Abstract

This work attempts to analyze the implementation of the GI law and regulations in the traditional handicraft industry in Indonesia. We particularly focus on the natural and human factors that are assessed when stakeholders apply for GI registration for their traditional handicraft products. This work also analyzes the books of requirements of five handicrafts with registered GIs in Indonesia. Indonesia’s GI regulations and policies, especially with regard to handicrafts, are compared with those of India and Thailand. The article comprises four chapters. Chapter 1 introduces the topic of this work. Chapter 2 explores the protection of traditional handicrafts through GI systems. Chapter 3 details the GI law and regulations in Indonesia and the traditional handicrafts protected by GI. Chapter 4 analyzes the issue of GI registration for traditional handicrafts in Indonesia, especially the issue of the assessment of natural and human factors. The chapter also covers the comparative analysis of the GI systems implemented in Indonesia, India, and Thailand to protect traditional handicrafts. Chapter 5 summarizes our conclusions and recommendations.

Abstract

In this study, the authors raised the issue of Royalty Protection for the Practice of Copying Books. The choice of the theme was motivated by the fact that book copying in Indonesia is increasingly being carried out by several parties, such as photocopying service providers and digital platforms or marketplaces that sell fake books from the original copies. Copyright infringement carried out with this photocopy machine has violated the exclusive rights of the creator, especially economic rights. As the protection of the author of a book is very important whose aim is that the author can feel appreciation for the work that has been made by using his creative thoughts and ideas in the form of royalties for the use of the license that the author has given to other parties. Based on Law No. 28 of 2014 concerning Copyright, the Reproduction of books for commercial purposes and without prior permission to the creator or copyright holder is very clearly referred to as a violation, because it violates the economic rights of the creator where copying books for commercial purposes is carried out only for business and profit purposes and the creator does not get royalties for the violation

Abstract

As a main contributor to Indonesia GDP, Small and Medium Enterprises should be assisted by Goverment and University in order to expand its capacity in managing their intangible assets and intellectual property. The efforts in giving guidance to SMEs in managing its IP and take a benefit of IP systems could be on the mapping of problems faced by SMEs in managing its IP and addressing a better policy recommendation suitable to solves it problems. This article streghtening the arguments that to enhance Indonesia SME capacities in managing its IP , the government institutions and university have to coopertate in disseminating IP strategy adaptive to the needs and challenges faced by SMEs of Indonesia in protecting its IP assets, enforcing, and commercialization of its IP assets.

Abstract

Sherlock Holmes merupakan Novel karya dari Sir Arthur Conan Doyle, Sir Arthur Conan Doyle memulai semua kisah mengenai karakter ini dengan novel A Study in Scarlet, yang terbit pada 20 November 1886. Sir Arthur Conan Doyle hanya pernah menulis empat novel dan 56 cerita pendek Sherlock Holmes. Setidaknya 54 dari karya-karya ini – dan karakter Sherlock Holmes ditampilkan dalam karya – tidak dapat disangkal dalam domain publik dan dengan demikian bebas untuk digunakan siapa saja. Enola Holmes karya Nancy Springer merupakan anggota terbaru dari tradisi pastiche fandom ini. Film adaptasi dari sebuah novel ciptaan Nancy Springer yang berjudul Enola Holmes, populer di kalangan masyarakat pada akhir-akhir ini, film tersebut di tonton masyarakat melalui aplikasi film dan serial yaitu Netflix Penggugat yaitu Conan Doyle Estate mengklaim pelanggaran hak cipta dan merek dagang terhadap Film Enola Holmes karena menampilkan karakter domain publik Sherlock Holmes dalam filmnya Enola Holmes. Penggugat mengklaim kepemilikan hak cipta atas karakteristik, seperti penggambaran kehangatan dan kebaikan oleh Sherlock Holmes. Beberapa doktrin dapat digunakan untuk mengetahui apakah ada sebuah peniruan (copying) dalam pembuatan karaker fiksi Literatur Sherlock Holmes dalam novel Enola Holmes buatan Nancy Springer dan Film adaptasinya yang di rilis oleh Netflix, diantaranya adalah doktrin originalitas, dan doktrin merger. Doktrin tersebut kemudian digunakan untuk mengidentifikasi peniruan-peniruan yang terjadi dalam sebuah karya

Abstract

Perkembangan hak kekayaan intelektual dipengaruhi oleh perkembangan teknologi. Salah satu bentuk kekayaan intelektual adalah Paten yang diciptakan oleh para inventor baik yang bekerja pada swasta maupun yang berstatus sebagai Aparatur Sipil Negara (ASN). Bagi inventor berstatus sebagai ASN, invensi yang dihasilkan tentunya didasari atas hubungan dinas dengan instansi pemerintah di mana ASN tersebut bekerja. Penelitian ini bertujuan untuk mengkaji bagaimana mekanisme pembagian royalti atas paten dari invensi yang dihasilkannya dan apakah pembagian royalti paten tersebut telah memenuhi hak ekonomi inventor atas invensinya. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan data sekunder. Hasil Penelitian menunjukkan bahwa “work made for hire” sebagaimana dipaparkan di atas, pembagian royalti paten atas suatu invensi yang dilakukan dalam hubungan dinas dengan instansi pemerintah tidak hanya dimiliki oleh inventor saja melainkan juga milik instansi pemerintah di mana inventor tersebut bekerja. Pemenuhan hak atas royalti paten yang dihasilkan dari hubungan dinas dengan instansi pemerintah, Kementerian Keuangan menetapkan PMK 136/2021. Invensi yang dihasilkan dalam hubungan dinas dengan instansi pemerintah menerima imbalan atas royalti paten setelah memenuhi kriteria yaitu dalam proses pendaftaran/pencatatan atau telah diatas namakan milik negara; telah dilisensikan; telah menghasilkan PNBP; dan hasil PNBP dimaksud telah disetor ke negara.

Abstract

The formulation of the problems of this research are: 1. What is the Urgency of Strict Liability in Enforcement of Environmental Law in Indonesia? and; 2. What are the Efforts to Implement Strict Liability in Environmental Disputes in Indonesia? The research method used is a normative method using a conceptual approach and a statutory approach. The conclusions from this study are 1. By using Strict Liability, the constraints experienced by sufferers of environmental impacts can be minimized. Then another thing that can be considered as something that benefits the victim is that the polluter has been held responsible, regardless of whether he is guilty or not. and; 2. The removal of the phrase "without the need to prove an element of guilt," by Law No. 11 of 2020 Concerning Job Creation does not make Article 88 UUPPLH where Strict Liability is removed. Regarding the concern that the formulation of Strict Liability in the Ciptaker Law will further obscure the understanding of Strict Liability.
