis berdampak pada kecacatan yang disengaja, sehingga membutuhkan kepastian hukum kepada pasien yang dapat diperoleh dengan meminta pertanggungjawaban hukum baik secara pidana maupun perdata kepada tenaga medis akibat kelalaiannya tersebut. Pentingnya pertanggungjawaban hukum adalah untuk memberikan kepastian hukum kepada pasien sebagai korban atas tindak kelalaian dari tenaga medis sehingga mengakibatkan kecacatan permanen. Untuk menjawab permasalahan tersebut metode penelitian hukum yang dipergunakan adalah penelitian hukum yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach), dengan menelaah semua peraturan perundang-undangan dan regulasi yang bersangkutan dengan isu hukum yang diangkat. Pertanggungjawaban hukum akibat kelalian dari tenaga medis yang menyababkan kecacatan permanen pada pasien dapat mengacu kepada ketentuan Pasal 1371 ayat (1) KUHPerdata dan/atau Pasal 46 Undang- Undang No. 44 Tahun 2009 tentang Rumah Sakit jo Pasal 190 ayat (2) Undang-Undang No. 36 Tahun 2009 tentang Kesehatan. kecacatan permanen pasien yang diakibatkan hilangnya anggota tubuh pasien akibat kelalaian dari tenaga medis umum disebut dengan malpraktek. Malpraktek adalah kesalahan atau kelalaian yang disengaja atau tidak dengan sengaja oleh tenaga medis yang menimbulkan kerugian pada kesehatan atau keselamatan dari pasien sebagai korban. Bahwa dapat disimpulkan pertanggungjawban hukum yang dapat dijatuhkan kepada tenaga medis akibat kelalaiannya dapat dimintakan pertanggungjawaban baik secara pidana maupun perdata.

Abstract

The international human rights framework requires cooperation and compliance from member states. Despite various mechanisms offering human rights protection, challenges persist in ensuring compliance and responding to human rights violations worldwide. In this research phase, a systematic literature review was conducted, employing an approach that referenced various sources available in various research databases. The research findings indicate that in analyzing the compliance of member states with international human rights court decisions, it can be concluded that the implementation of decisions involves a complex process and entails various factors. The mechanisms for implementing decisions at the national level require the involvement of legal institutions, civil society participation, collaboration with relevant parties, and education for law enforcement agencies

Abstract

Deviant behavior in the form of Lesbian, Gay, Bisexual and Transgender (LGBT) seems unavoidable. This behavior can target children, teenagers and even adults. With this phenomenon, it has negative impacts on community life. The problem is getting stronger when the phenomenon is published through social media and television shows. At least there are perpetrators of LGBT couples and other LGBT actions in Indonesia. This study uses a research method that is a normative legal research type. In normative legal research, the data used is secondary data. The secondary data contains primary legal materials, secondary legal materials and tertiary legal materials. Then the materials that have been collected are analyzed using a statute approach and a case approach. This study answers a problem, namely first. The implications of LGBT behavioral deviations in Indonesia can have an impact on the health, social, education and security of the Indonesian state. The factors can be caused by internal factors originating from oneself and the family environment and external factors originating from the external environment and social media and television or community groups and second. In the provisions of the existing laws and regulations, there are limits for LGBT, although they are not regulated concretely and explicitly, and future regulations will regulate deviant behavior for LGBT groups who intentionally commit sexual harassment in public, but there is still a need for comprehensive regulations that regulate LGBT.

Abstract

The establishment of the National Social Security System is realized through Law Number 40 of 2004 concerning the National Social Security System (UU SJSN) which has a health insurance program, work accident insurance, old age insurance, pension insurance and death insurance. Health insurance as part of the social security system in Indonesia is indeed a form of social assistance program for health services for the poor and disadvantaged. This program is organized nationally to guarantee cross-subsidies in order to create comprehensive health services for the poor. The purpose of this study is to examine free health insurance for the poor after the health omnibus law related to the regulation that the central and regional governments are required to provide financial protection to the poor and disadvantaged through the health insurance program, so that they can access health services without cost barriers. The research method used is normative juridical. free health insurance for the poor after the health omnibus law in the future (establishing rights) is by creating a single institutional model in the form of an institution mandated by all people. This is important, because in this way the collection of funds will be realized quickly. A single institution in the sense of the organizer of the National Social Security System as a container or umbrella that covers program organizers, so that program implementation can be carried out by several program organizers, especially free health insurance for the poor. The single institution in question is led by a Director, under the National Social Security Council (DJSN), who is directly responsible to the President. The future model is the Free Health Insurance Agency for the Poor.
