Abstract

Fenomena dualisme perempuan dalam rumah tangga merupakan sebuah permasalahan yang sampai saat ini masih saja diperdebatkan. Dalam penelitian ini penulis menggunakan metode studi kasus dengan mewawancarai dualisme perempuan dalam kesejahteraan rumah tangga. Kemudian data lapangan merupakan sebuah data yang utama dalam penelitian ini. Analisis data dalam penelitian ini dilakukan dengan cara analisis konten. Yaitu dengan mengevaluasi dualism perempuan dalam kesejahteraan rumah tangga yang dilakukan dengan 4 informan dengan teori mubadalah faqih abdul qadir dan maqashid syariah. Adapun hasil dalam penelitian ini adalah Menurut pandangan Maqashid Syari’ah dualisme perempuan dalam rumah tangga sejalan dengan prinsip-prinsip maqashid syari’ah yakni bekerja untuk menjaga keturunan, jiwa, akal, harta dan nashab. Kemudian menurut Teori Qira’ah Mubadalah menegaskan bahwa pekerjaan rumah tangga maupun kerja sosial ekonomi diluar merupakan bagian kesalihan laki-laki dan juga perempuan secara bersama. Islam sesungguhnya mendukung perempuan berkarir diruang publik. Sehingga keterlibatan laki-laki diruang domestik juga menjadi niscaya dalam Islam. Sehingga secara tegas penulis menegaskan bahwasanya dualisme perempuan dalam kesejahteraan rumah tangga sejalan dengan teori mubadalah faqih abdul qadir dan juga maqashid syariah. Abstract

This study examines the application of the Non-Discriminatiebeginsel principle by the General Elections Commission (KPU) in ensuring the voting rights of persons with disabilities during the 2024 Regional Elections (Pilkada) in Kerandon Village. Using a field research method through direct observation, the study found that despite efforts by the KPU—such as providing assistive tools and improving accessibility—significant barriers remain. These include physical access limitations for wheelchair users, complex administrative procedures, and inadequate, non-neutral assistance and information. To realize an inclusive and equitable election, improvements are needed in infrastructure, simplification of voting procedures, accessible public information, and impartial, rights-based assistance.

Abstract

Penelitian ini bertujuan untuk menganalisis sertifikasi halal sebagai bentuk perlindungan konsumen Muslim melalui perspektif Maqashid Syariah dan hukum positif. Metode penelitian yang digunakan adalah hukum normatif dengan pendekatan kualitatif, melibatkan pengumpulan dan analisis data sekunder, termasuk peraturan perundang-undangan dan literature ilmiah. Penelitian ini fokus pada konsep halal, makanan halal, makanan haram, Maqashid Syariah, dan sertifikasi halal dalam konteks perlindungan konsumen Muslim. Temuan utama melibatkan konsep-konsep dasar Islam terkait halal dan haram, landasan hukum dari Al-Quran, Hadis, Ijma’ Ulama, Qiyas, Undang-Undang Nomor 33 Tahun 2014, Badan Penyelenggara Jaminan Produk Halal (BPJPH), dan Majelis Ulama Indonesia (MUI). Sertifikasi halal dianggap sebagai implementasi Maqashid Syariah yang bertujuan melindungi kemaslahatan individu dan masyarakat. Kesimpulan penelitian menegaskan bahwa konsep halal mengatur aspek-aspek kehidupan, sertifikasi halal memiliki dasar konseptual pada prinsip Maqashid Syariah, dan Undang-Undang Nomor 33 Tahun 2014 memberikan perlindungan hukum. Sertifikasi halal memberikan keyakinan kepada konsumen Muslim dan mencegah penipuan, sesuai dengan prinsip hukum Islam. Implikasi penelitian ini mencakup peran BPJPH dalam perbaikan kebijakan, peningkatan kepercayaan konsumen, dan tanggung jawab moral pelaku usaha. Secara ekonomi, sertifikasi halal dapat meningkatkan daya saing produk, sementara secara sosial, kesadaran hukum pelaku usaha perlu ditingkatkan. Rekomendasi penelitian lebih lanjut mencakup eksplorasi dampak ekonomi jangka panjang dan efektivitas pendekatan edukatif untuk kesadaran hukum pelaku usaha dalam mengadopsi sertifikasi halal, yang dapat memperkuat perlindungan konsumen Muslim dan mendukung pertumbuhan industri halal.

Abstract

Purpose – Contemporary Ḥaḍānah practices are often confronted with complex social and economic realities. Childcare practices by Single mothers working as sex workers must bear full responsibility for childcare amid economic pressures and moral stigma. This study focuses on the tension between the principle of child welfare and the social marginalization of single mothers who are sex workers. Design/methods/approach – This research employs a qualitative field method with a case study. Primary data were collected through in-depth interviews and observations of four single mothers who worked as sex workers in Astana Village, Cirebon, Indonesia. The data were analyzed thematically using the interpretive framework of Qirā’ah Mubādalah and Maslow’s hierarchy of needs. Findings – The research findings show that the practice of ḥaḍānah by single sex worker mothers in Astana Village, Cirebon, Indonesia reflects a reciprocal caregiving relationship oriented towards the welfare of the child, as emphasized in the Qirā’ah Mubādalah perspective. Analysis using Abraham Maslow's Hierarchy of Needs Theory reveals that caregiving is carried out simultaneously and contextually through the fulfillment of physiological needs, safety, affection, and even the child's future aspirations, despite structural limitations. Research implications/limitations – These results confirm that the suitability of ḥaḍānah cannot be measured by the stigma of the mother's work but rather by her commitment and ability to fully meet the needs of her children. Originality/value – This research offers a novel interdisciplinary analysis integrating Qirā’ah Mubādalah and Maslow’s theory to reinterpret maternal resilience and justice in childcare, promoting a more compassionate and contextual understanding of Islamic family law.

Abstract

Abstract:  This study aims to examine the practice of fulfilling children's rights after divorce in Kerandon Village, Talun District, Cirebon Regency, through the perspectives of Qira’ah Mubadalah by Faqihuddin Abdul Kodir and Maqashid Sharia. The research focuses on three main questions: (1) how children's rights are fulfilled at the local level following a divorce, (2) how the values of reciprocity (mubadalah) are applied in post-divorce parental relationships, and (3) how the principles of maqashid sharia are reflected in the fulfillment of children’s rights. This study uses a descriptive qualitative method with a normative-sociological approach. Data were collected through interviews with five divorced families with children, as well as through observation and document study. Data analysis follows the Miles and Huberman model, including data reduction, data display, and conclusion drawing. The findings indicate that the fulfillment of children's rights after divorce is significantly influenced by social, economic, and relational factors between the parents. In some cases, the principles of Qira’ah Mubadalah, such as mutual consultation (musyawarah) and consent (taradhin), are internalized through productive and collaborative communication between parents. However, there are also instances where the failure to fulfill children’s rights stems from broken communication and the negligence of one parent. From the maqashid sharia perspective, some families continue to uphold the principles of protecting religion (hifz al-din), life (hifz al-nafs), intellect (hifz al-‘aql), lineage (hifz al-nasl), and wealth (hifz al-mal) of the child, albeit under limitations. This study highlights the importance of a reciprocity-based and maqashid-oriented approach in designing post-divorce child protection policies and practices.
