Abstract

Penyusunan undang-undang yang demokratis harus menggambarkan peran hukum sebagai alat untuk memfasilitasi dinamika masyarakat. Dengan cara ini, peran hukum dalam negara yang sedang mengalami perubahan dapat mencakup semua kompleksitas masyarakat seperti Indonesia. Perkembangan teknologi dan industri menuntut kehadiran suatu kerangka hukum yang mampu mencapai tujuan yang diinginkan oleh masyarakat. Dalam artikel ini, akan dibahas tentang politik hukum dalam pembentukan undang-undang di Indonesia yang berkaitan dengan Konstitusi, sehingga dampaknya sesuai dengan yang diinginkan. Tujuan dari artikel ini antara lain, untuk mengetahui bagaimana aspek yang mempengaruhi legislasi di Indonesia, dan untuk mengetahui bagaimana Politik Hukum Legislasi di Indonesia. Adapun metode penelitian yang akan digunakan menggunakan metode penelitian normatif dengan pendekatan konsep dan pendekatan perundang-undangan. Untuk menghasilkan kualitas yang berbeda dengan kualitas legislasi saat ini membutuhkan proses dalam menghasikan produk tersebut, yaitu undang-undang, tanpa perubahan dalam mekanisme tersebut maka tidak bisa lagi kita berharap terjadi perubahan kualitas dengan mesin proses yang sama. Kekuasaan politik yang dijalankan oleh pemerintah bersama lembaga-lembaga kenegaraan lainnya, harus sesuai dengan konstitusi yang telah disepakati bersama demi tegaknya negara hukum. Dalam hal ini semua komponen bangsa, baik organisasi politik, harus secara sadar melaksanakan kewajibannya sesuai dengan aturan hukum.

Abstract

The formulation of the problems of this research are: 1. What is the Urgency of Strict Liability in Enforcement of Environmental Law in Indonesia? and; 2. What are the Efforts to Implement Strict Liability in Environmental Disputes in Indonesia? The research method used is a normative method using a conceptual approach and a statutory approach. The conclusions from this study are 1. By using Strict Liability, the constraints experienced by sufferers of environmental impacts can be minimized. Then another thing that can be considered as something that benefits the victim is that the polluter has been held responsible, regardless of whether he is guilty or not. and; 2. The removal of the phrase "without the need to prove an element of guilt," by Law No. 11 of 2020 Concerning Job Creation does not make Article 88 UUPPLH where Strict Liability is removed. Regarding the concern that the formulation of Strict Liability in the Ciptaker Law will further obscure the understanding of Strict Liability.

Abstract

Dalam konteks perkembangan kebebasan berserikat di Indonesia sebagai manifestasi dari Negara Demokrasi Konstitusional, peran Partai Politik sangat fundamental. Tanggung jawab yang diamanatkan oleh UUD NRI 1945 menjadikan partai politik sebagai wadah penting untuk partisipasi politik dalam tatanan demokratis. Efektivitas lembaga negara berpengaruh langsung terhadap kualitas sistem partai politik dan mekanisme demokrasi yang ada. Artikel ini bertujuan untuk menganalisis secara mendalam peran partai politik dalam konteks demokrasi konstitusional serta upaya untuk memperkuat partai politik guna meningkatkan kaderisasi dan sistem partai. Metode penelitian yang digunakan bersifat normatif, menekankan pentingnya peran partai politik, baik terhadap konstituen maupun negara secara keseluruhan. Kepemimpinan negara umumnya diisi oleh individu dari partai politik melalui proses pemilihan yang demokratis. Meskipun partai politik didirikan dengan tujuan tinggi, perannya sebagai penggerak masyarakat dalam memperoleh kekuasaan di pemerintahan kini tidak lagi sesuai dengan realitas yang ada di Indonesia saat ini

Abstract

This article compares the legal policies implemented by France, Argentina, and Indonesia in addressing economic crises. The research method used in this study is doctrinal legal research, combined with a prescriptive-analytical approach, aims to provide recommendations for addressing specific issues and generate arguments, theories, or new concepts as solutions. The findings of this research indicate that France, through the Macron Law, seeks to overcome the economic crisis by reforming the labor market and implementing social policies. Meanwhile, Argentina addresses economic crises by referring to its Constitution, particularly Article 76 and Article 99(3), which provide the legal framework for the government to handle public emergencies and regulate the executive-legislative relationship in crisis policymaking. This is evident in Law 25.156 and Decree 1.019 of 1999, which govern competition protection. In Indonesia, the economic crisis triggered by the Covid-19 pandemic was addressed through the National Economic Recovery (PEN) policy, which relies on statutory authorization. Additionally, Indonesia has adopted a legislative model in responding to emergencies, a concept introduced by Tom Ginsburg and Mila Versteeg.

Abstract

This study examines the evolution of the legislative power relationship between the House of Representatives (DPR) and the President within Indonesia's constitutional framework, particularly before and after the amendments to the 1945 Constitution. It aims to identify how constitutional reforms have reshaped the distribution of legislative authority and whether they have succeeded in achieving a substantive balance of power. Using a qualitative, normative juridical approach with historical and comparative analysis, the study explores relevant constitutional documents, laws, and Constitutional Court decisions. The findings reveal that although the constitutional amendments shifted the Indonesian system from presidential dominance to a formal balance of power, lawmaking practices remain heavily influenced by executive control. The president retains significant authority in legislative initiation and formulation, while the role of the DPR is often constrained by political and institutional constraints. Consequently, the principle of checks and balances in Indonesia's presidential system tends to be cooperative rather than competitive, with procedural balance lacking substantive equality. The study concludes that constitutional reforms must be complemented by institutional strengthening of the DPR through increased research capacity, professional legislative drafting, and increased public participation. This study contributes to the theoretical discourse on constitutionalism by proposing a cooperative checks and balances model suitable for presidential systems characterized by asymmetric power relations

Abstract

This article examines the Constitutional Court’s authority in adjudicating structured, systematic, and massive (TSM) electoral violations in Indonesia’s 2019 and 2024 presidential elections. Using a normative legal and comparative approach, it evaluates the Court’s application of the judicial restraint principle and its limitations when violations do not quantitatively affect election results but may undermine electoral legitimacy. Findings reveal that the Court consistently rejects examining TSM allegations without evidence of direct impact on vote counts. However, in cases involving ethical and constitutional violations, this approach may fall short in ensuring substantive electoral justice. A comparative study with five other countries shows that several constitutional courts have adopted a more progressive role in safeguarding the integrity of the electoral process. The article recommends strengthening constitutional interpretation and reforming the legal framework to enable Indonesia’s Constitutional Court to act as a guardian of both electoral outcomes and democratic fairness.

Abstract

This article analyzes the incorporation of environmental norms into constitutional law, focusing on the 1945 Constitution of the Republic of Indonesia within a comparative constitutional framework. Amid worsening global ecological degradation, the study investigates the extent to which the right to a healthy environment is recognized as a constitutional right and enforceable through legal mechanisms. Article 28H(1) and Article 33(4) of the 1945 Constitution reflect normative commitments to sustainable development, though in a general and non-justiciable form. Employing normative juridical and comparative legal methods, the study evaluates selected jurisdictions—Portugal, France, Ecuador, and India—which exhibit more progressive and enforceable environmental constitutionalism. The findings reveal that Indonesia's constitutional provisions remain insufficient in terms of clarity, institutional support, and judicial applicability. Therefore, this paper recommends a constitutional refinement through detailed and justiciable environmental provisions, accompanied by institutional guarantees. Strengthening environmental constitutionalism is essential to ensure intergenerational justice and ecological integrity within the framework of constitutional democracy..

Abstract

This study examines the problem of overlapping authority among high state institutions in Indonesia following the amendment to the 1945 Constitution of the Republic of Indonesia. The shift in the system towards the separation of powers and the proliferation of independent institutions has actually triggered disharmony, sectoral ego, and regulatory obesity, which has led to declining legal certainty and hampered the effectiveness of government. This study uses normative legal research methods with legislative, conceptual, and comparative approaches. This study examines the root of the problem and compares it with the constitutional practices of the United States and South Korea. The results of the study confirm that the availability of a dispute resolution forum in the Constitutional Court is not enough to unravel the conflict of authority in the field. Two main pillars are needed as fundamental solutions. First, the application of regulatory precision in the formation of rigid and firm laws to close the gap in gray areas, adopting the discipline of South Korean legislation. Second, the need to internalize a culture of constitutional compliance among the elite of state administrators, as is the tradition of the United States Constitution. This structural and cultural double improvement is an absolute prerequisite for realizing institutional harmonization, ensuring the upholding of legal certainty, and maintaining governance stability.
