Abstract

Dalam kehidupan di masyarakat banyak transaksi jual beli yang tidak sempurna artinya memiliki cacat hukum, baik objek jual beli tersebut belum diserahkan dalam transaksi jual beli maupun mengenai keabsahan legalitas seseorang untuk dinyatakan sah sebagai hak untuk melakukan transaksi jual beli. Penelitian ini berupaya untuk menganalisis aspek perlindungan hukum terhadap pembeli beritikad baik dalam transaksi jual beli yang dibatalkan karena adanya gugatan pihak ketiga. Studi ini mengambil studi kasus Putusan No. 800/Pdt.G/2013/PN.Dps. Dalam studi ini, aspek hukum yang dikaji adalah adanya gugatan terhadap suatu transaksi jual beli dari pihak ketiga. Ini secara hukum mempunyai konsekuensi terhadap hak pembeli yang beritikad baik, dan aturan hukum menyediakan perlindungan hukum dalam kasus ini. Sebagai temuan, bentuk perlindungan hukum yang diberikan terhadap pembeli tanah yang beriktikad baik tidak dipertimbangkan oleh hakim, dalam kasus Putusan No. 800/Pdt.G/2013/PN.Dps. Sebaliknya, pertimbangan hakim hanya ditujukan terhadap Penggugat saja tanpa mempertimbangkan mengenai adanya unsur-unsur pemenuhan kategori pembeli beritikad baik yang juga seharusnya dilindungi hak-haknya sesuai undang-undang yang ada. Abstract In life in society, many buying and selling transactions are imperfect, meaning they have legal defects, whether the object of sale and purchase has not been submitted in a sale and purchase transaction or regarding the validity of the legality of a person to be declared valid as the right to carry out a sale and purchase transaction. This study analyzes aspects of legal protection for good faith buyers in sales and purchase transactions canceled due to a third-party lawsuit. This study takes the case study of Decision No. 800/Pdt.G/2013/PN.Dps. In this study, the legal aspect studied was a lawsuit against a sale and purchase transaction from a third party. It has legal consequences for the rights of the good faith purchaser, and the rule of law provides legal protection in this case. As a finding, the form of legal protection given to land buyers with good intentions was not considered by the judges in the case of Decision No. 800/Pdt.G/2013/PN.Dps. On the other hand, the judge's considerations were only aimed at the plaintiff without considering the elements of fulfilling the category of good faith buyers whose rights should also be protected in accordance with existing laws. Abstract

Mining in Indonesia still leaves many excavation holes that have not been reclaimed, at least 8 million hectares of post-mining land after the use of coal mining land in East Kalimantan Province. As a result, from 2011 to 2018, 32 people died, most of them children, while 140 people died in all regions in Indonesia due to drowning in ex-mining holes. The aim of this research is to provide legal protection for land through the application of the Eco-Democracy concept due to violations by fraudulent entrepreneurs. The method used is the approach of statutory opposition and conceptual opposition of regulations relating to legal issues resolved through a statutory approach. The results of the research explain that reviewing all laws written in Government Regulation Number 78 of 2010 concerning Reclamation and Post-Mining and Number 4 of 2009 in the Republic of Indonesia Law concerning Mineral and Coal Mining requires companies to restore land through reclamation after the mining process is complete. Prepare collateral in the form of money given by businesses committed to restoring and improving the land environment. The government authority will supervise the reclamation during its implementation so that mining entrepreneurs will comply and not abandon the ex-mining land.
