Abstract

Narcotics are substances or drugs that are natural, synthetic, or semi-synthetic which cause a decrease in consciousness, hallucinations, and excitability, and can cause dependence if misused. The problem is: How is the implementation of the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, 1988 towards eradicating illicit narcotics trafficking in Indonesia? The author uses transformation theory, legal certainty theory, and law enforcement theory in this thesis. The research specification in this thesis is descriptive analytical. The method used in this study is an empirical juridical method which is supported by a normative juridical method. The empirical juridical method is a research method carried out by researching directly into the field, while the normative juridical method is a research conducted by examining secondary materials. The data collection technique used is through interviews, which are supported by literature studies. The result of this study is: Indonesia has implemented the United Nations Convention Against Illicit Traffic In Narcotic Drugs and Psychotropic Substances, 1988 by ratifying the convention with Law Number 7 of 1997 as implementing legislation, as well as forming a law on narcotics, namely Law No. 22 of 1997 which was repealed by Law No. 35 of 2009.

Abstract

Management of regional property areas that are increasingly developing and complex needs to be supported by comprehensive arrangements adapted to developing needs so that the planning, implementation, and supervision processes can be managed optimally, effectively, and efficiently. Two problems need to be discussed and analyzed. First, what is the function of the Supervision of the Regional Finance and Assets Agency (BKAD) on the security of regional property in terms of Law Number 1 of 2004 concerning the State Treasury? Second, how is the implementation of Law Number 1 of 2004 concerning the State Treasury 1 of 2004? Whether the State Treasury can guarantee the Protection and Security of Regional Property. The research was conducted in a qualitative descriptive analysis with a normative juridical approach. The research sources used consisted of primary data and secondary data. The legal materials used in this study consist of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques were carried out in a documentary and interview. The results show that the Regional Finance and Assets Agency (BKAD) Supervision Function on the Security of Regional Property in Law Number 1 of 2004 concerning the State Treasury has been implemented by the Regional Finance and Assets Agency. Belonging to the region in the form of securing building land; Security of buildings and/or buildings; Security of official vehicles; Statehouse security; Security of supplies; Security other than building land and buildings; Security of intangible goods. The Implementation of Law No. 1 of 2004 concerning the State Treasury can guarantee the Protection and Security of Regional Property following the Supervision Function of the Regional Financial and Assets Agency (BKAD) on the Security of Regional Property

Abstract

Bidan paktik mandiri pada kenyataannya saat ini kurang memperhatikan dan memenuhi kelengkapan praktek serta kebutuhan kliennya. Salah satu tindakan terhadap pasien yang sering terjadi di BPM adalah komplikasi persalinan, di mana banyak kasus komplikasi persalinan yang tidak terungkap karena menganggap hal tersebut bukan suatu perbuatan melawan hukum, melainkan hal biasa yang dapat terjadi saat pasien melahirkan. Tujuan penelitian ini untuk mengetahui dan menganalisa tanggung jawab bidan praktik mandiri terhadap pasien yang mengalami komplikasi persalinan berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, serta untuk mengetahui dan menganalisa komplikasi persalinan yang dilakukan oleh bidan praktik mandiri yang dikategorikan sebagai perbuatan melawan hukum. Adapun jenis penelitian yaitu penelitian hukum normative, dengan pendekatan penelitian yaitu pendekatan undang-undang, konseptual, dan kasus. Sumber data adalah sekunder dan primer. Teknik pengumpulan data studi pustaka dan wawancara. Analisis data adalah kualitatif.

Abstract

This study addresses the critical need for increased understanding of halal product certification among Micro and Small Enterprises (MSEs) in Pasanggrahan Village, Indonesia. Halal compliance, encompassing raw materials, production processes, and storage, is essential but difficult for consumers to verify without certification. The Indonesian government, through Law No. 33 of 2014, aims to ensure halal product availability, safety, and value for businesses. This research focuses on empowering local communities by combining halal education and legal counseling to enhance MSEs' understanding of halal certification. The findings highlight the importance of joint supervision and collaboration with village officials to ensure compliance and support local enterprises. This study contributes to improving halal certification awareness and strengthens the legal framework for halal product assurance in Indonesia.

Abstract

The Philippines filed a case against China at the Permanent Court of Arbitration (PCA) in 2013. The case concerned territorial disputes in the South China Sea, particularly China’s territorial claims over nearly the entire region. The PCA issued a ruling in 2016 rejecting China’s claims, referencing Annex VII Article 11 of the 1982 UNCLOS, which states that PCA decisions are final and binding. However, China rejected the PCA ruling for several reasons. The purpose of this research is to examine the reasons behind China's rejection of the PCA ruling and the consequences of this rejection. The research employs a normative juridical method focusing primarily on legal materials, as it considers legal rules of a normative nature. The data used in this study is secondary data. China rejected the PCA ruling for several reasons: first, China considered the decision invalid because they never consented to the arbitration process initiated by the Philippines. Second, China argued that the PCA lacked jurisdiction to adjudicate the dispute. China's rejection of the PCA ruling highlights the weaknesses of international law and poses potential threats to sovereignty and security in the ASEAN region, including opening opportunities for illegal activities in the South China Sea.

Abstract

Armed conflicts have severe humanitarian consequences, especially for civilians. Among the most vulnerable are children, who require specific protection under international law. This study examines two critical questions: how the 1949 Geneva Conventions regulate the protection of children in armed conflicts, and whether the protection of children during the Russia-Ukraine conflict aligns with these legal frameworks. Using legal protection theory and humanitarian principles, this normative juridical study analyzes literature and secondary data. The findings reveal that the Geneva Conventions, along with Additional Protocols I and II, explicitly protect children in armed conflicts. However, the study also highlights a breach of these protections in the Russia-Ukraine conflict, where recruitment of minors as soldiers violates international law. This research underscores the urgency of ensuring compliance with international humanitarian law to safeguard children in war.

Abstract

On July 12 2019, there was a pipe leak and a gas bubble oil spill belonging to PT Pertamina. PT Pertamina's pipeline leak in Karawang waters which has an impact from the oil spill threatens the ecosystem and the people around Karawang waters. Marine pollution cannot be seen only as a problem that occurs in the sea, because the oceans and land are an ecosystem unit that cannot be separated and are affected by one another. As a result of this incident, a problem arose regarding PT Pertamina's legal liability due to a pipe leak that caused marine pollution in Karawang waters. This research uses the normative juridical method. The purpose of this research is to find out the regulation of marine pollution actions carried out by PT Pertamina in the offshore area and to analyze the form of accountability. The results of the study can be concluded, firstly, that the regulation of marine pollution actions based on UNCLOS 1982 is contained in Articles 192, 194, 195, 196 and Law Number 32 of 2009 concerning Environmental Protection and Management. Secondly, in the form of liability for marine environmental pollution as a result of PT Pertamina's oil spill, there are three legal responsibilities (administrative liability, civil liability, and criminal liability).Keywords: Marine Pollution, Oil Spills, Accountability, UNCLOS 1982.

Abstract

The lawsuit filed by South Africa against Israel regarding alleged acts of genocide against Palestinians, submitted to the International Court of Justice (ICJ) on December 29, 2023, raises a central legal issue concerning South Africa’s legal standing under Article IX of the 1948 Genocide Convention and the Statute of the ICJ. This study adopts a normative juridical approach using a case study method with descriptive-analytical specifications, based on secondary data obtained through literature review. The analysis is grounded in international legal theory, particularly the jurisdiction of international courts and the principle of obligations erga omnes partes. The results show that South Africa holds legal standing to bring the case, as the Genocide Convention grants all State Parties the right to raise disputes regarding violations, regardless of direct involvement. However, the ICJ’s jurisdiction remains contingent upon mutual consent, which Israel has denied. This rejection poses a barrier to judicial resolution. Therefore, South Africa may need to pursue diplomatic and multilateral efforts to secure jurisdictional recognition and strengthen evidentiary claims related to the alleged acts of genocide. This research contributes to the scholarly discourse by reinforcing the applicability of the erga omnes partes principle in genocide-related disputes and by offering a legal analysis of jurisdictional constraints at the ICJ, thus providing a valuable reference for understanding third-party state standing and the enforcement limits of international adjudication in politically sensitive cases.
