Abstract

Pengadaan tanah untuk kepentingan umum harus menjamin keadilan bagi masyarakat dalam perolehan tanah untuk pelaksanaan pembangunan, termasuk di dalamnya pemberian ganti rugi pengadaan tanah bagi kepentingan pembangunan ruas jalan tol. Dalam pelaksanaannya timbul pertanyaan mengenai pengadaan tanah untuk kepentingan umum perlu mendapatkan ganti rugi, dan bagaimana bentuk ganti rugi yang diberikan kepada pemilik hak atas tanah berdasarkan peraturan perundang – undangan serta upaya yang harus di lakukan masyarakat untuk menanggulangi hambatan bagi masyarakat mendapatkan ganti rugi sesuai aturan yang berlaku. Metode yang digunakan dalam penelitian ini antara: yuridis normatif, deskriptif analis, jenis dan sumber, yaitu data primer dan skunder, kualitatif. Setelah di kaji lebih dalam menunjukan bahwa ganti rugi dalam pengadaan tanah untuk kepentingan umum merupakan amanat konstitusional dan sebagai kompensasi atas potensi ekonomi tanah yang dimiliki masayarakat. Ganti rugi dapat diberikan dalam bentuk uang, tanah pengganti, permukiman Kembali, kepemilikan saham atau bentuk lain yang disetujui oleh kedua belah pihak. Upaya yang harus di lakukan masyarakat untuk mendapatkan ganti rugi adalah mendatangi sumber informasi resmi seperti kantor desa atau kelurahan dan kecamatan. Kemudian pastikan dokumen-dokumen adalah dokumen asli yang diakui oleh negara. Abstract Procurement of land for the public interest must ensure justice for the community in acquiring land for the implementation of development, including the provision of compensation for land acquisition for the benefit of the construction of toll roads. In practice, the question arises, why does land acquisition for the public interest need compensation? What is the form of compensation given to the owner of land rights based on the legislation? What efforts should be made by the community to overcome obstacles for the community to get compensation? According to applicable regulations? The methods used in this study include normative juridical, descriptive analysis; types and sources, namely primary and secondary data, qualitative. After further review, it shows that compensation in land acquisition for the public interest is a constitutional mandate and is compensation for the economic potential of the land owned by the community. Compensation can be given as money, replacement land, resettlement, share ownership, or other forms agreed upon by both parties. Efforts that the community must make to obtain compensation are to visit official sources of information such as the Office Village and Subdistrict. Abstract

Indonesia has experienced rapid growth in the technology sector and digital economy. However, traditional contract transactions still often face problems such as legal uncertainty, fraud and complicated bureaucracy. The blockchain technology system brings major changes in various sectors, including in the context of security and legal certainty in contract transactions in Indonesia. The problem that will be discussed in this research is, How can blockchain technology be used to increase transparency and data integrity in contract transactions in Indonesia? Are there any legal regulations governing the use of blockchain technology in contract transactions in Indonesia? How does the application of blockchain technology in contract transactions in Indonesia affect the resolution of contract disputes? The approach method that the author uses in this research is a normative juridical approach. In this research, the author studies legal rules by examining statutory regulations and legal concepts that are related to this research. Based on the research results, it can be seen that in general, the role of blockchain technology in increasing security and legal certainty in contract transactions in Indonesia is very important in facing challenges related to reliability, security and legal certainty that are often faced in conventional systems.Keywords: Blockchain; Contract; Security.

Abstract

This study aims to describe the form of policies, problems encountered, and efforts that must be developed by the Regional Government of Cianjur Regency in the Development of Jayanti Tourism Potential as a tourism asset. The method of approach used in this research is Normative Jurisprudence, namely by studying and reviewing the principles of law, especially positive legal principles derived from existing literature from legislation and provisions, especially relating to tourism. Tourism is a temporary and  short-term  transformation  of  people  towards  destinations  outside  the  place where they live and work. With the Law of the Republic of Indonesia Number 10 of 2009 Concerning Tourism and bearing in mind that Tourism is an inseparable part of national development, the tourism potential of the Jayanti coast really needs to be given more attention by local governments to be developed, in order to improve the economy of Cianjur regency to be more prosperous.Keywords: Development; Tourism; Jayanti Tourism Potential; Tourism Potential.

Abstract

Badan Pertanahan Nasional juga merupakan Lembaga yang memiliki tugas pokok dan fungsi di bidang pertanahan yang sesuai dengan ketentuan peraturan perundang undangan yang nantinya akan menjembatani persoalan-persoalan yang berkaitan dengan tanah. Namun Faktanya yang terjadi dalam masyarakat tidak jarang ditemukan permasalahan sertipikat dengan kepemilikan ganda (dualisme sertipikat) di suatu wilayah. Tujuan dari penellitian ini memberikan pemahaman faktor apa yang menjadi penyebab terjadinya overlapping hak kepemilikan atas tanah yang dialami masyarakat di Desa Ciputri Kecamatan Pacet Kabupaten Cianjur. Dampak yang ditimbulkan akibat terjadinya overlapping hak kepemilikan atas tanah dan peran Badan Pertanahan Nasional dalam menyelesaikan sengketa akibat overlapping hak kepemilikan atas tanah. Penelitian ini menggunakan metode penelitian yuridis normatif yang merupakan pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Hasil Penelitian ini menunjukkan bahwa faktor penyebab overlapping yaitu, ada beberapa kepemilikan tanah yang saling mengklaim satu sama lain dan untuk penyebab lainnya diduga ada cacat administrasi dalam salah satu sertipikat, maka acuan datanya pun harus dikonfirmasi kembali pada pihak yang berwenang. Selain ada klaim dari pihak lain, ada indikasi penyerobotan lahan, melalui permohonan ulang untuk permohonan sertipikat baru, sehingga menjadi peluang sengketa.
